Transfer pursuant to Court Orders without consent of registered proprietor
Hi, I have Court Orders for the sale of property. We act for one of the registered proprietors. The other registered proprietor will not cooperate in signing Client Authorisation or VOI. Is there any advice on this, ie. do we need to get a signed Client Authorisation and completed VOI and can we sign the Transfer on behalf of the registered proprietor who is not cooperating? If it was a paper transaction, the Registrar of the Court would sign on their behalf. Just wondering how is it done via PEXA?
I believe this is answered in Schedule 8 of the MPR, under section 4.4(e). If you need further clarification on this, I would suggest reaching out to ARNECC directly (https://www.arnecc.gov.au/contact_us/) or perhaps The LIV.
