Hi, my name is Rimmy and I am the Settlement Support Specialist for QLD. Over my last 3 years at PEXA I have had the pleasure of working with our members across New South Wales, South Australia and Queensland.

10 months ago, I joined the QLD PEXA Team, dedicating my time to our amazing QLD members and I love supporting the QLD market’s transition to digital.

As a Settlement Support Specialist, my focus is to ensure your settlements proceed smoothly on PEXA. I proactively monitor daily settlements to assist with:

Settlements occurring in a timely manner/on the day of settlement
Ensuring any workspace issues are raised with our technical team
Coordination with teams, both internal & external for any escalations, prioritisations & feedback
Overall day of settlement support
And most importantly, assisting to ensure that our Practitioners feel confident and supported

Settlement preparation is key to ensure a smooth settlement (and knowledge is power!) – here are my top 6 tips to ensure a smooth settlement;

Reference to PEXA Transfer Guidelines
Ensuring documents are prepared well before the settlement date
For Purchases that the Total Funds Required to Settle to be added by the day before or first thing on the morning of settlement
Uploading documents, for example Discharge Authority or any documents relevant to the workspace via Files tab – to ensure they are not lost in emails.
Ensuring all communication is through workspace Conversations
PEXA Community – This is a fantastic place to learn about PEXA, ask any specific questions (which PEXA and/or your peers will answer), submit ideas and provide us with any feedback;

A message from the Land Registry Office

The Queensland Titles Registry has advised that there has been an increase of members who are failing to return the original document to the Titles Registry when complying with a requisition. Please ensure that the original requisitioned document with the barcode label affixed is returned to the Titles Registry as is required. Copies of the original or copies of the document will not be accepted.

It is now 2.56pm on the day of settlement and all parties are still waiting for Westpac to prepare the Release.

Can I have someone at Westpac look at this to see if there is a legitimate reason as to why they are holding up the process ?

Banks Preparing Form 3 Release late

Can we have alerts or something sent to the banks warning them when they have not loaded the Form 3 Release of Mortgage document in the PEXA Workspace by the day prior to settlement.

If a Conveyancer can prepare a Transfer document two weeks out of the settlement date why can't the banks load the Release at least one day prior to the Settlement Date.

It is now 10.48am on the day of settlement and neither party or the incoming bank can sign off on the workspace because Westpac have not yet prepared the Release and the workspace therefore can't balance.

I have better things to do than to check the workspace every 15 mins.

This is the second time I have had this problem with Westpac.

That is a great question to ask. Whilst we do suggest that the "Adjustments" section is utilised in a workspace it is not currently a mandatory section so it if is not completed this will not cause issues with your settlement. Only the "Source Funds" and "Payments" need to match up for settlement to proceed.

In this example if you are entering the adjustments in then you could add an adjustment as an "Additional Fee/Allowance" and title it "Funds Already Paid to Seller" (or something similar) so that it is clear that funds have already accounted for.

Unfortunately Transfers which involve parties with only one name is currently out of scope and settlement would need to be converted to paper.

Non-Financial Settlements

Hi Team,

We have a settlement where a director is purchasing from their company. There won't be any funds actually exchanging hands because it is all held in the same bank account and the accountant will have the parties sign the required paperwork after settlement.

I understand that there will be PEXA and registration fees payable and also that the source funds will need to match the destinations funds for settlement to proceed but my question is whether the "balance due to vendor" under the Adjustments and Payments tab will need to be adjusted to show that via PEXA the vendor is not receiving any funds - such as through an adjustment that there is an agreement between the parties that the sum be paid following settlement.

It just seems strange that there be a large sum of money noted to be "due to vendor" but that there is only the PEXA fee for the vendor destination and I didn't know if this would cause a problem with settlement.

Any help would be greatly appreciated.

Client has no first name (Qld Settlement)

We have a client who has NO first name, only a surname.

I note when creating a party that surname is optional, but first name is mandatory.

Is there any way around this or do we have to convert the settlement to paper?

Does it really matter how the names are noted as they are not categorised on the Transfer?

Any assistance would be appreciated!

