When we attend to standalone lodgements (e.g. a Discharge of Mortgage without a financial settlement), does the PEXA lodgement fee and registration fee automatically come out of our office bank account?
Also, we note that the lodgement fee for a Discharge of Mortgage is $20.46. Do any additional fees apply if we request to have the paper duplicate unencumbered Certificate of Title delivered to us after the registration takes place (we note in the pricing schedule there is a fee for "nomination to paper dealing" of $19.36 - not sure what this fee is for)?
PEXA is the collection agent for all lodgement fees, in all jurisdictions.
Land Registry Lodgement Fees are calculated by the Land Registry and returned to PEXA at Lodgement Verification.
PEXA fees are calculated by PEXA also during the period of Lodgement Verification.
For all transactions including Financial Settlement, PEXA will collect Lodgement and PEXA Fees at Settlement.
For all transactions not including Financial Settlement, PEXA will collect Lodgement and PEXA Fees via direct debit on the evening of the day of successful lodgement.
NSW LRS have their own rules for determination of whether a paper duplicate CT is to be returned to the lodging party or if they are to receive electronic CoRD.
In short, in NSW, only APRA registered ADI's may be assigned CoRD. Any other lodging party will receive a paper duplicate CT. No additional fee is charged by NSW LRS for issue of a paper CT.
In VIC, the Registrar applies different lodgement fees for transactions lodged via the paper vs electronic channel. Electronic lodgements are lower cost in VIC, reflecting the benefit of electronic lodgement receveid by the Land Registry.
The Nomination to Paper Dealing you refer to is a VIC only transaction. It is used when a Participant possession CT Control needs to make a title available to an electronic dealing.
In NSW a CoRD Consent may be used for the same purpose, but per above only by an APRA registered ADI.
The management of CT Control and CoRD are VIC and NSW Land Registry requirements supported by PEXA.
