ASP by deceased proprietor

We have a situation where joint proprietors (P1 & P2) were registered on Title.  P1 died first but P2 did not register ASP and subsequently P2 has passed away.  We have probate for both P1 and P2 and the executor is the same for both.  Can we lodge a ASP application followed by an APR or do we lodge an APR with both deceased proprietors on on it?

Hi @LauraEll 

 

Where the registered proprietors own the property as "Joint Tenants", you can lodge one Transmission application where you specify the "Primary deceased" which as the recently deceased.

Where the registered proprietors own the property as "Tenants in Common", you may proceed with lodging two Transmission application as each owner owns an individual share of the whole of the property
