Settlements this week

The run up to the end of the year is always an extremely busy period.
We are focussed on getting as many people in (an out) of their homes in the lead up to Christmas as possible to meet their contract obligations.

As it stands, the 16th, 17th & 18th of December already have double the number of settlements of an average day.
We will work hard to make sure all these transactions settle on time.

To make this happen we ask for your support in ensuring that your workspace is prepared as early as possible.
Two critical components of this are ensuring the Transfer is created immediately if you have not already done so, and entering total funds required as early as possible.

If your workspace has the Enhanced FSS activated, you’ll be agreeing funds due for settlement and selecting ready for shortfall or surplus.

This will allow us to prepare as many settlements as possible prior to the settlement date.

Additionally, if there is any settlement scheduled for these dates that is unlikely to be ready, we ask that you consider changing the settlement date.

Your support and patience is greatly appreciated.

Saving Time and Being Vigilant of Cyber Fraud Leading up to Xmas

As we head into the busy period for settlements in the lead up to Christmas and the holiday season, time is more precious than ever, as is protecting you and your clients from cyber crime. Email fraud, phishing attempts, scams and reported losses have increased since the COVID situation came into effect, and it is critical that firms are doing all they can to mitigate this risk.

The common misconception is that fraudsters can only manipulate the body of your email, where they can in fact tamper with attachments (including editing PDFs), send completely new emails whilst posing as a client or practitioner. I have unfortunately seen this occur on a number of occasions with clients I work closely with, and whilst verifying bank account information is important, it can be missed by even the most experienced operators. We are all human, after all. It only takes one incident, which could cause a significant impact and distress to all parties involved.

Front and centre, PEXA Key should be used to eliminate the need to ever use email to transmit bank account information - this is where the risk is. Having to re-key bank account details also presents the risk of data-entry error. Eliminating risk is one thing, but leading up to a hectic time of the year, using PEXA Key will also save you valuable time by removing the need to draft and send emails with bank account information, then potentially going back and forth chasing the client to verify account information.

Leesa, you’ve been a lawyer for 5 years now, what has that journey been like for you?

I love being a lawyer and am grateful I found a career path that I enjoy so much. There have been times when the journey has been a little shaky but I have always been surrounded by supportive people.

Living and working in a regional town like Toowoomba must have many benefits, can you tell me a few?

Absolutely, I have found the larger percentage of the community want to provide support, and see other businesses succeed. This has led to a lot of opportunity for collaboration, which has really been highlighted to me in starting my own business with the relationships I have formed and the people I have met over the last 15 months.

What’s one thing you think Toowoomba has over any other place in QLD and one thing you wish it had?

I grew up in Yeppoon – so can I say I wish it had a beach and some islands? The thing I find Toowoomba has is a lot of opportunity and diversity, and despite being a larger town – there is still a strong community feel.

What is the one piece of advice you would give to your 18 year old self?

Don’t sweat it if you don’t have it figured out. You are still young and you never know where life will take you. At 18, I never would even have imagined being a lawyer, and look where we are!

Hi my name is Helen, I have been at PEXA for nearly four years as a Practitioner Specialist, and being a rural girl myself I am so passionate about regional firms. It is my absolute pleasure to virtually service all Regional QLD. Before COVID I would visit them every few months or so. I miss catching up with them face to face, but love supporting them virtually as they transition to digital. Over the next month I will be bringing you a series of Q & A’s with some of the firms that make up my portfolio. I hope you love getting to know them as much as I have.

Maddie, you not only run a law firm, but you run it with your family? What is that like!?

It can be challenging at times but it is also very rewarding. I am lucky to be able to do something I love and be doing it with my family and for my family. It’s my father’s legacy so it means so much more doing it all together.

You’ve got a young family, what is your best tip for people who like you juggle both?

Don’t be too hard on yourself. You are only one person. Prioritise, keeping calm and having good protocols in place are key for me. I have to be super organised.

What’s your favourite thing about property law?

I am a very routine and structured person and that’s what I like about property law. As much as it can be the same it can also be so different. No day is the same.

Fast forward 10 years, where will you be?

Hopefully still running our little practice in our beautiful, buzzing coastal town and offering people quality legal service with my beautiful family behind me.

Member Support Centre: Common calls #1

Hi Community,

My name is Vanessa and I work in our Member Support Centre. I’m here to deliver some settlement tips and tricks, based on the calls and feedback we receive from members, We've identified that many members have been asking the question; Why are fees missing from the Destinations?

For fees to be automatically populated in the ‘Destinations’ tab on the settlement screen, all of the documents need to have passed lodgement verification.

Lodgement verification is the process where the documents are sent to the Land Registry to be reviewed and return from the Land Registry with a Document Verification Result (the fees are also returned at this point).

Lodgement verification can only occur when all documents have a Document Status of ‘Prepared’. Any document with a Document Status of ‘In Preparation’ indicates that the document is missing information and will need to be edited and saved to trigger lodgement verification.

HANDY TIPS:

Edit the document to help assess what information is missing, also check the ‘Participants Screen’ to ensure all Party details have been entered completely. An ‘i’ beside a participant name will indicate that further information is required.

