Purchaser Caveat - unrepresented Caveator merge on completion NSW
I have registered a purchaser Caveat in a separate workspace which is now completed. In my purchaser workspace which is soon to settle, the purchasers are shown in the workspace separately as unrepresented Caveators - and I can't edit to confirm that I represent them OR invite my firm. What happens here, do they stay unrepresented and the Caveat is withdrawn/merges on settlement without any action and being unrepresented ???
Depending on the setup of the Caveat (in this case, Purchaser's Caveat), a withdrawal of caveat may not be required and the parties can remain unrepresented. Depending on the Land Registry rules of the State, the caveat may automatically lapse.
If the Caveat needed to be withdrawn the parties would need to be represented, but an additional role of 'Caveator on Title' would need to be added to the workspace. As you are in the role of 'Incoming Proprietor' you cannot represent a party in another role without adding that role first.