OSR Online – Google Chrome Invalid Date Issues

OSR has identified a temporary fix for clients experiencing an issue with invalid dates in OSR Online.

Please watch this short video, which explains how to change your language settings in Google Chrome.

Once you have changed your language settings, enter the date in the format DD/MM/YYYY.

If you continue to experience the issue in a date field after changing your settings, please send an email to selfassessment@treasury.qld.gov.au.

QLD Stamping | Electronic conveyancing transactions

When a transaction comes in to OSR Online via the ELN channel, the full list of transactions available to self assessors is now available for selection, whereas previously, the self assessor could only select relevant transfer agreement or ELN lodgement.

The self assessor must select either relevant transfer agreement or ELN lodgement. They should not be selecting any other transaction in the ‘Type of dutiable transaction’ field.

Reasonable Time to Prepare National Mortgage Instrument

Can someone please tell me when the advancing bank should be preparing the National Mortgage.

I have been put on notice by CBA to complete the FSS at least 24 hours prior to the Settlement Date to ensure no delays.

It is 9.55am SETTLEMENT DAY and I would like to sign off on the Workspace but how can we if it isn't even balanced yet because the National Mortgage hasn't even been created yet.

Navigating the End of Year Rush

We’re approaching the traditionally busy end of year period for our industry and we know it’s likely you have a high number of transactions to be settled before you spend time with your loved ones these holidays).

As we prepare to navigate the coming weeks, we’d encourage you to keep three key things in mind:

Be Early

Where possible, we recommend you progress your Workspaces as early as possible. This includes:

Sending Workspace invitations early, at least 10+ days out from settlement
Finalising the source funds required for settlement 5+ days out, ensuring they are cleared 3+ days out if using the PEXA Source Account
Finalising Payment Directions at least 24 hours prior to settlement

Tip: 12pm and 2pm AEDT are popular time slots for settlement – consider selecting a different time.

Be Safe

Please remain vigilant at this time. Our Security team has provided the below guidance:

PEXA will only ever contact you from email addresses ending in "@pexa.com.au"
Avoid email for the exchange of sensitive information
Use PEXA Key to securely transfer trust and bank account details

When an ownership of a title is in the name of a trustee for a bankrupt transaction in PEXA these are limited to a Release of Mortgage.

Unfortunately as the name of a trustee for a bankrupt is stored all in the surname field and when returned to Land Registry for verification it sends it as an individual due to no given name and organisation and is therefore deemed an incorrect party type.

Please check here in regards to scope in QLD. Please rest assured that we are working closely with all third parties to further expand the scope of documents in QLD in 2021.

I have met some amazing people in my time in Regional Qld, and Paul Kelly from Gladstone Legal is just one of them. In this chat with Paul we get to know just a little bit more about him and a day in the life of a busy business owner.

I know you have a couple of furry workmates in the office, how important is it for your dogs to be a part of office life?

It used to be really important for all of us. The furry friends have been “banished” from the workplace however!!! They had become soo acclimatised to clients that they thought the clients were coming to see them (i.e. the furry friends”)?. Upshot was that when a client came in there was a race between them and us as who could meet and greet the client first!!! Then they would insist on coming into meeting room/s so they could be petted!!! All got out of hand so they were banished. We are all happy now as client’s don’t have “fur balls” sitting on their feet and licking there ankles … I am happy cause I don’t have the competition between who is cuter (the fluffy white dog/s or a grumpy old lawyer)!!!

Who has been a big influence in your life?

Professionally it would have to been a guy called Alex Freeleagus who was one of those larger than life lawyers in the 60-80’s who passed away about 8-10 years ago. He was president of every legal organisation in Brisbane and Qld at one time or another. He was a mentor in the true sense of the word. He taught me the “old school” ways of ethics, client management, professional respect, integrity etc

What is your favourite part of the day and why?

I come to work early normally around 5-6am. The Post Office doesn’t normally doesn’t finish sorting Express Post mail until 7.30 am. Highlight of the day is that I elect to to drive down and collect morning mail at 7.30 so I can get the cup of coffee on way back to office by 8.00am! Two or three hours at work without real caffeine is about all I can take before having a “hissy fit” about one thing or another !!.

