HI Everyone,

I would like mortgagees, both incoming and outgoing, given the ability to join an existing workspace.

It is so often the case that we don't know who the client will by borrowing from, or who will be representing the mortgagee in the PEXA workspace, and so it makes sense that I should be able to advise my client of the workspace details, and have my client pass these details on to the mortgagee or mortgagee representative.

This would certainly cut down on the communications and miscommunications with mortgage brokers, the law firms representing mortgagees and the mortgagees themselves.

Peter Mericka

Lawyers Conveyancing

Yes, while soft certificates may be an option, Subscribers will need to satisfy certain criteria (focused on the maintenance of a satisfactory IT security posture) in order to qualify to use them.
FAQ | New macOS Catalina

Hi Community,

This message is for Subscribers who sign in PEXA using a Mac computer.

Apple has released its newest Mac operating system, Catalina and while macOS Catalina is the most up-to-date software, the changes implemented by Apple affect how this operating system interacts with smartcards or USB tokens containing digital certificates.

PEXA together with its vendor have performed several tests which identified that those who sign with a Mac computer will not be able to do so if they upgrade to macOS Catalina.

To ensure that your PEXA experience is not impacted, we suggest that you defer updating to the macOS Catalina. Signing on the previous macOS versions such as ‘Mojave' continues to work and the operating system will remain under support by Apple for the foreseeable future. Note that it remains important to apply any issued security patches for your version of MacOS.

Alternatively, if you have access to a Windows computer you can use it to sign in PEXA as well. See https://www.pexa.com.au/digicert for instructions to install the necessary software.

Below, please find a list of frequently asked questions on the matter. Can’t find the information you’re looking for? Reply to this post and we’ll get back to you as soon as possible.

WIll deferring put me at risk of not adhering to pexa's subscriber security policy

MacOS Mojave is still supported by Apple, and using it will not breach any system requirements. Deferring upgrade to Catalina does not restrict the updating of security patches. It is important that your security patches are up to date and that you are using supported operating software.

I have updated my macOS to Catalina, and I’m now unable to sign, what should I do now?

You may use an alternative computer (Windows or one that is not updated to macOS Catalina) to sign. Note that you may need to install the digital certificate software, found here.

As an option, you may also check with Apple if you are able to downgrade to the prior macOS Mojave. Your ability to downgrade, could be subject to having backed up your system prior to the upgrade, and unfortunately, we are not able to provide you any guidance on this. We recommend contacting Apple or your IT support on this matter.

Can I still access PEXA if I’ve updated to macOS Catalina?

Yes, you will still be able to access PEXA but you will not be able to sign.

Is PEXA the only application affected by this?

No, the changes Apple has implemented with the macOS Catalina impacts the way it reads signing tokens (otherwise referred to as smart cards) in general and impacts other applications that use digital certificates.

When will there be a resolution to this?

PEXA is currently working on a resolution with our supplier, and we are not able to confirm if or when a resolution will be found.

As I am now not able to sign, can I give my digital certificate and PIN to my colleague?

No, according to the e-Conveyancing legal framework, MPR 7.1, sharing of digital certificates is prohibited. A digital certificate is equivalent to a wet signature and using someone else’s is akin to forging a signature.

Digital Certificates enable you to securely sign documents electronically on behalf of your clients, as well as authorise a number of key actions within PEXA. There’s a number of helpful resources on Community to assist you with maintaining and using your Digital Certificate – from these, we’ve put together our top five quick tips below.

Take care of your Digital Certificate

Digital Certificates are essential to facilitating electronic settlements on behalf of your clients – so please handle them with care! We request that you are particularly mindful of protecting the physical casing containing the Digital Certificate. Digital Certificates are not designed to co-exist on personal key rings and are meant to be kept in a secure location. All PEXA Digital Certificates are sourced from a third-party vendor and in case of a broken unit or its casing, the Subscriber will be responsible for the cost of a replacement token or case.

If restructuring your business, new Digital Certificates may be required

If your business is changing its legal entity, it’s important to note that you’ll need to re-register with PEXA. This process includes ordering fresh Digital Certificates in line with your new legal entity, as the tokens associated with your previous legal entity will not be able to be used to sign documents.

Ensure the details for your Digital Certificate are correct

Your name in PEXA must be identical to the name that is hard coded on your Digital Certificate. This includes the inclusion or exclusion of middle names, and names that do not match your legal name, such as the shortening of names – ie, Sam Vs. Samuel. Further to this, your email address in PEXA must be identical to the email address that is hard coded on your digital certificate, including the inclusion or exclusion of dots in between words.

You can change your name in PEXA if it is incorrect (ie. middle name included in PEXA but no middle name on Digital Certificate), however in order to change your name or email address on your Digital Certificate if ordered incorrectly, you must re-order the USB as changes cannot be made to the hard coding.

You must not share your Digital Certificate

The rules around sharing your digital certificate are designed to protect the integrity of the network, and the integrity of your signature. PEXA, the e-Conveyancing regulator ARNECC and jurisdictional land registries take this issue very seriously, just as your business would when dealing with a wet signature on paper documents. To this end, it is your organisation’s responsibility to verify the identity of any digital certificate users or recipients.

If you already hold a PEXA Digital Certificate and would like to purchase an additional PEXA Digital Certificate(s), you should complete this form.