Lodgement fees will be attributed to the Responsible Subscriber (lodging party). The Responsible Subscriber can be changed via the Lodgement Instructions on the ‘Document’ screen.

Some PEXA Subscribers will have a Profile setup in place where their PEXA fees are collected outside of the workspace and therefore will not be reflected in the Financial Settlement schedule. We advise to liaise with the relevant party to confirm this.

Message from Land Services SA: The importance of the Priority Notice

With the ever changing circumstances of the COVID-19 (Coronavirus) pandemic, it is timely that I remind you of the importance of the Priority Notice, when transacting land.

Priority Notices play an important role in mitigating potential fraud and provide a similar level of comfort as that of the Duplicate Certificates of Title did, prior to the introduction of electronic conveyancing.

The use of Priority Notices is encouraged as it protects consumers and their interests when transacting land. This is particularly important in an environment where lodgement occurs through the different mediums of paper and electronic channels.

It becomes even more relevant should an event arise where dealings are either unavailable electronically and/or you cannot attend the Land Services SA’s office in person.

Digital Certificate Shell Replacement

Lately, there have been a few members who have been in contact regarding cracked or loose digital certificates. This can sometimes cause intermittent signing issues but members will be happy to hear that there is an easy solution for this.

A new shell can be ordered via our Support Team, who can be contacted on 1300 084 515. The cost of replacement is $10 after a PEXA subsidy, which is direct debited from your general/office account. The new shell will be sent in the post.

Upon receiving the new shell, it will be necessary to remove your digital signing SIM card from your old shell and insert it into your new shell/USB. In the interim, some tape can be used to tightly hold the casing together which should solve the problem until your new shell arrives in the mail.

Pexa flawed system

we are in process of arranging finance to complete our house build.
our original date that we’re aiming for settlement was 20 March and fell over when one party suggested that they didn’t have all required paperwork from the other. No alarms or alerts were in place meaning that unless the broker was on top of it no one new until was too late.
A new invite was sent and now all parties have accepted except one has not accepted time and date!!
No one can tell us when this will happen or who can contact to find out. Everyone just putting hand up and saying they don’t know. Doesn’t leave us in a great position as we are desperate for this to happen urgently. The old LTO system would be much better but obviously now with covid this has become problematic.
Frustrated!!!!

Adjustments and Payments disappearing

There is a quick fix, go to administration tools, manage subscriber details and go half way down the page to

Financial Settlement Schedule - Adjustments preferences, click on the display and adjustments and remember to hit save!

As more of our members are keeping their businesses operating with staff working at home, we thought it would be worth sharing some tips that may assist with the transition, insofar as PEXA is concerned. Although PEXA is a web-based application, and can be used anywhere you have an internet connection, there are some factors to be mindful of –

Digital Signing Certificate Software

If you are a signer in PEXA, and will be signing on a computer you haven't signed on before (perhaps a personal laptop, as opposed to your desktop computer in the office), you will need to ensure you have downloaded and installed the digital signing software, which may be found here. Please take note of the number of steps you need to follow for your preferred browser, and proceed through them sequentially. If you do not have administrator rights to your computer, you may need to ask your administrator to complete the download and installation for you.

If you are using a Mac computer, please note that the signing software is not yet compatible with their latest operating system, Catalina. For other Mac operating systems, please follow the instructions in this link.

Of course, it goes without saying, please remember to take your digital certificate home with you, and ensure it is stored safely when not in use.

Multi-factor Authentication (MFA)

Although users have the option of receiving their MFA code via SMS or the smartphone app, we find the most reliable option to be the latter. The code is generated immediately in the smartphone app for users to transcribe into PEXA, and while it is likewise generated immediately for the SMS option, there can be latency issues with some telecommunication providers that mean the code is not received by the user for some time. For more information, please see this article, and if you would like assistance moving from SMS to the smartphone app, please contact our Support Centre on 1300 084 515.

Verification of Identity (VOI)

We know many of our members are hesitant to meet with clients face-to-face now to complete their VOIs, which is perfectly understandable. At this stage, Australia Post, ZipID and ID Secure are conducting VOI appointments as per usual, so you may opt to outsource at the moment.

Using PEXA Key

PEXA Key provides your business with an extra layer of security when communicating bank account details and allows homebuyers and sellers to track their settlement on their phone. Bank and trust account details are communicated via the PEXA Key app, removing the need to use email and mitigating you and your client’s risk of succumbing to phishing attacks. For more information about PEXA Key, visit our help page.

Hello Community,

In conjunction with our recent Member Open Day on 28 February, we were pleased to host PEXA’s 2020 Community Super Users – our third cohort of Super Users since the launch of Community back in 2016.

What is a Super User? Great question! Super Users are members of this forum who regularly showcase a willingness to assist others in our Community, and to share their experiences of using PEXA in the hope that doing so will help other members. In an increasingly busy world, that these people take the time to participate so actively here on Community truly is inspiring.

