Hi Community
I have a problem where I need your assistance. Trying to lodge transmission application. The 2 registered proprietors are deceased and held the property as tenants in common in unequal shares. Probate for each of the 2 deceased estates have been granted.
The Executors of the 2 deceased estates are the same persons. Can’t seem to prepare the transmission document.
Please advise what I should do. The property has been sold and settlement is imminent.

Hi, I'm not really sure but I think you may have to prepare/lodge 2 separate Transmission Applications as there are or would be 2 separate Probates. Maybe check with support and they should be able to help.

Hope you are well.
Where the tenancy is Tenants in common - process each deceased person transmission application individually as one person's share is not linked to the other person's share. It doesn't matter that they have the same executors.
If they has been Joint tenants then both the deceased details would be recorded on the one Transmission.

Yes that is correct, 2 Transmission applications are required as each person's share has to be transmitted individually because they are tenants in common.