Running a very busy business, what keeps you motivated?

I like the “people” side of things… I love a chat and the social interaction!! If I had a career change it would be to be a Barista for the same reason ……social interaction…need to talk!! (mostly rubbish ?)

I have a purchase settling today at 1.30pm and the discharging bank (WBC) has not yet accepted the invite nor have they prepared the Discharge.

I can't sign off on the workspace until the discharge has at least been prepared which would then balance the workspace.

When should the banks prepare the discharge as this is not explained anywhere.

From a historical check I can see they joined the Workspace on 2/11.

The Department of Natural Resources, Mines and Energy (DNMRE) and subsequently, the Queensland Land Registry, has confirmed its holiday closure period as Friday 25 December 2020 to Sunday 3 January 2021, inclusive.

We’re pleased to share with members that settlement will remain available during this period.

It’s important to note however that while settlement will proceed, lodgement and registration will not be confirmed until the Land Registry’s return date of Monday 4 January 2021.

From this point, the Land Registry will begin to work through the backlog of matters accumulated during its shutdown.

Change of Trustee - How to put in description in Consideration as no monetary value

I need to record a new Trustee on a title due to the old Trustee having retired.

The Land Titles Office Practice Manual states -

Instrument Required [1-2425] A Form 1 – Transfer is required that shows: (1) The retired/discharged/deceased trustee and any continuing trustees (as applicable) as transferor in Item 3. (2) Words to the effect of ‘As a consequence of the retirement/discharge/death of [name of registered trustee] who held the lot or interest in trust and the appointment of [names of new trustees] in accordance with the Trusts Act 1973’ in Item 4. If the trust is not already recorded on title and it is intended that the trust be disclosed, Item 4 should also include words to the effect of ‘and to declare the trust in accordance with s. 109 of the Land Title Act 1994’ or ‘and to declare the trust in accordance with s. 374A of the Land Act 1994’. (3) ‘[names of new trustee] as trustee’ in Item 5. This will include any continuing trustee, as applicable.

How do I insert these words into the consideration as there is no monetary consideration ?

ANZ PAYOUT

Settlement is due today at 2.30pm and it is currently 12.19pm AEST and ANZ have not yet loaded the payout.

2 conversations have been submitted with no response.

This is unacceptable.

Just because we don't have to order bank cheques any more does not give the banks the right to delay issuing payouts.

Put more staff on if you are busy - it's no excuse.

Queensland pricing update | October 2020

PEXA is dedicated to supporting firms transacting digitally in Queensland. As part of this commitment to the state’s members and industry, PEXA has provided a 50% pricing discount on Transfers, Priority Notices and Transmissions related to Queensland properties – with this offer concluding on 31 December 2020.

After this point, from 1 January 2021, QLD transactions will re-align with PEXA’s national pricing.

To help you prepare for this change, we’ve compiled a list of FAQs which you can access below:

When is the pricing offer ending?

In support of industry, PEXA’s 50% discount on fees for Transfers, Priority Notices and Transmissions related to Queensland properties remains in place till 31 December 2020.
After this date, the offer will no longer run, with PEXA fees in Queensland reflecting our national pricing schedule moving forward.
This date was first communicated to members on 1 September 2020, ensuring practitioners were provided ample time to prepare.

Why is the pricing offer ending?

Since November 2019, a 50% pricing discount has been provided to all Queensland members to assist with the industry’s adoption of digital settlements and support the network through its ongoing transition.

What happens if a Workspace is opened during the campaign, but settlement is executed after 31 December 2020?

The Workspace must settle within the campaign’s time period to receive the discount. If the Workspace is created during the campaign period but settles or rolls over to settle outside the campaign period, standard PEXA fees will apply.

Though PEXA has been supporting members in Queensland with a pricing discount throughout 2020, we’ve been providing free on-the-ground support for members in Queensland since 2015, and we remain committed to assisting practitioners with their transition to digital settlements in this way.
As digital settlement volume has increased in Queensland, PEXA has dedicated additional support and training to help ensure the network is best supported.
The market has progressed significantly in recent months, which is testament to how members have embraced change, particularly in the difficult recent months as a result of COVID-19.