We had nine Super Users, with representatives from practitioner firms and financial institutions all over Australia, join us (, , , and me) in Melbourne, the evening prior to our Member Open Day. We had a great time getting to know one another while testing our putting skills at Holey Moley’s mini golf course at Crown, before heading off for dinner and drinks. Well done to for taking out mini golf, and thank you to all for your enthusiastic participation.

The next day was action-packed for our Super Users, who had an exclusive program before the formal Open Day agenda commenced at lunchtime. They had the opportunity to meet with a number of PEXA’s Group Executives, participated in an ideation session with on the future of Community’s Help Centre, learnt about what goes in in Member Support with and , and had a chance to speak with about what’s coming up in future PEXA releases.

We are so fortunate to not only have such engaged PEXA members, but to have them so active here on Community as well, helping others in the network. Keep an eye out on Community for their special Super User 2020 badges, which will appear next to their names very soon.

Linked settlements

I just wanted to say how pleasantly surprised I was when completing my first linked settlements!

I just used the PEXA Help Centre and watched the short and concise tutorial (https://community.pexa.com.au/t5/Help-Centre/Completing-a-Simultaneous-Settlement-Help-Centre/ba-p/2470 ).

From there it was a simple task to link my settlements. The other parties had simultaneous settlements too, and in the end we had a link of 4 simultaneous settlements that all settled seamlessly.

I was very impressed at how simple it was.

Bullying By the E-Conveyancing Regulators

I have just sent the following query to SubscriberReviewProcess@pexa.com.au and DELWP:

"Dear Sir/Madam,

I believe that my law firm is being unfairly targeted because I have been outspoken about absurdities I have identified in the subscriber compliance requirements.

I have written a letter of complaint to DELWP after a member of my staff received a second compliance audit, and was then falsely accused of non-compliance.

I have now sought dispensation due to a physical disability I have in relation to the USB key and password requirements, but I have received no response to my request. After following up with DELWP this morning on this issue I find that my law firm is now the target of PEXA compliance audit.

Please explain as to why my firm is being overwhelmed with compliance audits and reviews, and whether this is an attempt to silence me through a form of regulatory bullying."

I am growing tired of these micro-managing bullies who want to quote rules and regulations but fail in developing workable processes. The present requirements force otherwise compliant professionals to find non-compliant work-around alternatives, just to be able to complete a day's work. Not good enough!

Conversations in PEXA

I have had an issue with the change to mortgagee on title conversing with incoming purchaser.

Purchaser is re-financing properties and at the same time purchasing a property. The mortgagee on the title of the properties being re-financed has been conversing with the vendor's solicitor of the property being purchased. I am unable to converse with this mortgagee.

There are two mortgagees on title in this instance: one is the discharging mortgagee on the property being sold, and two is the discharging mortgagee on the purchaser's properties being re-financed.

My First PEXA Settlement - Taitz Solicitors

January 2020; As the much needed rain falls in NSW today, earlier this week I caught up with Lionel from Taitz Solicitors over breakfast to discuss his first settlement through PEXA and what it meant to him and his business.

Paul; Going back to October 2016, your first settlement on PEXA, how did you feel leading up to settlement date, did everything go smoothly?

Lionel; The settlement itself went ahead with no hiccups at all. I was certainly a little worried as I was entering the unknown with E-Conveyancing. We agreed with all parties we would settle at 5pm and the banks and Purchaser solicitor all worked together to make sure everyone was ready.

Paul; Were you nervous at all leading up to the settlement time on the day?

Lionel; I definitely had a few nerves, but I had tremendous support from both my PDS and the support line. My nerves we’re eased even if the workspace did not enter ready, ready until later in the day.

Paul; What feelings did you have with the new electronic documents, electronic signing and entering of payments directions?

Lionel; I was surprised how easy the platform was to navigate, I’d had a demonstration and excellent support from my PDS, so I knew where things were supposed to go. The settlement screen back then was a little more complicated than it is now too with both vendor and purchaser destinations together.

Paul; What are your feelings on PEXA now compared to 2016?

Lionel; I think PEXA has certainly helped the conveyancing industry. I no longer need to take the 45-minute trip to Land Registry Services or get my agent to lodge my documents at a cost. I’ve also been able to settle many matters whilst I have been in the USA and South Africa which I would not have been able to do using the paper way.

Paul; Is there anything further you would like to add?

Lionel; Just another shout out to the support I have received and still receive from both my PDS and Support Centre at PEXA. They have been amazing, are very knowledgeable and more than happy to help.

Taitz Solicitors are now a certified user and on course to complete 200 Settlements through PEXA in the coming days.

Hey guys,

It’s been an awesome first week on the job as SA’s newest PEXA Direct Specialist. I have spent my last few days in training with the team here in Adelaide and heading out to meet some of our members. These initial meetings, even with people I’ve known a long time, has by far been my favourite part of my induction. It is great to see so many PEXA advocates in the community who are excited about and using the PEXA platform, and impressive just how far and wide it is actually being used! 💻📚

Being a Registered Conveyancer who has worked closely with the platform, I hope to bring a familiar face and an open ear to all PEXA members. I have been there before, and walked along the same path as many of you, so I understand the complexities from both the practitioner and panel member perspectives. 👂✍️

Banks dealing with transfer and linked refinance

I have had poor experiences lately with incoming mortgages badly managing a linked refinance settlement that is connected with the IP's purchase lending .. it is the IM's responsibility to ensure that the linked transaction is connected to the settlement workspace (with an appropriate time as simultaneous settlement) and to ensure that the linked matter is put in ready status BEFORE the required settlement time .. too often the IM appears to just ignore the matter and leave it up to the refinance OM to get it ready -- that only causes delay and often results in a purchaser breaching a contract and incurring costs and penalties .. banks need to be more vigilant with the refinance side of things!

