I see from another post that properties with Qualified Title in NSW can settle via PEXA.
However, I can't find anything regarding Limited Title in NSW (i.e. a limitation recorded on a certificate of title pursuant to s. 28T(4) Real Property Act 1900 because the boundaries of the land comprised in the certificate of title have not been investigated by the Registrar General), which is not uncommon in rural properties.
Can a sale or purchase of land affected by Limited Title in NSW be settled via PEXA?
Hi @Ken_Shepherd. In response to the below, you can confirm via the land title look up that the title is available to transact electronically. The limitation on the title would remain and therefore you could proceed and settle electronically. You would need to deal with removal of the limitation, if required, via the normal paper procedure.
