PEXA is pleased to present a maintenance release of the PEXA System, Release 11.1.1, scheduled for business go live 14 March 2020.

 

UPDATE: There is no expected outage during the rollout of this release.

New Document: Notice of Death (NSW)

New to this release is the ability for NSW Representative subscribers to lodge Notices of Death documents in PEXA.

If a joint tenant is deceased, then the surviving Tenant(s) can make an application to the Land Registry to have the deceased’s name removed, so that only the surviving proprietor’s name is on the Title.

In New South Wales, a Notice of Death:

  • Can be processed for Joint Tenant Title,
  • Can be processed for Tenant in Common Titles which have Joint Tenant groups,
  • Some or All surviving Joint Tenants can be represented as Applicants in the Notice of Death.

A Notice of Death can be lodged as a standalone, or in combination with any of the following document types supported in PEXA:

  • Consent
  • Discharge of Mortgage
  • Withdrawal of Caveat
  • Mortgage
  • Transfer
  • Part Tenancy Transfer

Note: A Transmission can be lodged in the same workspace as a Notice of Death where the tenancy type is TIC with joint inter -se and one of the Tenants in common is also deceased.

New Document: Transfer of Interest (NSW)

PEXA now supports Transfer of Interest documents in NSW.

The holder of either a Mortgage or Charge interest can now transfer their interest to a new interest holder.

Note: A Transfer of Interest (when the interest is a Mortgage or Charge) does not require a Duty Assessment in NSW.

In New South Wales, a Transfer of Interest:

  • Can include one interest per Transfer (The interest can affect up to 20 Titles),
  • Can include one or many Transferors and Transferees,
  • Can be a Monetary or Non-Monetary consideration type,
  • Can optionally include Financial Settlement.

From Release 11.1.1, Transfers of Interest can be lodged standalone. You may also lodge multiple Transfer of Interest documents in the same lodgement case.

ATO Foreign Residential Capital Gains Withholding (FRCGW) integration

We are pleased to advise that PEXA has integrated with the ATO for Foreign Residential Capital Gains Withholding (FRCGW) payments.

As part of R11.1.1*, PEXA members will be able to now complete the details of the Purchasers Payment Notification and lodge it with the ATO. Once successfully lodged, a FRCGW destination line item is automatically created with the payment reference number and amount, unique to the client(s). Upon settlement, the payment(s) will be directed accordingly to the ATO.

Any steps outside of lodging the form and submitting payment will still need to be completed by existing process which you may have.

*The ATO integration will be available post-release; with the date to be confirmed.

New attachment types for documents (NSW)

PEXA has added support for further attachment types, which may be attached and lodged with documents in NSW:

Transfer

  • one 'Minister’s Consent' attachment
  • one or more 'Caveator’s Consent' attachment
  • one or more 'Statutory Declaration – statement for notice of severance' attachment
  • one or more 'Native Title Registration Approval Certificate' attachment

Transfer of Interest

  • one 'Minister’s Consent' attachment
  • one or more 'Caveator’s Consent' attachment

National Mortgage

  • one 'Terms and Conditions' attachment (already supported)
  • one 'Minister’s Consent' attachment
  • one or more 'Caveator’s Consent' attachment

Caveat

  • one 'Claim Details' attachment

Task enhancements

As you can now complete a wide variety of documents in PEXA, we have replaced the Complete Transfer task with a more general Create Document task. When you click on the Create Document link, you will be taken to the Document List screen where the full list of documents that are available to you will be displayed. This task is relevant only to subscribers in the role of Incoming Proprietor or Proprietor on Title.

Usability enhancements

Transfer warning message

We understand it’s often hard to determine why your Transfer document is not moving to a Prepared document status. Quite often, this is because the Proprietor on Title party is not yet represented or is missing identification information such as date of birth. To help you quickly ascertain what is missing from your Workspace, we have added a warning message to the Transfer document to highlight when information is missing. When you see this warning message on a Transfer document, the proprietor's representative should navigate to the Participants screen and then Edit the Proprietors on Titles party record to add these details.

Hi Team!