PEXA Key - Why is it Essential for Every Firm Conducting Conveyancing

There is now a secure way to transmit bank account details that offers a safer alternative to communication channels such as email. Emails have the risk of being intercepted by a third party and funds are then subsequently directed to the incorrect account. It is an issue that unfortunately will not go away anytime soon and to eliminate the risk to firms and their clients, there has been investment made to develop PEXA Key.

PEXA Key allows practitioners and conveyancers to send trust or source account details to clients, and/or request client bank account details for surplus funds via the PEXA workspace, removing the need to use emails for this task. When account details are received from the client using PEXA Key, they will populate directly into the workspace without the practitioner needing to re-key this information. This removes the risk of data entry error by the practitioner.

PEXA Key also allows clients to track their settlement and have access to basic information such as date, time, address, your firm's details and "what to expect" articles that explains frequently asked questions about the settlement process. Clients DO NOT have access to the workspace or see any documents, figures in the financial settlement schedule, conversations etc. This is a common misunderstanding that has been raised by firms, so it is important to understand that PEXA Key will only provide limited information to buyers and sellers.

If there is no need to communicate bank account information for a matter, clients can still be invited to use PEXA Key to see when their property is settling, once it starts to settle and when it has completed. So, this means all clients can benefit from using PEXA Key irrespective of whether bank account details need to be exchanged. For those buyers and sellers who are fans of social media, there is also an option to post the "settlement completed" notification onto social platforms to share their excitement with friends and family.

Clients will download the PEXA Key app exclusively from the App Store or Google Play, whilst firms will manage everything from their workspace. To reiterate, firms DO NOT need to download the app, everything is managed from the existing workspace via a few buttons. Buyers and sellers can contact PEXA Support should they require assistance with downloading and activating the app.

Change of Name Process WA

Transactions in WA where the Seller has changed their name from what is on the Certificate of Title can be completed in PEXA.

The PoT representative can update the party name that pulls through from the land registry when editing their participant. This will prompt for a justification for the name change to be selected from a list of options, before saving the updated party.

Any evidence required for the change of name is to be retained on file.

For the IP role, when completing the Certificate of Duty, it only needs to show the Seller with their current/updated name. Reference to "formerly known as" isn't required.

NAB - not accepting settlement date until 2 days prior to settlement regardless...

We just had a conversation with NAB settlements advising that they now only accept settlement dates 2 days before settlement even if they are ready sooner.

I just don't understand the reasoning. I always accept the settlement date but I still have to order searches, do figures and set up settlement but I accept the fact that is the settlement date to which I must be ready for. We are only asking that you accept a settlement date which indicates to us that you are ready for settlement. I get it that last minute issues may arise. Do we need another status of "ready but not telling anyone just in case..." ?

What if everyone in the workspace took this stance ?

Issues with Bank of Queensland PEXA settlements

Any suggestions welcome..... I have a BOQ refinance matter to be settled in PEXA. All parties have accepted the time and date for today at midday, therefore assuming that all parties are ready. I have sent conversations to BOQ to upload source funds to no reply, I received a "random" reply to my conversation stating "the documents were on hold" and then when I requested information regarding the issues I received no further reply. I contacted BOQ by telephone and prior to "Michelle" hanging up on my call was advised;

1. settlement won't happen today;

2. no supervisor is available to speak with me;

3. she doesn't know why the PEXA team accepted the settlement time and date;

4. I can't speak with the PEXA team - just send a conversation

Obviously I have sent conversations which have neither been read nor replied to....... I understand that the transfer Guidelines are just guidelines however it appears when they are not followed (even remotely) then there is no recourse....

Revenue NSW - Interest

This is for pexa and your next meeting with Revenue NSW. We have just noticed that Revenue NSW has just added additional interest at 2:07pm. When I last checked the workspace and downloaded a copy of the settlement statement at 1.25pm there was no change. I called to Revenue NSW and advised there was nothing they could do, as this is when there system updates the interest calculation. Any additional daily nterest should be updated first thing in the morning not prior to settlement.

Essential tips for using the new PEXA Projects bulk upload process

As of June 17th, 2019, it is no longer required to have your spreadsheet converted to a csv file by a team member at PEXA. This mapping process is now built into PEXA Projects, so you can upload your file and create the workspaces or upload child titles without assistance from your PEXA Specialist.

To download a sample template of what data is required for your upload, first create the Project in PEXA Projects and then go to "Manage Workspaces" in your dashboard and click on "Bulk Upload Workspaces". It is here that you will find a link to "download a sample template". This template also has a "help information" tab which outlines the requirements/restrictions in the spreadsheet to ensure your upload is successful.

