Western Australian Land Titles

Hello,

 

Can a Victorian subscriber be given eCT control of a Western Australian Title?   

 

Our client's mortgagee are discharging their mortgage and the client has requested the Title be forwarded to us.  Would it be forwarded as a pCT or transfer of eCT control?

We don't have eCT control in WA. We have some electronic and some paper titles still in production. Do you know if your client's title is currently a paper or non-issue (electronic title)?

 

If it is currently a paper title that is on issue, then the current holding party will need to confirm they hold the CT and will destroy it as part of their certifications to the Land Registry within PEXA at the time of lodgement. They will then request a new one to be issued (presumably to yourself via mail).

 

If it is an electronic title, they do not need to do this, but you should ask them to ensure that a new title post the discharge of mortgage is requested as part of the lodgement of the discharge, and this can be sent to you via mail.

Thank you for your quick response. 

 

I do not know if CBA had a paper Title or non-issue.  Based on what you have said, I assume CBA's practice will be to request a paper Title that they will then forward onto us.