You can renew your Digital Certificate via PEXA Plus

Digital certificates will expire after three years and must be renewed. Subscriber Managers/Administrators with an active Digital Certificate can renew Digital Certificates. Subscriber Managers/Administrators should access PEXA plus to view and action any upcoming expiries. We recommend you use Google Chrome for optimum performance. On submitting the renewal form, the Subscriber Manager/Administrator will be prompted to sign using their Digital Certificate. If you are not a Subscriber Manager/Administrator and have been informed that your Digital Certificate is expiring, you should get in touch with your Subscriber Manager/Administrator to submit a renewal form on your behalf.

FAQ | Joining an existing Workspace

Hi Community,

As part of PEXA’s Release 10.1.0, users in the role of IP and POT will now have the ability to join an existing Workspace. Below are frequently asked questions about this new functionality.

Can’t find the information you’re looking for? Reply to this post and we’ll get back to you as soon as possible.

Who can join a Workspace?

Only an Incoming Proprietor or a Proprietor on Title can join a Workspace. This functionality is not available for any other roles, for example, Incoming Caveators, Incoming Mortgagees, Mortgagees on Title.

What steps does a joining Subscriber need to go through before accessing the Workspace?

If a Workspace has already been opened, and the Subscriber is in the role of Incoming Proprietor or Proprietor on Title, they will see the Existing Workspace pop up screen (formally the Duplicate Land Title pop up screen) and now have the option to join. The Subscriber will then have to tick a checkbox to confirm that they are authorised to represent the said party.

If an invitation has already been sent to the Subscriber, they will only see a ‘View Invitation’ option on the Existing Workspace pop up screen.

What happens when a Subscriber joins a Workspace?

Existing participants in the Workspace will be alerted with a banner across the Workspace Summary screen with details of the joining party. They will also receive an email notification.

What happens if a Subscriber joins the wrong Workspace?

The Subscriber will be responsible for removing themselves from the Workspace. The existing Subscribers in the Workspace may request that the party who erroneously joined to remove themselves. Failing which, as they do today, existing Subscribers in the Workspace will need to escalate the matter to PEXA Support.

What happens when a party remains in the Workspace despite requests to leave?

Once the matter is escalated to PEXA Support, PEXA will then request the party remove themselves from the Workspace, or face the possibility of suspension.

Note that the Participation Agreement has been updated to include the obligation for Subscribers to join Workspaces only if they have the authorisation to represent a said party to the transaction. Persistent failure to comply could be met with suspension.

Can Subscribers remove a Subscriber who has incorrectly joined the Workspace?

No. The Subscriber that has erroneously joined the Workspace will be responsible for removing themselves.

What is the Participation Agreement amendment and when did PEXA communicate the change?

The following changes were incorporated in the Participation Agreement in May. The revised agreement was shared with all Subscribers via the May Clicks and Mortar newsletter (and direct by email for those who have unsubscribed to the newsletter)

Inclusion below:

4.1 (f): to only enter an Electronic Workspace where the Subscriber is authorised to represent party to a Conveyancing Transaction involving the Land Title Reference, the subject of the Electronic Workspace;

What can a Subscriber see when they join the Workspace?

Subscribers will be able to see title details, which is available in a title search. As per today, when Subscribers join a Workspace upon acceptance of an invitation, they will be able to see any information, if already entered that a Subscriber in that role would be able to view.

We have two Victorian matters where we hold first mortgage and there is a second mortgage. In both matters we wish to discharge the first mortgage. In the lodgement instructions we cannot direct the eCT control to the 2nd Mortgagee. We tried lodging a Nomination saying we don't want eCT control after the transaction, however we still need to complete issuing instructions (and the 2nd Mortgagee is not one of the choices).

Are we missing something here?

Baz.....

Thanks for the feedback. You'll be pleased to hear we are making this exact change in the next PEXA release. From the 8th April (Release 9.1.2) the User Report will contain a 'Last Active' column to help you identify inactive users within your organisation. I'd recommend using the CSV option so you can easily sort all your user records by this new piece of data.

R9.1.2 Release Notes

Regarding inactive users and our subscriber manager obligations it would be really useful that as Subscriber Managers (for large firms) if we ran the PEXA User Report (see the second attachment) that the report contained an additional column which showed the date of the last log in. Unless I'm missing something there is no other way to actually see if users are logging in.

FAQs - New User Activation

Hi Community,

As part of PEXA’s ongoing security initiatives, we have simplified and enhanced the new user activation process.

Previously, new users were activated via a partially manual authorisation process, which could take up to two days to complete. From 4 March 2019, this process will be replaced and subscribers can activate new users with a digital signature.

Below are frequently asked questions about this new process. If your question isn’t listed below, please comment beneath.

Who can create a new user?

Any Subscriber Manager or Subscriber Administrator with a digital certificate can create a user – no additional form of signing permission is required. When a new user is created, they will remain in a status of ‘Pending’ until activated.

Who can activate a newly created user in the status of ‘Pending’?

New users can only be activated by Subscriber Managers or Subscriber Administrators with a valid digital certificate.

Do I need a special user permission to activate a user that has a status of ‘Pending’?

No. As long as you are a Subscriber Manager or Subscriber Administrator with a valid digital certificate you can activate a user.

Why has this change been implemented?

To enhance the PEXA Subscriber’s security when creating a new user. It will also:
• Simplify and enhance the new user activation process
• Greatly improve the efficiency and time to activate a new user
• Provide visibility around who created and who activated the user

No, you can’t make changes to the permissions of your own user profile.