Important tips:

You must label the tab that contains the data as “Workspaces”
Purchaser names must be separated by a comma (,). It will no longer work with '&' or ‘and’
In your spreadsheet, only have the columns that are relevant, that is, lot, reference, purchasers' reps, purchaser names, consideration (no cents), child title
Use the PEXA Qualifier Tool to wash all the conveyancer/solicitor names to ensure you are using their registered name in PEXA - your PEXA Specialist can provide you with the link to access this tool
Always ensure you create your vendor as a frequently represented party in PEXA Administration Tools prior to uploading child titles - this allows your party representation to be automated in 'participants'

Registering a Lease

I recently opened a workspace to register 2 leases on one title. The workspace went to lodging and then stopped for a couple of days. Then I received via email the requisition from NSW LRS that we had entered "WHOLE" instead of "PART" in the drop down box. I was advised by NSW LRS to rectify the error that I now have to send the leases down to NSW LRS for them to fix it (kinda defeats the whole purpose of PEXA but that's another conversation for later).

I accept the error but why did PEXA data entry allow me to make the error ? If there is more than one lease to upload you should not get the option of WHOLE it should tell you that there is an error in your data entry. The data entry should be a formula along the lines that leases greater than 1 should only be allowed the option PART. PEXA can you please respond if this can be fixed on the data entry screen ?

I am also not sure how this is going to be fixed because NSW LRS are telling me they have no access to the PEXA workspace and PEXA are advising that i can't cancel or amend the workspace as it has started processing and is locked. So who has the key to open it and fix the error ? So I now have a PEXA workspace 3/4 of the way through a process stuck on "LODGING" with a pending settlement next week. Also - we were unable to process these leases on the sale workspace because the names didn't match up. So act cautiously if you think that registering of leases can be incorporated into a sale/purchase workspace as it was not possible in our case.

I await feedback from PEXA and NSW LRS

Transfers: What’s In and Out? Western Australian (WA) PEXA Eligibility and Scope (Part 2)

In addition to the lodgement criteria outlined by Landgate, the Office of State Revenue has its own requirements for transfer transactions to be assessed, then settled and lodged on PEXA.

Only certain transactions that are self-assessed through the Online Duties Portal in the WA Revenue Online (ROL) system are eligible to proceed on PEXA.
The duty payable from transactions completed in this manner is deducted from your firm’s ROL linked trust account on a monthly billing cycle.

It is important to note that transactions which are considered “complex assessments” and assessed through the OSR Duties Lodgements Portal or other methods will be UNABLE to proceed on PEXA.

If you have assessed your transaction through the incorrect method, please call the Office of State Revenue to have them remove your lodgement. You will then need to recomplete the assessment through the Online Duties Portal in Revenue Online.

Below we have included a copy of the Office of State Revenue’s list of transactions which are eligible and ineligible for settlement in PEXA. The latest version of this can be found here.

Transactions self-assessed in Online Duties eligible for settlement in PEXA:

There is an agreement (e.g. a contract for sale / offer and acceptance) in place.

The purchaser on the agreement is an individual, corporation or trustee of a trust or superannuation fund.
For example, Super Fund Pty Ltd executes a contract for sale to purchase a property as trustee of the ABC Superannuation Fund. A transfer of land is then executed to transfer the property into Super Fund Pty Ltd’s name.
The purchaser on the agreement substitutes their interest in the property to a related transferee on the transfer.
For example, Mary executes a contract for sale to purchase a property. Mary decides to substitute 100% of her interest in the property to her son.
The transaction is between related parties (if there is an agreement in place).
For example, Louise executes a contract for sale to purchase a property from her father.

Transactions self-assessed in Online Duties ineligible for settlement in PEXA:

Transactions which are:

Transfers of land without an agreement or contract in place
For example, a transaction between related parties where they decide not to draw up a contract.
Acquisitions of new dutiable property on its creation, grant or issue (e.g. easements)
For example, Greg agrees to grant an easement over his land to a utility services provider.
Surrenders of special dutiable property (e.g. easements)

Agreements to transfer business assets. Transfer of business assets are not registered with Landgate so are not eligible for electronic settlement.
Related party transfers of land from an individual to their superannuation fund (where it is eligible for nominal duty)
For example, Sue executes a contract for sale to transfer an investment property she owns to her superannuation fund. The transaction was self-assessed for nominal duty of $20.
Transfers of land from a discretionary trust to a beneficiary of the trust (where it is eligible for nominal duty)
For example, Bob, as trustee of the Smith Family Trust, decides to vest part of the trust property to Mary who was a beneficiary at the time the property was acquired. The transaction was assessed for nominal duty of $20.

Any transaction where the interested parties (transferor or transferee) is acting in their capacity as:

Administrator
Executor
Custodian

Any agreement to transfer land, where there is additional duty payable on the transfer (e.g. subsale transactions)

Any transaction where foreign transfer duty is payable (or exempted)

Any transaction that is assessed by State Revenue (e.g. not self-assessed)

A verification service confirms the transaction data entered in PEXA (party details, land information, contract date and consideration) is the same as that entered into Online Duties. If the data cannot be verified and matched, you will be required to review the data entered, based on the error message returned from OSR into the PEXA Workspace on the “Transfer Duty” screen.

