Dear Community,

 

Some community members have asked for more information on the expected timeframes for electronic dealings to register in NSW.   Some lodged electronically are auto-registered, in which case the registration can take place in a matter of minutes.  But what about those that are manually examined?  And which documents are likely to automatically register?

 

NSW Land Registry Services has service delivery targets for electronic dealings to either register, requisition, refer or reject is:

  • 70% within 2 business days
  • 100% within 5 business days

 

Several frequently lodged dealings can be automatically registered when transacted through an ELNO. They are:

  • Transfer
  • Mortgage
  • Discharge of Mortgage
  • Withdrawal of Caveat

 

All other dealing types lodged electronically are manually examined by the NSW LRS team.  There are also circumstances where a dealing that would normally auto-register requires manual examination, such as where there are certain notifications on title or where unregistered dealings may exist on title.    A delay in registration can be disconcerting for practitioners, and indicate further work/investigation may be required.  While caveats do not auto-register, practitioners can have confidence that a caveat takes effect from the date of lodgement.

 

Tips for community members

If you want to keep an eye on a dealing as it progresses, you can utilise the free “Document Inquiry” on the NSW LRS Online Portal to check the status of the dealing by entering the dealing number referenced in PEXA. 

  • To find the dealing number assigned:
    1. Access the documents screen from within the PEXA workspace
    2. Select View next to the document you are interested in
    3. Look for the Dealing No

Hi @Cory,

 

Yes good question.  The long-awaited Notice of Death will be available in Release 11.1.1, scheduled for 14 March.  This was pushed out a couple of weeks from the original date in February due to some delays.  Details of this release can be found here .

 

Change of Name on the other hand, will be one of the first document types released under the new Residual Documents Strategy.  The RDS was developed to speed up the introduction of the long tail of documents required to reach 100% digital.  The RDS provides a framework to enable NSW LRS to design the remaining forms at their own pace.  NSW LRS have proposed Change of Name to be ready in the March/April timeframe. 

 

Meanwhile, Release 11.1.0  features an increase in scope for part tenancy transfers, to enable joint tenancy matters to be dealt with using part tenancy functionality.  R 11.1.0 will be available in production 10 February.  Details are here.
