Withdrawal of Caveat Document Verification

Hi All,

 

I have a Transfer of a 1/2 share from the registered proprietor Wife to her Husband on PEXA. The Husband has a current Caveat on the title for his interest in the property. Will the Caveat be automatically withdrawn by LRS upon the registration of the Husband on title, or will a separate Withdrawal of Caveat document be required in the Documents screen prior to settlement. 

 

Appreciate any clarification on this.

Hi @CarterV 

 

We have seen transactions where a Withdrawal of Caveat is prepared in conjunction with the Transfer in the workspace. However, if you are confident that the Caveat that you lodged was designed to lapse on settlement then you may choose to not prepare a Withdrawal of Caveat in Settlement.

 

Electronic lodgement has changed the way documents are lodged to the Land Registry however the documents should operate the same as paper.

 

For further clarification specific to your circumstances in relation to the Caveat, please contact the Land Registry.