If you are experiencing issues in verifying your duty, please refer to our Trouble-Shooting Guide (attached below).

Following successful verification:

The Online Duties facility will automatically notify PEXA of the duty payable (if any);
Duty will be payable to State Revenue under the Online Duties monthly return;

PEXA Success for Stevens Partners

Karen von Einem and I on behalf of Stevens Partners are excited to have completed our first complex PEXA settlement over 5 financially linked workspaces, involving numerous participants with interests across all workspaces and lodgement of twenty documents.

It was exciting to have a platform that allowed us to deal direct with solicitors from several other states. What was particularly beneficial is, that by dealing with them direct, we were able to overcome the need for these parties to be separately represented in South Australia and therefore quite complex VOI procedures did not need to be repeated before the settlements could proceed.

Once we had achieved “Ready Ready” on all workspaces and the settlement time ticked over, the settlements were completed simultaneously and funds disbursed, all within about 20 minutes, whereas without the PEXA platform the settlements would have taken hours due to the number of parties involved and the LTO lodgement sequence required.

Jeff Stevens, our principal at Stevens Partners has been a great advocate and supporter of the PEXA platform and below is a link to his recent discussion with Daniel Roesler of PEXA.

I have just been told by CBA that they are "at full settlement capacity tomorrow and are unable to settle" my simultaneous tomorrow. This is despite accepting both invitations 5 weeks ago knowing the settlement date was tomorrow, sending me conversations 6 days ago that the files were both in certifications for settlement, then suddenly the day before, they are at full capacity and received a directive yesterday unable to take any more settlements tomorrow. I asked the question was there something late or wrong with our documents that is now going to delay settlement and the response was, they are just at capacity, that's it. How can this be???? is this some kind of a joke??? Clients have removalists booked, all is in order for both settlements, there are significant ramifications on this. Anyone else having issues?

Company name change to Beyond Bank Australia Limited

Effective 1 July 2019, Community CPS Australia Limited (currently trading as Beyond Bank Australia) is changing its legal entity name to Beyond Bank Australia Limited. The organisation’s ACN, ABN, ACL numbers will remain the same.

PEXA will update the Qualifier Tool which will direct parties to invite Beyond Bank Australia Limited where Community CPS Australia Limited is registered as Mortgagee on Title.

Priority notices will need to include ‘Beyond Bank Australia Limited’ (and not Community CPS Australia Limited) where the Bank’s documents are executed on or after 1 July 2019. Please contact Lending Operations on 08 8205 8778 or email lasa@beyondbank.com.au to confirm which entity name should be listed on the priority notice during the transition period.

Land Use Victoria lodgement fee for a transfer with consideration 2019-20

Practitioners should take care to check that the lodgement fee for a Victorian transfer with consideration for a matter settling in 2019-2020 has been correctly provided on the Financial Settlement Schedule. Transfers created before 20/6/2019 may be affected by an error where the lodgement fee will include an extra $89.50. This error can be easily identified, as a correct lodgement fee for a transfer with consideration will always be an exact number of whole dollars.

If a lodgement fee is incorrect, you need to refresh the Lodgement Instructions. One easy way to do this is to:

1. Add a second Transfer document to the lodgement. It can be for no consideration to the existing transferee(s).

2. Remove the second transfer.

3. Edit the Lodgement Instructions, and then Save them (without making any changes). This sequence of steps causes the lodgement to be re-verified, and the lodgement fee will then be re-calculated correctly.

New DOL Issues Arising - Victoria

Hi all,

Be aware of some new anomolies occuring as a result of the new DOL updates.

For example, ABC Limited (in full) and ABC Ltd (abreviated) will now stop claiming Duties Form Settlement Statement - there is no longer a pop up box, allowing an incoming proprietor to proceed, having evidence to support the difference.

This issue will mean that the form will require edit, which will unsign, and then re-signing by both parties.

My attempts to find a work around or solution from DOL, PEXA hotline or Land Use Victoria, took valuable time, and the only solution provided was to edit the DOL form.

A big shout out however to Mr Jonathan Teh, Executive Manager, Practitioner Services (Vic) who provided a practical solution to edit the Participant in PEXA to match the DOL form, and complete the justification reason as "approved abreviation".

Thank you Jonathan, you saved the day on this one.

There have been some additional issues raised with me by other subscribers, when trying to claim the form under the new regime, and we anticipate there will be more, but as they say .... stay positive, onwards and upwards.

What’s In and Out? Western Australian (WA) PEXA Eligibility and Scope

Since 1 December 2018, all combinations of eligible transfer transactions, mortgages and caveats are now processed online in WA. It has been amazing to see the transition of this workflow into the digital realm, and the enthusiasm in which many of our members have embraced the change. There are, however, still a portion of transactions which are currently outside of scope of electronic lodgement and settlement in WA. Establishing the eligibility of certain transactions can is important – incorrectly proceeding through the wrong lodgement method can result in significant lost time and money for parties involved.