Apologies for the delayed response. Transfers pursuant to an Order under the Family Law Act 1975 (Cth) are not currently in scope in QLD hence why you would have been advised same.

I would be grateful for any comments members of this group may care to make about this subject generally. I am the deputy chair of the property committee of the Law Society of South Australia, and we are currently considering a submission from members suggesting that our Real Property Act should be amended to allow disclosure of the existence of trusts. I understand that Queensland was the first state or territory to allow this, and I note that PEXA evidently accommodates transactions where a party already holds as trustee or will after registration hold in that way, and the existence of the trust is or is to be disclosed. I will read the relevant section of the Qld. Land Title Practice Manual (Part 51) however any comments on benefits or disadvantages of your section 109 in practice would be greatly appreciated.

Transfer from Bare Trust to Custodian Trust - Duty Exemption

The Super Fund is paying out the bank so the bank would want the transaction completed electronically preferably.

Daylight savings time will resume in New South Wales, Victoria, South Australia and Tasmania from Sunday 4 October 2020.

The following changes will be effective from Tuesday 6 October 2020 until Friday 2 April 2021.

For members in NSW, two additional settlement slots will be made available: 6.00pm and 6.30pm AEDT.

In Western Australia, settlement rebooking cut-off time will be at 1.00pm AWST.

Please also be mindful of the 4.00pm cut-off time in Queensland, with the jurisdiction not observing daylight savings time.

JG Settlements celebrating 20 years in 2020!

If you have ever arranged a paper property settlement on the Gold Coast, chances are you have engaged JG Settlements as your settlement agent. They are a trusted and respected name on the Gold Coast within the conveyancing community and are celebrating 20 years in business in 2020!

When Government Departments announced closures to settlement rooms, and with more firms transitioning to electronic settlements with PEXA, JG Settlements reviewed their business model to ensure they could best adapt to the COVID-19 restrictions.

After much thought and consideration, owners Janeen and Glen realised they “had to change the way their office ran” and made the decision to become electronic settlement agents. This switch enabled JG Settlements to continue to service their valued clients who found themselves needing to settle electronically but were unable to register themselves. Michelle was extremely quick to pick up the PEXA platform and settled JG’s first electronic agency settlement with ease at the end of July 2020.

When asked how electronic settlements changed the way JG Settlements will work in the future, Michelle advised that they are “currently restructuring the office and business to allow paper and PEXA settlements”. She believes that their electronic settlement volume “will continue to grow over the next few months” with more solicitors who are not registered “wanting to trial it through us”.

Michelle prides herself on communication – updating the firms she represents frequently throughout the transaction. This fosters a seamless settlement experience not only for JG Settlements and the firms they represent but the firms’ clients – the buyer and the seller.

Janeen, Glen and the team at JG Settlements are proud of the experience they have accumulated over the years. Better Together Pricing Update

You may have already received an email from PEXA, advising you of great news for Queensland regarding the Better Together Pricing offer.

PEXA has been committed to supporting firms transacting in Queensland through numerous initiatives – assisting with the ongoing adoption and transition to online settlements. In line with this, PEXA’s 50% pricing discount on Transfers, Priority Notices and Transmissions related to Queensland properties has been extended, with the offer now concluding on 31 December 2020.

From 1 January 2021, QLD transactions will re-align with PEXA’s national pricing. You can view the full schedule here.

Queensland highlights include:

Land Title address lookup automatically populates and refines as you type, allowing you to quickly and efficiently search for a valid address without having to type in the full address.
Ability for all Workspace participants to view a Priority Notice. This will save you having to request or send copies of Priority Notices by email.

Reminder - Revised Titles Registry fees effective 1 August 2020

Titles Registry have issued a reminder that, further to Titles Registry Alert 171, revised Queensland Titles Registry fees will take effect from 1 August 2020.

The revised fees are prescribed in the Natural Resources, Mines and Energy Legislation (Fees) Amendment Regulation 2020 which is available on the Office of the Queensland Parliamentary Counsel website.