Will I be able to see activated users?

Yes, you will be able to see users that have a status of ‘Active’ in the view. You will also be able to see who activated the user and the date activated.

Will new PEXA users be notified?

Yes. New users will receive two notifications:
1. The first notification will advise them that they have been created as a PEXA user and are in a status of ‘Pending’.
2. The second notification will advise them that they have been activated as a PEXA user and can now use the platform.

Hi <LI-USER uid="1410"></LI-USER> - our development have had a look into this - the Waterfox browser currently isn't included in our Browzerstack (which tests PEXA Plus against various versions of the most common browsers, and on the most common operating systems). Hence, further investigations are required to understand exactly what is causing the display issues. Is it still occurring on your end?

Thanks <LI-USER uid="136"></LI-USER>

Hadn’t switched any off, but since tried turning them all off, and on one by one…

Since it only impacts Waterfox, completed the usual Cache clear etc… additionally have disabled, and even removed add-ons, not even safe mode gets it displaying properly…

Done remove, reboot and reinstall, even powerwash, all to no avail.

Considering a system restore, but really want to avoid that... that why I asked if any code changes.

Started happening 2-3 weeks ago.

It looks like it is trying to be mobile responsive...

Hi <LI-USER uid="32"></LI-USER>

Been loving the PEXA Plus dashboard simple Summary overview, Today's Settlements, Announcements, Upcoming calendar etc.

Even better, been running fantastically in Waterfox (used due to is out of the box privacy and extensions support) until recently.

Just wondering if there were any recent PEXA Plus dashboard changes, (perhaps responsive modifications) as now my PEXA Plus displays like this....

Inactive users | FAQs

Hi Community,

We recommend regularly reviewing your PEXA account and ensuring user access is up-to-date. We've provided answers to frequently asked questions on 'inactive users' below.

What is an inactive user?

An inactive PEXA user is defined as ‘a PEXA user who has not logged into PEXA over the past 100 days.'

What will happen if a PEXA user becomes inactive?

If a user does not login for a period of over 100 days, their access to PEXA will be suspended. Note that this is not a permanent suspension and Subscriber Managers can reactivate access via the 'Manage Users' section on the PEXA platform. To find out how to manage users, follow our guide on Community.

Why is it important to manage inactive users and PEXA user access?

It’s important that only users who need to utilise PEXA have access to the platform. If an employee has left your organisation, access to their PEXA account should be removed to prevent unwarranted access to the PEXA System.

Rule 7.3 of the Model Participation Rules requires that Subscribers keep user profiles up-to-date. In addition, paragraph 4.5.2 of PEXA's Security Policy requires Subscribers to perform regular checks of their User profiles and, where applicable, remove inactive User profiles.

Who can manage PEXA user access?

Your organisation’s PEXA Subscriber Manager(s) can remove, suspend or reactivate users. It's important to note that Subscriber Managers do not need a Digital Certificate to reactivate a suspended user.

Do I need to call PEXA Support to manage user access?

No, the PEXA Subscriber Manager(s) from your organisation is able to remove, suspend and reactivate users and does not need to call PEXA Support to complete any of these tasks. It's important to note that Subscriber Managers do not need a Digital Certificate to reactivate a suspended user.

As a PEXA Subscriber Manager, how do I manage PEXA user access?

To remove or suspend users from PEXA, visit your PEXA dashboard, click Administrator Tools and select Manage Users.

From here, locate the relevant user and use the action cog to select Edit. Update the user details or permissions as required.

If you are a Subscriber Manager and have had your access to PEXA temporarily suspended, you will need to call PEXA’s Support Centre to have your access reactivated.

To reactivate users, on the Manage Users screen:

1. Locate the relevant User and use the action cog to select Reactivate

2. Enter the reason for Reactivating the User

3. Select Confirm.

You can find more information on managing PEXA user access by visiting our guide on Community.

What if a user requires PEXA access only sporadically?

If a user accesses PEXA infrequently, we kindly request that they login every 100 days to keep their profile ‘active’.

What if a user is on an extended period of leave, such as parental leave?

If a PEXA user is on an extended period of leave (such as parental leave), we recommend that you suspend their access to PEXA, and reactivate it upon their return.

What should I do when an employee leaves my business?

If an employee leaves your business, you should check that their PEXA user profile has been removed and terminate their Digital Certificate (note: you’ll need to contact PEXA directly for Digital Certificate termination).

Have a question regarding inactive users? Reply to this post and we’ll get back to you as soon as possible.

Today, Landgate do not enable titles having one or more proprietors on title in capacity (for example as Executor) eligible for electronic lodgement.

PEXA continues to work with Landgate and WA OSR to expand the scope of titles and documents available for electronic lodgement.

Bulk Conversion of Titles NSW | FAQs

Hi Community,

New South Wales Land Registry Services (NSW LRS) will be carrying out a bulk conversion of paper certificates of title (pCT) to electronic certificates of title (eCT) on behalf of the Registrar General by the end of September 2018.

The NSW Office of the Registrar General posted an explanation of the transition, including FAQs, on their website. Please contact NSW LRS for any further questions on the bulk conversion process at ctconversion@nswlrs.com.au.

If you would like to post your questions below, we will pass them on to NSW LRS at the above e-mail address.

When will the bulk conversion happen?