To assist with this process, we have collated the following information from Landgate which outlines the eligibility criteria for documents required to be completed via electronic lodgement in WA. We recommend consulting this material before proceeding with settlement preparation.

In order to check if your title is eligible for electronic lodgement, use the land title lookup feature on the PEXA dashboard or when creating a new workspace.
Also remember that you can only proceed on PEXA if no party in the transaction is considered an incapable person pursuant to a State Administrative Tribunal order. Parties who are self-representing must also proceed through paper channels.
For transfers, only certain transactions that are self-assessed through the Online Duties Portal in the WA Revenue Online (ROL) system are eligible to proceed on PEXA. For further information, see below.
After you have established the above, check that your transaction meets the individual requirements of each document.

*Document type*	*Eligibility critieria*
*Caveat*	The claim type must be available in the ELNO The caveat must affect all of the land in a title All caveators named in the caveat must be represented by the same subscriber All registered proprietors must be affected by the caveat.
*Withdrawal of Caveat*	A withdrawal of caveat must not include a removal of caveat by a party that is not a caveator Withdrawal of caveat must cover all of the land in a title All caveators named in the withdrawal of caveat must be represented by the same subscriber The name of the caveator represented must be the same or justified to be the same as the caveator on the title.
*Mortgage*	Must be over all of the land in a title All registered proprietors must be mortgagors All titles included in the mortgage must have the same registered proprietors All mortgagees named in the mortgage must be represented by the same subscriber
*Discharge of Mortgage*	The discharge of mortgage must discharge all of the money in the mortgage The discharge of mortgage must discharge the whole mortgage from all of the land in a title The discharge of mortgage must discharge all of the mortgagees in the mortgage All mortgagees named in the discharge of mortgage must be represented by the same subscriber The name of the mortgagee represented must be the same or justified to be the same as the mortgagee on the title.
*Transfer*	A transfer does not include transmission or survivorship applications, mortgagees exercising power of sale, transfer of an interest, transfer under property (seizure and sale) order or transfer for sale for rates Transfer must include all of the land described in a title All registered proprietors must be named as transferors All registered proprietors must be on title without reference to any capacity such as Legal Personal Representative All titles included in the transfer must have the same transferors The name of the transferor must be the same or justified to be the same as the registered proprietor The transfer must have a consideration type that is either monetary, desire to make a gift, or natural love and affection The transfer must be pursuant to a contract of sale or a written agreement The WA Revenue Online System (Online Duties Self-Assessment portal) must be used to assess the stamp duty to be paid on the transfer. Some quick feedback to say the event was fantastic from my perspective. I personally do not get to attend many conferences anymore however for a long session, I must say the event was quite interesting and the speakers and organisation was fantastic!

Great opportunity to also meet more of the PEXA team and other practitioners and hear experiences, particular from interstate colleagues who are going through what we in VIC have gone through a year or so ago re transitioning!

Whilst all the speakers were great, Adam's hosting and Stephen's insight into global giant tech company's and silicon valley were my favourites (although if Marcus is reading this, he was the best speaker of course!).

For those that were not able to attend, I would strongly recommend making your way to the next one!

My only criticism, longer lunch, shorter afternoon tea would've been great to catch up on urgent work!

Cowell Clarke, becoming a pioneer of PEXA Projects in SA with KODO

This month, I have been working with Cowell Clarke, and the anticipated settlement of their KODO project. The KODO building at 29 Angas Street, Adelaide, is nearing completion and we have been preparing for the Proprietor on Title Role for the upcoming settlements through PEXA Projects. This will be easily the largest project to settle on PEXA Projects in South Australia so far.

With the project now active on our PEXA Projects platform and invitations out to other participants, Cowell Clarke are able to track and monitor the status of their project, invitation acceptance status and settlement date and time acceptance, along with a multitude of other benefits. This assists Cowell Clarke to provide a first class service to their Developer Client.

This project is also particularly important for South Australia, as the Mortgagee on Title is represented here in Adelaide by MinterEllison. MinterEllison will also receive the benefits of using PEXA Projects' Mortgagee on Title solution and will be the first firm to use the newly developed bulk creation of the discharge of mortgage document.

PEXA Projects has had extensive use and development particularly in Victoria and New South Wales, so it is exciting for me to be able to gather experience learned from the larger states, and put in to practise here in Adelaide.

An exciting time for both PEXA in SA, and Cowell Clarke as we eagerly look towards settlement.

My first 2 months at PEXA have been a whirlwind, that’s for sure! Initial weeks were spent training with the team in Sydney, with invaluable first-hand insights provided by a very welcoming and supportive crew! I was then lucky enough to head to Melbourne to be involved in Hack Day festivities. I was astounded by the level of technical smarts in the room and took the opportunity to absorb as much information as possible!

It’s been fantastic being back in Adelaide to reconnect with familiar faces that I’ve encountered (and developed friendships with) in my past life working as a Real Estate Agent and some years spent with SAI Global. This initially stirred my PEXA-curiosity around 3 - 4 years ago and I didn’t know much, only that the settlements landscape was about to change significantly! I’m extremely grateful that I’m now a part of this pioneering team!

