Where a duplicate certificate of title currently exists, as displayed in the Land Titles screen, one of the subscriber’s in a workspace must complete Duplicate Holding details for that title, as part of the lodgement instructions.
Note: It is optional to provide Duplicate Holding Details for a lodgement case with a discharge of mortgage only. It is mandatory in all other transactions.
Land Title Screen > Certificate of Title
Duplicate certificate of title issued is displayed in the land title screen. Paper duplicate “Edition Number” and “Edition Date” for this title may be required to be entered as part of an electronic conveyancing transaction on this title as evidence of duplicate holding.
Edit Lodgement Instructions
When editing the Lodgement Instructions, a Subscriber will be presented with both Duplicate Holding Details and Duplicate Issuing Instructions. In a refinance scenario, the Mortgagee on Title who holds the Duplicate Title provides the Holding Details. The Incoming Mortgagee would instruct the Land Registry how to issue the title post registration of their new mortgage.
Duplicate Holding Details
For titles where a duplicate certificate of title has been issued, the following information is required for the Duplicate holding details of the Lodgement Instructions:
NOTE: Duplicate title number held - You only need to enter the duplicate title held by the subscriber if the title number differs to the Current Title number issued by the Land Registry.
Edition number and Edition date (this information can be found in the top right-hand corner of the paper duplicate Title). Note: If the Duplicate Title is an older duplicate and does not have an Edition Number and Date, enter the value ‘N/A’ in the Edition Number field. No Edition date is required in this scenario.
When a Title has Duplicate Holding Details specified in a Lodgement Case, the Title must also have Duplicate Issuing Instruction specified. This is completed by editing the Lodgement Instructions (on the Documents Screen) and is completed by:
Transfers - the Incoming party either the Incoming Mortgagee if applicable, or if a cash purchase, by the Incoming Proprietor
Change of Name - the Proprietor on Title
The options for Issuing a Duplicate Title are:
Duplicate to issue, or
No duplicate to issue (not to be selected for a Discharge only Lodgement Case).
If you wish to issue a duplicate, then select a ‘Method’ of issuing. The options available for having a title issued are:
Issuing Box: Deliver the paper duplicate title to the selected subscribers WA Land Registry Issuing Box
Pick Up: The paper duplicate title is available from the selected Land Registry office (either Perth or Midland office)
Post: You can select to post the paper duplicate title, either to yourself or another (other) party. If Other is selected, you can Add (or Edit) the address details by clicking the Actions cog.
The subscriber who provides the Duplicate Holding Details must affirm an additional Certification when signing the Document that relates to the Duplicate Title Holding Details. This Certification confirms that the subscriber has retrieved and destroyed or made invalid the duplicate title that relates to the document.