Each Authorised Deposit-taking Institution (ADI) will be converted on the following dates:

1 Sept.

ANZ

2 Sept.

CBA

8 Sept.

Westpac

9 Sept.

NAB

15, 16, 22 & 23 Sept.

ADIs (on list at bottom of this post)

why is bulk conversion of paper certificates of title happening?

As part of the transition to 100% digital, the major Financial Institutions have agreed with NSW LRS, to lead the way with the bulk conversion of all NSW paper certificates of title in which they are the first registered mortgagee, to electronic certificates of title (eCT). This is a significant step in the industry transformation to e-Conveyancing.

what is an electronic certificate of title (eCt)?

An eCT is a digital record of the land title that is administered by NSW LRS. Every eCT is assigned to a “CoRD Holder”.

What is cord?

CoRD is the Control of the Right to Deal. There are two key concepts that underlie current arrangements in NSW, visit NSW Land Registry Services for more information.

what is a cord holder?

A CoRD Holder is the party that has the right to deal on the title and must be a PEXA Subscriber/Member.

how do you know an ect exists and who controls it?

This is shown on a CT Inquiry or Land Title Search.

The following text on a land title search indicates that an eCT exists and who controls it:

“NO CERTIFICATE OF TITLE HAS ISSUED FOR THE CURRENT EDITION OF THIS FOLIO.

CONTROL OF THE RIGHT TO DEAL IS HELD BY [mortgagee name].”

How do I complete a ct inquiry?

Navigate to the NSWLRS CT Inquiry page here.

what does this mean for nsw lawyers and conveyancers?

Where an eCT exists, a paper certificate of title will not be available at a paper settlement.

Please review the Circular issued by LRS about eCTs and lodgements of dealings here: http://rg-guidelines.nswlrs.com.au/__data/assets/pdf_file/0019/217216/2017-07_Electronic_Certificate_of_Title_Information.pdf

how do i as a practitioner know before settlement if the ct is paper of electronic?

When representing a purchaser in a settlement, you can complete a CT Inquiry or Title Search prior to settlement to find out whether a CT is paper or electronic.

Similarly, vendor representatives should provide a printed copy of the CT Inquiry or title search evidencing the title is an eCT and showing a Consent has been lodged.

NOTE: Mortgagees on Title are required to Consent to the details of the transaction, including the incoming proprietor and incoming mortgagee details. Practitioners should make these details available to Mortgagees on Title where there is an eCT and the settlement is proceeding in paper – this is not required for an online settlement. You can provide these details using the NSW LRS template here.

What does ect mean for banks or panel lawyers acting on behalf of financial institutions?

When representing the Mortgage on Title, financial institutions (ADIs-only) and/or their panel lawyer representative must complete a CoRD Holder Consent on PEXA. A standalone Consent on PEXA can be completed for paper transactions.

WHAT is a cord holder consent?

A Consent is required for transactions where:

The CT is electronic and is required for settlement and/or lodgement of dealings (for example refinance, transfer, discharge of mortgage, registration of plans etc). A Consent must be lodged for both paper dealings and PEXA dealings.

In a PEXA transaction, a Consent must be lodged regardless of the title being paper or electronic.

Note: a Consent can only be lodged electronically.
Currently in a paper transaction, a pCT must be handed over at settlement and lodged together with other documents for a dealing to be registered on title. The equivalent process where the certificate of title is electronic, is for the CoRD Holder to consent to the paper instrument or PEXA lodgement case via a Consent in PEXA prior to settlement and/or lodgement. If the CoRD Holder is a party to the transaction, they would lodge a Transacting Party Consent. If they are not part of the transaction, they would lodge a 3rd party Consent.

How do i lodge a consent prior to settlement?

Visit this page on the e-Conveyancing Community to learn how. Note, a CoRD Holder Consent cannot be lodged in paper.

How can i confirm that a consent has been lodged in preparation for a paper settlement?

A free CT Inquiry is available on the NSW LRS website here, or by performing a Land Title Search through your Information Broker.

What do i do if there has been no consent lodged prior to settlement?

NSW LRS has provided a template to assist with requesting Consent from CoRD Holders here.

what happens if a paper title has remained undischarged?

A paper Discharge of an ADI Mortgage can be lodged if it is dated:
- before 1 March 2017 and is lodged as a standalone dealing.
- before 1 August 2017 and is lodged as part of a refinance transaction with an ADI.
- before 1 July 2018 and is lodged as part of a refinance transaction with a non-ADI.
- prior to the conversion of the paper CT and is lodged with dealing(s) other than mortgage(s).

In all cases above, the Discharge of Mortgage should be lodged with the paper CT.

as a non-major bank or panel lawyer, do i have to convert my client's pct?

The bulk conversion of paper certificates of title is for Authorised Deposit-taking Institutions. If your client is an ADI, you should familiarise yourself with details and contact your client to discuss. See question one for a full list of transitioning ADIs.

does this mean all transactions will have to go through pexa?

No, some transactions in paper will still occur. The CoRD Holder will be required to create and lodge a CoRD Holder Consent in PEXA, regardless of whether the transaction is electronic, or paper based.

Is it possible to change the name of this topic to VIC Bulk Conversion FAQs & add a new section for NSW Bulk Conversion FAQs.

The ORG has just launched it's new page regarding the bulk conversion coming up in September: http://www.registrargeneral.nsw.gov.au/eConveyancing/bulk-conversion

Security FAQs

Hi Community,

On Monday 18 June, at approximately 5pm, PEXA was made aware of a fraudulent situation where a practitioner’s email account was compromised.