I am looking forward to working with Daniel, Jessica and Matthew to further assist practitioner’s growth and confidence in PEXA. I hope to bring a genuine enthusiasm to this role and an additional source of support and fun for all PEXA members.

In attendance were members from right across the South West region, along with representatives from ANZ, CBA & Bankwest as well as various PEXA staff. We heard updates from the Banks around their e-con processes, and it was also great to have an open floor session where members could ask questions and gain insights from the Banks. Thursday night footy at its finest! The SA Conveyancing Community is a close group of professionals, so much so we watch footy together.

I received a very happy phone call today from a firm that they have completed 250 settlements! This firm was a little slow to embrace PEXA in the beginning but are loving the fact that with PEXA they have so much more time to open more files and have already opened up 100 new files so far for the year. They also love the fact that there is less paperwork to deal with in preparation for settlements, after settlements time out of the office, and attending to the banks to bank cheques which is great for a small practice.

I am so proud of them, they just kept going forward with PEXA and are now reaping the benefits......Well Done Spilva & CO

CBA disappointment

We had a settlement scheduled and we were waiting for CBA to add the balance of the source funds (our client had provided them with the authority). They added $1 instead of $150k. We called them half an hour later, they put in $45k..... still short, further telephone call......meanwhile settlement was delayed....they finally got it the 3rd time around. Their excuse was they had too many settlements on that morning. Seriously?

Stamp Duty Walk Thru

Have you seen the orange Walk Me Thru button on the Transfer Duty screen? This button launches a Walk Thru that guides you through how to verify duty in PEXA.

Here are some important things to note about verifying duty in QLD:

The stamping process starts in the PEXA Workspace so if you’re representing the purchasers, complete your Transfer and Form 24A first.
Go to the Transfer Duty screen in PEXA and select how duty is to be paid.
When all the relevant information is in the Workspace then an automated message will be sent the OSRconnect and a duty record will be created in there for you.
You can locate this record in OSRconnect using the OSR transaction number located on the PEXA Transfer duty screen.
When you have completed the assessment, come back to PEXA’s Transfer duty screen and click the cog to verify duty.

Don’t forget we would love to hear your feedback on our Walk Thru’s so we can continue to improve them.

Lodging a caveat is not a trivial act to be undertaken lightly. It has immediate legal effect and can have significant commercial and financial consequences. Legal practitioners and licensed conveyancers who advise on, prepare and certify caveats that are lodged electronically have an important role to ensure that obviously unmeritorious caveats are not lodged. This judgment arises from a failure by a licensed conveyancer to perform that role properly.
These proceedings were begun by the plaintiff (“Mr Guirgis”) for orders under s 74MA and s 74P of the Real Property Act 1900 (NSW) (the “Act”) for the removal of a caveat (the “Caveat”) and for compensation against the defendant. The sole director, secretary and shareholder of the defendant is Mr Guirgis’ wife (“Mrs Guirgis”). Mr and Mrs Guirgis are currently involved in a matrimonial dispute before the Family Court of Australia.
The Caveat had been prepared, certified and lodged electronically on behalf of the defendant over Mr Guirgis’ land (the “Property”) by a licenced conveyancer (the “Conveyancer”). When Mr Guirgis’ application came on for hearing, Mrs Guirgis appeared in person. It quickly became apparent that the defendant (Mrs Guirgis’ corporate alter-ego) did not have a caveatable interest in the Property and that at all times Mrs Guirgis had understood that to be the case. The defendant was ordered to remove the Caveat and pay Mr Guirgis’ costs of the application.
During the course of the hearing, evidence was given which caused me to form a prima facie view that the Conveyancer had acted either with a reckless disregard for her obligations in relation to the Caveat or had failed to meet the standard of care to be expected of a reasonably competent conveyancer in the preparation of the Caveat. I made directions which had the effect of the Conveyancer appearing before the Court to explain why I should not refer the papers to NSW Fair Trading so that its Secretary, who has regulatory responsibility for licensed conveyancers, could consider whether or not the Conveyancer’s conduct warranted disciplinary action.
The Conveyancer appeared before the Court. The Conveyancer apologised without reservation and acknowledged to the Court that there had been a complete departure from appropriate standards. The Conveyancer undertook to do further study in relation to the electronic filing of caveats as part of her annual professional development. On the basis of what the Conveyancer said to the Court, I was satisfied that it is highly unlikely that the Conveyancer would repeat such conduct in relation to a caveat and determined that it was unnecessary for the Court to take any further action in relation to the matter. Nevertheless, I consider it appropriate to publish these reasons to make clear how seriously the Court views the obligations of those who advise on, prepare and certify caveats.

I was privileged to attend a Real Estate Agent event hosted by Baldwin Lawyers, By The Rules Conveyancing, Swift Legal & AJT Law to give a talk about PEXA and all the benefits that comes with using it. The RE Agents were very engaged and asked some great questions. They were also lucky enough to witness a "live" settlement during the event.
