Hi. I note PEXA is stated as being ready as far as transfers of land are concerned however I deal with a lot of perpetual leases with Western Lands Properties and NSW LRS still require an original of the consent letter from the Department of Lands so this cannot be done on PEXA. How will these transfers be done when all transfers are mandatory? Has NSW LRS looked at this and accepted an alternative such as DPI sending something directly to them? At the moment the letter of Consent gets handed over with the stamped and executed Transfer and registration cannot occur without it.

Hi Lyn,
PEXA has the capability to capture supporting documents such as a Ministers Consent via the PEXA Document Hub. You may be familiar with this capability for the National Mortgage in NSW.
NSW LRS currently have it on their road map to enable receipt, and processing, of attachments (supporting evidence such as Ministers Consent) for Transfers in Aug 2019.
Until NSW LRS have enabled this capability, such dealings will have to be lodged in paper.

Please advise if Western Land transfers can now been completed electronically through PEXA in NSW.

Hi Alison,
The transfer can be lodged through PEXA where title for Western Land is issued as a Perpetual Lease Title. Ministers Consent where required can also be uploaded.
Where the Western Lease is a term lease a transfer of interest (Transfer of Lease) may be lodged when the Duty Assessment issue is resolved with Revenue NSW).