In this instance, an unknown party intercepted a change-in-password email sent from the PEXA platform which in turn allowed this person to access the Subscriber’s PEXA account. As a result, the destination account details in the settlement schedule were fraudulently changed.

Below are some frequently asked questions we have received from our members on this matter. If you have any further questions, please don't hesitate to ask below.

Has the pexa system been hacked?

No, the PEXA system has not been hacked.

In this instance, an unknown party intercepted a change-in-password email sent from the PEXA platform which in turn allowed this person to access the Subscriber’s PEXA account. As a result, the destination account details in the settlement schedule were fraudulently changed.

what is pexa doing to make sure this doesn't happen again?

While the PEXA platform itself was not compromised, PEXA is working closely with all parties, including the relevant authorities to assist in every possible way.

The PEXA security team is currently undertaking detailed monitoring of all Workspace* activity, checking for similar scenarios where passwords have been re-set in close succession among other things which may be considered ‘unusual’ behaviour.

PEXA is also in the process of adding additional security measures. Click here to learn more.

Consumer Guarantee

PEXA will be introducing a new consumer guarantee for transactions conducted on the platform. We anticipate this guarantee will go above and beyond any guarantee available in the paper-based settlement process, and will provide greater safeguards to consumers whose conveyancer or lawyer uses PEXA. Further details will be made available shortly.

how can we be assured that the pexa system is secure?

To date, over 1.2 million transactions have been successfully completed on PEXA. Instances of fraud and attempts of fraud have been incredibly low, in fact much lower than the paper process.

The PEXA system’s security is aligned with international standards. PEXA continues to comply with with the Model Operating Requirements as set by the e-conveyancing regulator, ARNECC.

An independent expert review, currently conducted by Ernst & Young (EY), is completed annually to ensure alignment with these standards. PEXA has consistently complied with these standards.

Further to this, confidence in PEXA’s system security has been demonstrated by the Reserve Bank of Australia (RBA), Land Titles Office, State Revenue Offices and many software providers (among others) by the successful integration with these parties.

How does pexa protect its subscribers online?

PEXA protects its Subscribers in several ways. Firstly, the proper use of digital certificates mitigates the risk of fraud once the Signer has undertaken the appropriate checks and balances prior to signing to ensure accuracy of the information.

Digital Certificates allow the electronic signing of documents in PEXA on behalf of clients thereby eliminating the need to print and pen-sign physical documents.

A digital certificate is a PEXA Subscriber’s unique identity online. Anyone signing on the PEXA platform must use one for security purposes.

PEXA also uses encryption mechanisms and ensures all Subscribers agree to PEXA’s security policy to ensure their systems meet a certain standard of security when using the PEXA system.

Visit PEXA’s security webpage to learn more.

What advice does pexa have for its members to stay cyber-secure?

We urge all our members to take the necessary steps to reduce the risk of fraud. This includes, among others, verbally confirming bank account details with clients, not using free public Wi-Fi, keeping security patches up-to-date and importantly, checking payment directions immediately prior to signing.

Visit PEXA’s security webpage to learn more.

Kind regards

Aoife

* A Workspace is a shared online area in PEXA where the participants can communicate and prepare documents for a property transaction.

Kind regards

Hi Damien,

No, once your old certificate expires, it is considered null and does not need to be removed from the certificate store to be able to sign with your new digicert. You can remove if it you like, but it is not necessary.

That sorted it to re-enable use of my old Digital Certificate.

I imagine I will need to do the same (by removing the non-use certificate from certmgr.msc cache) once I receive my new PIN So then I may try to test the new Digital Certificate?

Hi Damien,

I believe this issue is stemming from the fact that your computer is trying to sign with the newest certificate that is "recognised". This is because certificates plugged into a computer are cached within the certificate store of your PC.

To rectify this, we need to remove any reference to your new certificate within the store, to allow you to sign with the old one.

Open your Start Menu, and search and open the program called Run.

In the box, type in certmgr.msc.

Open the folder called Personal, and remove the NEW certificate (expiring June 1, 2021).

Try and again sign, and you should be successful.

Thanks!

Georgina

To continue the experience...

I received my new Digital Certificate (DC) (AKA dongle) in the post, however, it did NOT mention that I needed to wait for a new PIN before testing it, only that one would issue separately, I did understand that I needed to test the new DC for operation before my old DC expires.

Also that I should then the process to destroy the old DC, by removal and cutting up of the SIM looking chip.

Testing process on live PEXA document first asks for a PIN -seemingly NOT the old one, would not accept my old PIN nor progress pass the PIN entry screen.

Switched back to old (unexpired) DC was able to seemingly successfully enter my old PIN

however the Workspace results in failure...

Was able to progress a little further by re-registering my old DC using the https://community.pexa.com.au/t5/Help-Centre/Installing-the-Digital-Certificate-Software/ba-p/167

now is briefly reports as 'signed' while a push notification/message says it failed... :/

Signed & failed at the same time......then not signed!

In case anyone else comes across the same issues.

Whilst pouring through my junk mail filter, I luckily discovered an email mentioning my Digital Certificate was up for renewal, it had some mention about having to log-in via 'plus.pexa.com.au' to renew via a link.

Being security conscious I phoned PEXA support to check if it might be a legit, email!

