I have a matter where the LPR has been completed already. There was two people on title the deceased (now the Executor as LPR) and the other owner who is also the Executor. So theTitle is now 1 share to Jo Blogs as legal personal representative of the estate of Jo Smith as sole proprietor and 1 share to Jo Blogs as sole proprietor.
The Executor and owner of the other share is also the beneficiary. When I transfer from LPR to the beneficiary do I require two workspaces? I have already completed the DOL but need to complete the PEXA side of things. Possibly getting myself more confused than I need to be.
There is no difference between PEXA and the old paper method to complete a transfer of land from a transferor as LPR to a transferee. This is a regular transfer transaction.
If the transferor as Executor (LPR) is also the beneficiary, then when completing the transfer in PEXA make sure to select the Trasnferor Party as the Transferee party in the Transfer document. This will show VIC SRO that the Transferor and Transferee are indeed the same party. If you do not do this VIC SRO will assume the transferor and transferee are different individuals (even though they share the same name) and will look to charge duty.
