Not signed up for ROL WA (Revenue online) - can we still use PEXA?

We are not signed up for ROL WA (Revenue online) and use the OSR's public portal to lodge for duty assessments. 

 

Assuming duty is assessed and paid (and the contact duty endorsed) has anyone been able to still use PEXA to transact when acting for the buyer?

 

Despite some initial advice to the contrary (which was some time ago) both PEXA and the OSR WA now tell me the only way is via ROL.

Hi Jason

 

Unfortunately, only transfer transactions where assessment has been completed via ROL may be completed in PEXA.

 

When the ROL Assessment is complete, regardless of timing of payment, the ROL generated Assessment Number must be entered into PEXA.   PEXA then sends transfer related data along with the number to SRO who validate alignment of data.   If all requisite data is aligned, the SRO return to PEXA the Duty Amount, and balance owing along with any payment reference details.

Hi Jason,

 

It is a requirements under the e-conveyancing National Law (ECNL) and the Model Operating Requirements (available on the ARNECC web site) that an Electronic Lodgement for a dutiable transaction may not be submitted for lodgement without having been stamped by the relevant duty authority. 

 

It follows that to act as Purchasers Representative in a PEXA transaction that the transaction Participant acting in the role of Incoming Proprietor must be registered and must complete electronic stamping in ROL.

As noted above, duty would have already been assessed and paid outside of the ROL.  ROL is not the only way to have duty assessed and paid in WA.  This is also the reason (and the way we have done it for years) that we can, in the paper world, act for purchasers.

 

So my question is - when duty has already been assessed and paid, is there a way to have this fact noted in PEXA so that the transaction can proceed?