Advised in the affirmative.

I was able to ask for the login address, - since email was stripped by the email security and as such still looked dodgy!

Merely to find, there was no 'banner' nor 'renew link' for 'Renew Digital Certificates Here' in my pexa-plus portal.

So after another contact with phone support, a few days later it became available, but seemed to be after refreshing/clearing my browser cache...

But after clicking on the link to renew my certificate by the plugin of my digital certificate and clicking 'sign & submit' then entering my pin. it would present with the yellow circle around an exclamation mark saying 'Server Error', '...try again later, or contact PEXA support'.

After several unsuccessful attempts.

Another contact with PEXA phone support was able to email me the renewal paperwork!

Hi all,

Our vision has always been to support the property industry as it transitions to a 100% digital conveyancing process. While the compliance date has been extended to 1 December, we remain committed to ensuring that everyone is trained and ready. We continue to take your feedback seriously. Please feel free to leave us your thoughts here on how we can help WA become a digitally enabled settlement community.

Kind regards,

Hi Community,

From 1 <STRIKE>May</STRIKE> December 2018, Western Australia takes its next step towards 100% digital property settlements.

Below are some of your network’s frequently asked questions regarding the transition online. I will continue to add to the post as questions arise and we encourage you to ask your questions below.

WHAT Instruments are moving online from 1 <STRIKE>May</STRIKE> December 2018?

WILL WE BE ABLE TO LODGE DOCUMENTS OUTSIDE OF LANDGATE'S BUSINESS HOURS?

*No. Documents lodged in paper and electronically through PEXA will only be accepted during normal business hours.

WHEN WILL LAND HELD IN CAPACITY OF EXECUTOR/ADMIN AND APPLICATIONS BY SURVIVOR BE POSSIBLE ONLINE?

PEXA is currently working with Landgate and the Office of State Revenue to introduce these transactions into a future release and will provide further updates as they become available.

Will a "free text" field be available on caveats by 1 <STRIKE>maY</STRIKE> December on PEXA?

No, a free text field for caveats will not be available by 1 May.

IF NOT, WILL LANDGATE ACCEPT CAVEATS OVER THE COUNTER THAT DON'T "FIT" INTO THE OPTIONS ON PEXA?

Landgate has advised that they will accept these caveats over the counter.

Hi <LI-USER uid="451"></LI-USER>

Thank-you for taking the time to provide us with your feedback on PEXAplus. It is early days for PEXAplus and as you have pointed out it currently provides more of a visual summary to your PEXA workspaces. Our aim is to build PEXAplus together with our members and start introducing value-add widgets for the varying needs of practitioner businesses.

I am pleased to advised that both your suggestions of a settlement list view and a task checklist are in our PEXAplus ideas and improvement pipeline.

Thank-you again for your input towards PEXAplus and please keep the ideas coming. We will be posting on this page as we start to roll-out more widgets so stay posted!

Cheers,

TBH it's not adding much value - it's another page I have to click thru to get to my "old" Dashboard.

What would be helpful?

A Dashboard that:

by default lists settlement in date order, AND

has tickboxes for most common tasks (eg Create Transfer, etc) showing at a glance what I need to do each WS

I realise the PEXA plus has a pretty Calendar of upcoming settlements, but clicking one just takes me to the "old" Dashboard.

To hopefully add some clarity to the discussion above:

- It is noted that the LUV customer information bulletin states that all transfer of land and survivorship applications must be lodged electronically from (on or after) 1st March 2018.

- However, there may be a smaller number of cases where a transfer has been signed + assessed for duty electronically through DOL (Duties Online) + paid and finalised before 1 March, but subsequently not lodged for registration at LUV until after 1 March. These purchasers should not be penalised by the mandate and forced to re-lodge a second transfer electronically through PEXA and subsequently pay duty twice.

Hi Jonathan <LI-USER uid="22"></LI-USER> and Aoife <LI-USER uid="74"></LI-USER>

I am familiar with the LUV Customer Information Bulletin which is why I suspected that I had to complete my transaction on PEXA. I started the PEXA workspace in both roles (as proprietor on title and incoming proprietor) but discovered that PEXA does not seem to cater properly for a transfer of this type with no monetary consideration (it required information which would not be required if the transaction was completed in paper) which is why I raised the initial query. After Aoife <LI-USER uid="74"></LI-USER>'s comment, I withdrew from the workspace. Given that LUV will not accept a paper transfer, I suppose I will have to start the workspace again.

Regards

Hi Eric <LI-USER uid="2554"></LI-USER>

In the scenario you've described, you will need to lodge the transfer via PEXA as it is an unencumbered title and there are no other lodgement instruments with your transfer, so it's considered a 'standalone' transfer.

The table that Aoife has linked are transactions that cannot occur as a Part Tenancy Transfer but these types of transactions can still be lodged in PEXA, you'll want to also look at this article on how to act for both parties in PEXA: Acting for Both Parties

If you haven't completed a transfer in PEXA before, these recorded webinars will take you through the whole process:

How-to-complete-a-transfer-in-PEXA-webinar-Transfers-101

Here's an extract from the Land Use Victoria Customer Information Bulletin 175 on what transfer transactions are currently out of scope for electronic lodgement:

Transfers of land and survivorship applications

From 1 March 2018, transfers of land and survivorship applications must be lodged electronically. This requirement applies when a party is represented by a conveyancer or lawyer who signs the instrument on behalf of their client; or, the party is a conveyancer or lawyer, or PEXA subscriber acting for themselves.

