Thank you for your feedback on the current process for the delivery and receipt of NOAs.  

 

As the PEXA network has grown, we’ve identified the delivery of the NOA to councils and water authorities as an area where the shift to e-conveyancing has created new possibilities. 

 

PEXA is has been exploring solutions with councils, water authorities and practitioners, and we will have more to say in the coming months.

"coming months" seems to have been the plan for many months. 

 

We are currently receiving semi-readable screenshots which are non-compliant with legislation, and missing basic required items such as parcel particulars and/or DOBs.

 

As we are not far away from compulsory PEXA usage, it is disappointing and frustrating that movement on this issue seems to be glacial. From a quick browse of the forum, it seems that all involved (councils. water and practitioners) share this frustration. 

 

Most councils have embraced and assisted by including BPay details on our LICs when PEXA requested this about 18 months ago. At the same time, SRO, banks and Titles Office have been able to receive electronic documentation instantaneously and automatically since day 1 (not coincidentally, they are also the co-owners of PEXA), yet the supply of a legislatively required document still seems stuck in the 1990s for both Councils and Water Authorities. Reading some comments on this forum it seems that some practitioners are under the mistaken impression that C&WAs are to blame for this situation. One practitioner is pushing the responsibility onto their clients, blaming C&WAs.  The following is a direct quote from another thread on this forum.

 

We are being told, "Please note: The Notice of Acquisition needs to be printed from PEXA and sent to local council and the water authority once settlement has occurred."

This is most inconvenient. Councils and water authorities that use PEXA should be able to access the NOA themselves, without us having to go to the trouble of posting them.

As the councils and water authorities do not seem to have the incentive to gain access to the NOA through PEXA, I have decided to make this the personal responsibility of the client.

Our firm now advises purchaser clients that it is their responsibility to ensure that the NOA is delivered to the local council, water authority and owners corporation.

When these authorities grow tired of having sort out messes created by their having to deal direct with their customers I'm sure they will find a way to streamline the process.

Following extensive consultation with stakeholders this year, we certainly can sympathise with the frustrations of councils that continue to rely on an outdated distribution process.

 

We see the benefits that an automated, digital service provides industry and want to ensure that any solution meets the needs of all stakeholders.

 

As of today, work is still ongoing to ensure that any service is safe, reliable and sustainable over the long-term.

 

We will continue to provide further updates in the near future.

Notice of Acquistion printed out from PEXA is not accepted by some councils

Hi All,


I have a question. We have recently deal with Mildura Council and they do not accept the Notice of Acquisition printed out from PEXA.

So we have to do manually again by a standard form. This is not convenient. Is there anyways we can make NoA exactly as the form lodged to Land Title office?

Hi @Hanhnguyen, please refer to this thread. As the PEXA network has grown, we’ve identified the delivery of the NOA to councils and water authorities as an area where the shift to e-conveyancing has created new possibilities. Included in this process has been the exploration of how we can incorporate additional fields, to satisfy the needs of all stakeholders. This is currently in progress and hoping to be able to share plans in the near future.