Attached for your information is a summary listing the revised Titles Registry fees (click here)

The Titles Registry online fee calculator will be updated on 1 August 2020 to reflect the revised fees that commence on that date.

Please note that up to and including 31 July 2020 the calculator will continue to function using the existing fees.

If the money for duty is coming from settlement, in the destination funds select Other (BPay) and enter the BPay details for duty payment from the OSR Summary or OSR Confirmation.

Depositing Supporting Documents with a Transfer - QLD

I have a matter where the seller is in external administration with a Deed of Company Arrangement.

If lodging by paper we would need to list the Seller as 'EXAMPLE COMPANY ACN 111 222 333 (Subject to deed of company arrangement, deed deposited with dealing 11111111)'

On PEXA there is an option to mark the Company as in external administration and with a Deed of Company Arrangement but no option to refer to the dealing number, or even submit the Deed as a supporting document.

Has anyone else ever come across this and if so can you please share how we can either refer to the dealing number or submit the deed with the Transfer on PEXA?

Please always ensure that the correct legal names are entered when using PEXA. In the event your client is an individual with only a given or a surname, please note these transactions are unable to be lodged via PEXA at this time and symbols must not be included in the name fields.

I queried the Qld Titles Office regarding this issue and in particular the inclusion of "[registered]" in item 6 of Schedule 8 of the current Queensland Participation Rules. My conclusion from the response (of 29/6/2020) which I will paste below is that it does not need to be registered.

Dear Mr Morgan

I refer to your email of 23 June 2020 seeking clarification as to the square brackets around the word ‘registered’ in item 6 of Schedule 8 of the current Queensland Participation Rules.

It is the understanding of this office that the square brackets signify that the Power of Attorney, from which the Identity Verifier must confirm the details of the Attorney and the Donor, may or may not be registered given the particular circumstances of the Conveyancing Transaction. For example, the Power of Attorney may have been registered if paper instruments executed under the same Power of Attorney have been, or may be lodged with the Queensland Titles Registry for registration.

It is also noted that the requirements for registration of a power of attorney differ between the various Australian jurisdictions.

PEXA Projects:

What does PEXA Projects offer your business?

PEXA Projects offers the ability to be across multiple matters at once while completing small, medium and large-scale developments. It also provides a powerful resource from a firm management perspective, in allowing our conveyancers to look at the development ‘at a glance’, providing updates when needed to clients, as well as decreasing the amount of data entry processes for our staff, which saves us time and money.
What’s the overall experience been like for your client?

Great! Once we got accustomed to the program how to use it, it saved time for us. We will continue to use PEXA Projects for future developments.
What would your advice be for any firm wishing to use PEXA Projects for the first time?

Just give it a go, get your PEXA Practitioner Specialist to provide support to the staff who will be working within it each day, and supervising partners just spend a little bit of time to get familiar with it. We can at times feel as though we’re ’too busy’ to spend the time on initiatives like this, however, once you have invested time and energy into better systems, you’ll understand that you were too busy not to do it!

Togetherness and Connectivity:

Have you had to adapt your working environment since COVID-19?

Of course, COVID-19 required us to act quickly, making decisions based on little information and in a short time frame. I’m happy with the steps we took as a firm. We had to adjust to staff being out of the office, cutting-off face-face contact with clients and other parties, but we just adapted. Nothing else really to do in the circumstances.

If so, how is your firm managing to stay connected and together?

We started undertaking group ZOOM and Microsoft Team chats and opted for these methods rather than traditional phone calls where possible. Also, morning emails around the office were a nice touch.
How do you see PEXA’s role in togetherness?

PEXA plays a unique role in bringing people together. It is fascinating to watch the progress of PEXA. They provide the platform in which we undertake our Settlements, however, given that they are required to constantly be in talks with industry stakeholders (such as QLS, REIQ, OSR, DNRME etc), they have become a valuable resource in connecting our profession to these stakeholders, as well as creating a community between lawyers all learning new skills and undertaking a digital transition, together!

How important is connectivity and collaboration to you at this time?

