Hello,

 

Can a QLD settlement proceed in the PEXA space if a request to release the statutory charge has been lodged, but not yet registered?

Hi @Anthony_P 

 

It would be advisable to speak with Titles Queensland to ensure that settlement will not be impacted or requisitioned due to the statutory charge not yet being registered.

I think the answer to this may be that a transfer will be registered irrespective of whether:

 

  • there is a statutory charge on title; and

 

  • there is a lodged-but-not-yet registered 'release' (or request to cancel or withdraw) the statutory charge,

 

and that the property remains subject to the charge until the 'release' (request) is registered, in the hands of each of the transferor and transferee, respectively.
