Notice of Death, Transfer and Mortgage

We act for the purchaser and the incoming mortgagee is St George (FMS is acting for St George in the PEXA workspace).

Notice of Death prepared by Vendor's solicitor and verified successfully by LRS NSW.

St George (incoming mortgagee) are refusing to action anything on the PEXA workspace without a certified copy of the Death Certificate.

St George are not entitled to a copy of the Death Certificate of the deceased Vendor. As long as the Notice of Death is prepared and verified successfully by LRS NSW that is all St George should require. They are refusing to do anything.

PEXA have confirmed the Death Certificate is not required by LRS NSW so should not be required by St George and other workspaces have proceeded to settlement without the Death Certificate being uploaded.

How is it that the bank is incapable of grasping this concept.

The bank also only requested a copy of the Death Certificate after settlement had rolled over twice.
