We are a NSW based law firm which does commercial property work nationally. We can't seem to register for PEXA in the WA jurisdiction without being registered for self-stamping. We don't mind registering for self-stamping. However, we can't seem to register for self-stamping in WA unless we are licensed WA lawyers. This appears to now prevent us from registering for PEXA in WA. Does anyone know if our understanding is correct?
You can have your PEXA profile activated to lodge documents in WA without the need for a Revenue Online (ROL) account. However, you will not be able to transact in any capacity that has a stamp duty implication, eg: acting for the purchaser. You will however be able to lodge documents such as mortgages, caveats and also act for a seller.
In order to have WA noted as an active jurisdiction within PEXA you will need to provide us with certain information, such as land registry contact details. Our support team can provide guidance on this. Once we have a written request and the necessary information, we can activate WA as a jurisdiction in which your firm can lodge documents via PEXA.
With regards to registering for ROL, OSR WA will consider applications from lawyers from other states, but there are requirements that need to be met before they will approve the applications. OSR will assess each application and notify the applicant if further information is required. You might like to reach out to OSR to discuss further.
Upon finalising your ROL account, and advising PEXA of the details, you will then be able to also act for the purchase in a transfer transaction.
