We are acting for the purchaser and the client's incoming financier is BankWest. We lodged a priority notice which made note of a mortgage to BankWest. Afterwards, the transfer and Form 24 was created. We have since been advised that the mortgage will actually be in favour of CBA. When we try to withdraw the priority notice (which notes a mortgage to BankWest) the withdrawal document forms part of the transfer lodgement in the list. Do we need to delete the transfer first, then withdraw the priority notice, lodge a new priority notice noting a mortgage to CBA, and then re-create the transfer? Or is there something else we are doing wrong?
To Withdraw a Priority Notice in a workspace that includes a financial settlement, when creating the document PEXA will ask if the Withdrawal of Priority Notice is to be created in its own lodgement case or in the lodgement case linked to financial settlement.
Please ensure to select the option to be created its own lodgement case, this will ensure the Withdrawal of Priority Notice to lodge prior to the transfer.
