Can I lodge a Transfer of lease through PEXA?  Is there a help card?

Hello,

Currently you can only lodge a Transfer of Lease as a Residual document - that is create a paper Transfer of Lease, sign & stamp it and then scan &save it as a PDF through PEXA & send it to NSW Land Registry or hand the paper work straight to NSW Land Registry.

Is it still the case that Transfer of an existing Lease (as part of the purchase of a real property) needs to be done as a residual document?

Hello DebbyJJ,

A "Transfer of Lease" is out of scope at the moment and will either have to submitted as a Residual document or lodged in paper to NSW Land Registry.

Please note residual dealing and fully electronic dealing cannot be mixed in the one workspace.

Hello, 

There has been an new enhancement just released and you can now lodge a Transfer of Lease on the platform.

In documents search" Other Documents" "Transfer of Lease"

Both the Transferor ( Lessee) and the Transferee (new Lessee) must be represented in the workspace.

We are in the process of creating a Help card & additional community post and should hopefully have the resources available for members shortly.

Will it be possible for us to register a Transfer of Lease as a financial settlement where there is an existing Mortgage of Lease to be discharged and an incoming Mortgage of Lease to be registered?

Hello KRLegal,

When registering a Transfer of Lease a financial settlement is required. Additional Residual documents can be added within the workspace.

However you cannot mix different groups of documents in the one workspace  eg can't mix mainstream documents (e.g. Transfer) with Residual Documents (e.g. Change of Name)  nor Dealing with Exception - all the documents within the workplace need to be of the same type/format.