Incredibly important. Everyone deals with aspects of isolation differently, so it has been important as a firm to recognise this and strike a careful balance to ensure that everyone feels connected during this time.
How have you maintained connection and the relationship with your clients during this time?

We’ve been vigilant at pushing out newsletters, legislative updates, and continuing our Social Media presence to show that we are still here, and not slowing down! We’ve also been working with our clients going through tough times, providing the support to them to steer them through to the other side amidst uncertainty.

The entire team are exceptional PEXA Certified Members and embracing innovation ensures that you lead the way. Working with Bradley & Bray and seeing Jacob’s vision to drive digital change in Queensland has been truly inspirational and thank you for your continued support!

To start the week of In Conversations, we are hearing from James Harding, Senior Associate at Holding Redlich,Cairns. Holding Redlich are an extremely tech savvy firm who have embraced e-conveyancing and do a high volume of settlements through the PEXA platform.

1. Have you had to adapt your working environment since COVID-19?

By utilising the online team meeting platforms such as Zoom, Webex and Microsoft team to catch up with clients and colleagues. Our regular desk phones in the office are integrated with video call so fortunately it hasn’t been too different to our usual day to day operations.

We had already made some progress in moving to a less paper-based environment and we took this opportunity to further enhance many of our processes and functions to be able to do much more of our work electronically. Our offices have been well fitted out so that there was a choice for employees to be able to work from home, work from the office or do a combination.

Our IT team worked tirelessly to provide hardware and software to those employees who needed to work from home or chose to work from home but didn’t have infrastructure at home to do so.

2. If so, how is your firm managing to stay connected and together?

With the availability of video calls on our usual phone system and Webex, we were able to have regular contact with our team members, other people in the firm across the country and continue to have our regular team meetings. In fact, we ended up having more team meetings as those who work flexibly or in other locations were able to take advantage of the technology to be able to meet at any time. Some teams even got to have more contact with their team mates on a more social basis too as we had ‘virtual’ social events, groups forms on various social media, and some people introduced their family members (furry and human) on various video calls. Our human resources team also kept in touch with various people by phone, video meetings, instant messaging, social media to regularly check in on people to see how they were coping and if they needed any further support whether they were working in the office or at home. We also had (and still have) a daily check in so that the leadership team and human resources know which location people are working in and whether they are feeling well.

3. How do you see PEXA’s role in togetherness?

PEXA has allowed us to continue working with our clients during the disruptions that COVID-19 has caused. PEXA has ensured our staff can continue working in a socially distanced manner to ensure their settlements occur. Without PEXA, a few months ago these necessary transactions would have potentially come to a standstill.

4. What’s something you have learnt recently about Cyber Security?

Property transactions are often subject to scams and fraudulent transactions. Verification of Identity and Multi-factor authentication is integral to the safety of sellers and purchasers to ensure the dealings are legitimate and the respective interests are protected.

5. Why do you use PEXA Community?

PEXA supports flexible work arrangements as our conveyancers and team are able to communicate with all parties and proceed to settlement in their own home or remote office. It provides a convenient platform to facilitate settlements where all the required documents are in one place. The platform has ensured we can continue to deliver for our clients in a prompt and secure way.

6. How do you actively seek feedback from your clients to improve your business?

Informally, we touch base with clients for feedback within the course of working on their matter. We have also recently moved to a new client feedback program where we seek formal feedback by way of an annual online survey.

QLD Titles Registry | Updated arrangements for titles registry lodgements | 14 July 2020

QLD Titles Registry have today advised the following updated arrangements for titles registry lodgements:-

“The preferred way for professionals to lodge Titles Registry documents is through eLodgement or eConveyancing.

The Brisbane Titles Registry office (located at Level 11, 53 Albert Street, Brisbane) remains open for Titles lodgements using the drop-off box facility from 9:00am to 4:00pm, Monday to Friday (excluding public holidays).

Postal lodgements can be made by posting documents to GPO Box 1401, Brisbane, 4001.

Lodgements can also be made at a number of regional business centres*. See the Titles Registry contacts page for lodgement hours and street addresses.
