A Withdrawal of Nomination is used to remove a Nomination that has been associated with a Land Title. A title can only be Nominated to a single Lodgement Case at a time. If a Nomination has been lodged for a title and you wish to use that title in another transaction then the Nomination must be withdrawn before you can Nominate the title to the alternate transaction.

 

Note: A Withdrawal of Nomination to a lodgement case or paper dealing does not reverse the nomination of a paper CT (pCT) to an electronic CT (eCT). If your original nomination also converted a pCT to an eCT then the title will remain as a eCT after the Withdrawal of Nomination. If you lodged the original Nomination then you will hold eCT Control.

 

Withdraw a Nomination

  1. On the Document List Screen, click Create a Withdrawal of Nomination document.
  2. Review the Nominating Party. This will be your Subscriber Name.
  3. Select the land title or titles that are associated with the nomination you wish to withdraw.
  4. Review Set of Operative Words. Operative words, such as a Registry Instrument, are instructions from your land registry and have a legal influence on the rights and liabilities of Parties covered in the document.
  5. Click Save.

Tip: If the Lodgement case containing the Nomination hasn't been sent to the Land Registry for Lodgement, and you have access to the Workspace that includes the Nomination document you can simple remove the Nomination document from the Documents Screen using the Remove Document button.

Please be aware that a Withdrawal of Nomination to a lodgement case or paper dealing does not reverse the nomination of a paper CT (pCT) to an electronic CT (eCT).

 

If your original nomination also converted a pCT to an eCT then the title will remain as a eCT after the Withdrawal of Nomination. If you lodged the original Nomination then you will hold eCT Control.
