Lodgement Instructions are created in PEXA for each new electronic Lodgement Case.
Lodgement Instructions are included in each Lodgement Case and inform the Land Registry of general instructions for the Registration of your documents.
Lodgement Instructions are automatically generated when a document within the Workspace is created and saved.
Lodgement Instructions contain the following key information:
Set of Operative Words are the instructions from the Land Registry and have a legal influence on the rights and liabilities of parties covered in the document.
Dealing Requirements listing all necessary documents and information required to complete lodgement.
Justifications list the reasons associated with any differences between the names on a title and the names of the Transacting Parties.
Order of Lodgement specifies the order in which the instruments must be processed to complete lodgement successfully.
Issuing Instructions relate to the Certificate of Title (CT) and specifies how the CT is to be issued and to whom it will be issued after the transaction is complete.
PEXA automatically validates the Lodgement Instructions Document against a set of validation rules specific for each jurisdiction. Lodgement Verification commences when the Lodgement Case passes the validation rules. Refer to the Lodgement Verification tutorial for further information.
Edit Lodgement Instructions
Subscribers who are signatories on any of the documents within the Lodgement Case, are able to edit the Lodgement Instructions. Signed documents will become un-signed when edited and both the document and Workspace status will be updated to reflect the changes.
The Lodgement Instructions cannot be edited if the Lodgement Case is locked for Settlement or Lodging or if the Workspace has been abandoned or archived.
Maintain Lodgement Instructions
Hover mouse over the Lodgement Instructions area. Note: The area becomes active and the Edit and Remove Document buttons display.
Click the Edit button to edit the Lodgement Instructions.
Lodgement Instructions Screen
The Set of Operative Words field contains the statement of authority from the Land Registry (VIC, NSW and WA only).
The Responsible Subscriber defaults to the Subscriber who has created the first document in the Lodgement Case. The Responsible Subscriber is liable for the lodgement fees incurred. You can only have one Responsible Subscriber.
The LR (Land Registry) Customer Code defaults to the Responsible Subscriber ID returned from the Land Registry (VIC and WA only). Note: The LR (Land Registry) Customer Code field is only visible if you are the Responsible Subscriber.
Click the Add Dealing Requirement button to select the list of requirements (VIC only).
Alter the Order of Lodgement using the “Up” and “Down” arrows alongside the document types. Note: Fees related to each type of lodgement document are outlined alongside the document type.
Click the Add Issuing Instructions button to add the Certificate of Title within the Lodgement Case. This specifies how the Certificate of Title is to be issued and to whom it will be issued after the lodgement transaction is complete.
Click the Save button to save the edit Lodgement Instructions.
Result: Documents(s) successfully updated and the status moves to Prepared.