A quick question for the the new attachment types for Documents - NSW, Currently when creating a National Mortgage there is a tick box for attaching the 'Terms and Condition', which we would then attach the PDF in the Files Tab. Would this be the same format in where we would be doing the 'Caveator's Consent'? ie. select tick box and attach to files.

Hi @Clarkee 

 

A Caveators consent is optional, not expected to be high volume and therefore not managed by a check box. 

 

For a Mortgage, the check box indicates that they intent to attach a Terms and Conditions file.

 

This ensures that the status of the Mortgage remains 'Prepared - Awaiting Attachment', not allowing the Mortgage to be signed until the file is uploaded and attached to the Mortgage.

Great to know that the process will remain simple. I take it the that the teams will simply upload the pdf to the Files tab, and they will have the selection the drop down of 'Caveator's Consent'?

As part of the upload file process, select File Description and choose "Caveator's Consent" from "Land Registry Attachment Files".

@TSullivan ,

Can we please confirm if the new document types mean that we no longer need to produce the original document to the LRS for NSW? Currently we need to produce and lodge the original Minister's Consent for registration to complete. Sorry this was not in my original series of questions.

Thank you for your questions. As some of your questions relate to Participation Rules and Audit, I will need you to confirm those items with the NSW Land Registry. 

 

1. Notice of Death (NSW) - If we are a participant in a transaction where the Notice of Death is present, will we need to hold a copy of the Death Certificate in the event the lodgement case is audited by the Land Registry and we as the Responsible Subscriber receive the audit request? - Please confirm with the NSW LRS. 

 

2. New attachment types for documents (NSW): 

 

(1) Do the attachments flow through to the Titles Office? i.e. does the Title Office get to see the attachment? - Yes, once lodged, the Land Registry is able to retrieve (download) the attachment to assist in their examination process. 

 

(2) Does the Responsible Subscriber have visibility of the documents to verify their accuracy? e.g. can we see the Minister's Consent? - Yes. The subscriber that uploads the Attachment can share the file with other participants in the workspace. This is done at the time of upload, using share 'setting' logic. If a subscriber has not shared the attachment with you, it can be shared by that subsciber editing the file share settings. For more detail, please feel free to Direct Message me. 

 

(3) In the event of an audit by the Land Registry, does the Responsible Subscriber need to hold a copy of these attachments? - Please confirm with the NSW LRS.

Hi @Clarkee 

Always best to confirm with NSW LRS.. but my understanding is that you will no longer need to produce the original document to the LRS, as they will recieive the attachment as part of the lodgement.

With regard to your comment regarding the Task enhancements.

 

Tasks enhancements - Will the OFI's have a limited subset of the documents in the task list based on Participant Agreements and can these lists be provided by state?

 

FI's are not affected by this change so you will see the same tasks that you have done previously.

Hi, with the PEXA and ATO integration for FRCGT withholding payments, does this mean it is fully integrated so that from within the workspace you can manage - payment notification being lodged, payment made and receipt from the ATO sent to vendor and purchaser? 

I'm keen to understand if the payment notification form is exactly the same as the ATO online form including the declarations made by a representative lodging the form on behalf of a client?  https://www.ato.gov.au/forms/foreign-resident-capital-gains-withholding-purchaser-payment-notificati...

Is there some further information, perhaps a video could be provided please?

I'm also not sure what is means when you say: "*The ATO integration will be available post-release; with the date to be confirmed."

In reference to your question around the declaration statement, page 6 of the ATO online form, this declaration was not a requirement made by the ATO for PEXA members.

 

This functionality is going to be enabled on PEXA post this release, with the exact date to be determined. We will, as always, keep you informed and up to date with when this date is set.

 

Lastly, PEXA members are still able to continue with the current process with the ATO online form; the form isn’t mandated to be completed on PEXA. We do hope, however, that this new functionality reduces time and effort in using multiple systems to remit payment to the ATO.

That's correct, we've not rolled out the functionality for FRCGW. There's been some delays with getting the FRCGW PPN form finalised, and as such we'll (hopefully) be looking to bring this in towards the end of 2021.