Under Registrar’s requirement 6.5 the following exceptions to lodging using an Electronic Lodgment Network (ELN) include:

a transfer is lodged with any other instrument for the same folio(s), including a survivorship application

a transfer is of a type that as at 1 March 2018 is not available in PEXA, such as

transfers by mortgagees

transfers by a minor

transfers creating an easement

transfers of an interest (e.g. a lease or mortgage)

transfers of part of land in a folio of the Register

transfers of a tenant in common’s share

transfers that cannot be assessed for duty by the State Revenue Office Duties Online – details of the transaction types able to be processed in Duties Online are in the tables of transactions and combinations of transactions available on the SRO website at sro.vic.gov.au/duties-online-transaction-types

transfers affecting more than 20 folios

Cheers

Jonathan Teh

PEXA Direct Specialist

A transfer incorporating a covenant can continue to be created and lodged as a T2 transfer until the Registrars requirement for these types of matters becomes a mandated requirement from 1 July 2018. For further details on this topic interested parties can reference Land Use Victoria Customer Information Bulletin 175 published in February this year.

Hi Aoife,

Basically the standalone transfer will be assessed for lodgment through the conditions set out in the Registrars Requirements Version 4 and keeping in mind the exceptions listed most recently in Customer Bulletin no 175 published in February 2018.

If these matters confirm for the registrar that this matter should be lodged electronically then the paper document will be refused from acceptance and will need to be created and lodged via the electronic channel PEXA.

Hi all,

I've attached Land Use Victoria's Bulletin (175) in the original post for your reference as is sets out more criteria on mandatory transfers and survivorships.

Cheers

Hey <LI-USER uid="3131"></LI-USER>,

Not sure what you're referring to in the latest bulletin? Is it this line talking about exceptions?

a transfer is lodged with any other instrument for the same folio(s), including a survivorship application

This refers to any transfer which is not a standalone. There are of course exceptions, which are listed in the latest bulletin.

I did find something within the Registrar's Requirements which may be what you're thinking of:

a transfer of land signed on or after 1 March 2018, except when the transfer is to be Lodged with any other Instrument for the same folio(s) of the Register

an application by a survivor under section 50 of the TLA signed on or after 1 March 2018, except when the application is to be Lodged with any other Instrument for the same folio(s) of the Register

I would suggest confirming with Land Use Victoria, perhaps <LI-USER uid="1162"></LI-USER> can shed some light on this, but you might be right in that; if the transfer of land/survivorship application form was signed prior to 1st March 2018 - it can be lodged in paper after 1st March 2018.

Just out of curiosity, is this a scenario that would come up very often?

Hi <LI-USER uid="2745"></LI-USER>,

Great question. In short, if the settlement date is on or after 1 March 2018 it needs to be completed electronically.

EDITED with further information: If the transfer of land/survivorship application form was signed prior to 1st March 2018 - it can be lodged in paper after 1st March 2018.

Thanks

Hi Community,

Tomorrow, standalone transfers and survivorships are moving online, see timeline here.

Below are some of your more frequently asked questions regarding the transition online for these instrument types. I will continue to add to the post throughout the day as questions arise – stay tuned!

Can a Survivorship and APR(Application by Legal Personal Representative)/Transmissions be completed in conjunction with a transfer?

At the moment this cannot be completed in conjunction with a transfer however it is possible through separate workspaces at no additional fee. Moving forward, it is in scope for future platform upgrades. PEXA acknowledges the inconvenience of having to prepare these in two separate workspaces and will continue to update the e-Conveyancing Community on our progress over the coming months.

Why do we need to input Market Value into a Transfer (e.g. Change in Manner of Holding) when it is not required in paper?

In support of Commissioner requirements, PEXA collects specific data for dutiable transactions as set out in 2015 by the Commissioners of each jurisdiction. One of these items is Market Value, complete with valuation/value details.

Can Party Tenancy Transfers be completed with Proprietor on Title and Incoming Proprietor as Transferees?

Yes. As of 5 February 2018, this functionality became available in Victoria. However, some scenarios are still unavailable. See below for in scope and out of scope capabilities:

If the transfer of land/survivorship application form was signed prior to 1 March 2018 - it can be lodged in paper after 1 March 2018.

If the settlement date is on or after 1 March 2018 it needs to be completed electronically (regardless of execution date). Please see Registrar Requirements as it states:

"All Instruments set out in Registrar’s Requirements 6.3, 6.4 and 6.5 must be Lodged using an ELN...

6.5(c) a transfer of land signed on or after 1 March 2018, except when the transfer is to be Lodged with any other Instrument for the same folio(s) of the Register; and

6.5(d) an application by a survivor under section 50 of the TLA signed on or after 1 March 2018, except when the application is to be Lodged with any other Instrument for the same folio(s) of the Register;"

What happens when a non-PEXA Member is involved in "Paper Title and Cash Purchase" deal due to settle post mandate?

If a non-member is involved in “Paper Title and Cash Purchase” deal due to settle post mandate, they should contact PEXA immediately. In most cases, that non-member will want to commence their own PEXA registration and avail of the numerous training options available to complete transactions themselves.

In the event that registering with PEXA is not suitable for a firm, PEXA has various options to support industry. We are piloting alternatives for those practitioners who may not do enough conveyancing to stay up-to-date with e-Conveyancing requirements or transition that part of their business to digital. Please reach out if this scenario occurs.

