We have been instructed to lodge a survivorship on behalf of our client.
They have provided us with the paper Certificate of Title and Discharge of Mortgage. The discharge of mortgage has never been registered at the LTO and consequently is still registered over the Title.
We have invited the mortgagee to the workspace but they have refused the invitation as they have already released the title and discharge to our clients.
If we complete the nomination as we hold the paper title in our possession and then lodge the survivorship application will the mortgage still be registered over the property?
