Acting as a Third Party

Hi

I have 2 questions if possible:

1. Does PEXA under their Subscriber Agreement allow a PEXA registered Lawyer or Licensed Conveyancer, to complete a transfer with Financial Settlement or other Transaction Types available in PEXA, on behalf of another Lawyer or Conveyancer who is not registered, or actively transacting in PEXA ? (assuming both parties in question are under their own agreement to do so)

2. Is there any current facility or pilot trial,supported by PEXA that offers this service for a non registered or non transacting subscriber?

If the answer is yes can l have relevant details of the same and/or be referred to where or with whom  l can discuss or research the same. Many thanks.

Any transactions completed in PEXA must be in compliance with both the PA and Participation Rules, which means, among other things, the transaction must be completed on behalf of the client. Compliance is an important consideration in all conveyancing matters, this now includes complying with the relevant legislative requirements (which also includes the Registrar’s Requirements in the relevant jurisdictions). Conveyancing practitioners need to be across all of these requirements.

PEXA is looking at various options to support industry in the transition to 100% digital processing of conveyancing transactions. We are piloting various alternatives for those practitioners who may not do enough conveyancing to stay up to date with e-Conveyancing requirements or transition that part of their business to digital. PEXA also continues to provide numerous options for training, including our PEXA Direct program, virtual options, online help and Community for those that want to complete these transactions themselves.