For a non-monetary transfer what do I select if there is no contract? If it's a verbal contract what should I select?

In the case of no contract, select ‘NO’ and check all the names (as NO contract existed).

This is requested State Revenue Offices’ compliance data and requires a YES/NO answer.

Kind regards

If you’re a Subscriber Manager/Administrator at a legal/conveyancing firm and have been informed of the need to renew Digital Certificates within your organisation, please access the online renewal form via the link below (we recommend you use Google Chrome for optimum performance):

Log in to plus.pexa.com.au to renew Digital Certificates

When selecting a link for the first time, it may be blocked in your address bar.

In the address bar, click "Pop-up blocked."

Click "Done."

The online renewal form is housed within our new PEXAplus portal. PEXAplus is a new gateway to transacting property online and the beginning of a journey to provide you with a more engaging PEXA experience.

FAQs

Here are answers to your most frequently asked questions about Digital Certificate renewals. Can't find what you're looking for? Leave a comment and we'll get back to you.

How do I renew an expiring Digital Certificate?

Only Subscriber Managers/Administrators with an active Digital Certificate can renew Digital Certificates. Subscriber Managers/Administrators should access PEXAplus to view and action any upcoming expiries.

Does it cost to renew a Digital Certificate?

Digital Certificate renewals will incur a renewal fee. Fees associated with the renewal of Digital Certificates will be direct debited from your nominated fee paying account. Details of the renewal fees can be found in the Digital Signing Certificate Pricing Guide.

How do I find out who my Subscriber Manager/Administrator is?

If you are unsure who the Subscriber Manager/Administrator is for your organisation (some organisations have more than one) and you are unable to find out via your colleagues, please contact our Support Centre on 1300 084 515.

Why can’t I see any Digital Certificates that require renewal WITHIN PEXAPLUS?

All Subscriber Managers/Administrators within an organisation are notified of the need to action upcoming renewals. If you log on to PEXAplus and no renewals are displayed, it is likely that another Subscriber Manager/Administrator within your organisation has already actioned the renewals.

How do I change the name or email for a Digital Certificate renewal?

Changes to the name and/or email address of a Digital Certificate holder are not currently supported by the online renewal process. If a Digital Certificate holder’s name and/or email address has changed, please contact your PEXA Direct Specialist who will arrange an appointment with the authorised signatories to execute a paper form. If you do not have a PEXA Direct Specialist, please contact our Support team on 1300 084 515.

Note: if a user’s email address has changed, they will need to create a new corresponding user account in PEXA so their PEXA login email matches the email address associated with their new Digital Certificate.

How do I begin signing with my new Digital Certificate?

Hard tokens

These Digital Certificates are stored on a USB token. To sign in a PEXA workspace, you simply need to insert the USB into your computer and enter your unique PIN when prompted. You’ll receive a separate letter containing your Digital Certificate PIN. For instructions on how to change your PIN, visit the e-Conveyancing Community at pexa.com.au/digicertpin

Soft tokens

These Digital Certificates are installed and stored on the Certificate holder’s machine. To sign in a PEXA workspace, PEXA will automatically locate the Soft Certificate on the user’s machine and prompt them to enter their unique PIN when signing. If you use a soft token, you’ll receive a CD that contains the User’s Soft Digital Certificate which needs to be inserted into a CD drive to run the Certificate installation process. A separate letter containing your Digital Certificate PIN will be received a day or so later. For instructions on how to change your PIN, visit the e-Conveyancing Community at pexa.com.au/digicertpin

Do I need to install software for my new Digital Certificate?

If you have already installed the software required to use a Digital Certificate on your current device, no further set up is needed. You will only need to install software if you would like to sign with your Digital Certificate on a new device. Installation instructions can be found at pexa.com.au/digicert

What should I do with my old Digital Certificate?

Your old Digital Certificate will remain valid up until the day of its expiry. Until this date, both your old and new Digital Certificates will be valid. It is your responsibility to destroy the chip within the USB shell of your old Digital Certificate. You should only do this once you have tested that your new Digital Certificate works.

How do I find out the expiry date of my old Digital Certificate?

If you are unsure of the date, contact our Support Centre on 1300 084 515.

How do I destroy my old Digital Certificate?

<LI-USER uid="451"></LI-USER> Would you be so kind as to explain who exactly is driving this change in the paper tradition towards 'national alignment' if it's NOT to suit the new electronic settlement model of PEXA?

My only notification about 'national alignment' came from PEXA, no other source, till a later confirmation from AICWA...

Hey Damien

That's a paper question - one I doubt PEXA can answer.

Think it will be up to the Seller's Agent to ascertain.

AICWA are about to issue eNewsletter with suggested procedure.

Will email you an advance copy for feedback.

With 1/12/17 being this coming Friday. Have 2 outstanding queries;

1. Would you know how are us practitioners supposed to know if the discharge bank (mortgagee on title) is bringing more than one (1) Discharge of mortgage? Just because the title shows one (1) mortgage number, that does not mean the mortgagee on the title is only handing over only one(1) Discharge of Mortgage document, especially in paper settlement.

2. Have heard that some banks are already trialing this new process; so would you know which banks are already (pre 1 December 17) reducing their payout for this, or are they ALL still bringing their discharge rego fee to settlement?
