Transfer of Part Title

Does PEXA allow me to transfer part of a title, ie Crown Allotment 1 is sold from a title containing Crown Allotments 1, 2 and 3?

Hi Rebecca,

 

Currently, PEXA deals with Whole of Land only. 

 

This means that a Transfer of Land for a folio comprised of multiple lots will include all lots referenced on title. 

 

As part of Rls 7.1, LUV and PEXA will enable Mortgage of Interest and Part of Land.   As for Transfer of Part of Land, we are in dialogue with the Australian Registrars Working Group (ARWG) to arrive at a national approach.   Once agreed we will roll out the solution.

We have a matter underway which deals with the sale of three out of four CA's under the one Title.   

 

Are we able to do a Transfer of Part Land through Pexa yet?

Hi Jayd,

 

I am guessing when you say CA's you are referring to Crown Allotments.

 

LUV have only enabled one dealing type for Part of Land at present and that is Mortgage of part of land - either by specified Lot Number on a given plan or by description.

 

This capability is yet to be enabled by LUV for other electronic dealings, such as Transfer.

 

Consequently, if you are transferring only 3 of the four lots on given Crown Allotment, then you will be required to lodge an imaged paper dealing.

 

LUV do plan to enable part of land for all dealing types and are targeting this capability for 2021.

Has PEXA added the functionality to allow part of a title (e.g. 1 of 2 lots) to be transferred? If not, do you know when PEXA plans to roll this out?
