Land Titles—PEXA Projects

Subscribers can now add an additional parent land title to a Project, which can be used in a multi-stage development project to represent a different developmental stage within a project. To add a new parent land title, the Project must be flagged as a multiple stage Project and contain Workspaces without child titles. Each Project (and its Workspaces without child land title) can have a single active parent land title at any given time. When a new land title is added, Workspaces within the Project that do not have child titles inherits this new parent title.  Adding an additional parent land title To add a new parent land title, the Project must be flagged as a multiple stage Project. Create a new PEXA Project and select   Yes   to Do you intend to have more than one stage in this project. By selecting   Yes, the Subscriber will be able to add another parent title to the project once the Plan of Subdivision has been registered for its existing parent title. Add a new parent land title: On the   PEXA Projects   dashboard, open the project you just created. Click   Edit Project Details. Under   General project details, click   + add another Parent Land Title. Note: The active land title is marked with a green tick. Any new Workspaces created in the Project will inherit the parent title that is active at the time the Workspace is created. Enter a new parent land title reference and click   Save Project Details. Workspaces that do not have child titles will now inherit the new parent title. Check the updated land title: You can check the updated land title in the PEXA Exchange platform. In PEXA Exchange, open one of the Project’s Workspace and navigate to the   Land Titles   screen. Last updated: 02 December 2021 Jurisdiction: NSW Additional Resources: Help Card   Overview You can now create and lodge Lease/Sublease documents in a NSW Workspace. A Lease/Sublease is a tenancy agreement between the landlord and the tenant that allows the tenant to rent out the property based on the terms and conditions set out in the lease agreement. In PEXA, a Lease may be lodged: As a standalone document, In combination with other documents, such as Transfers* or Mortgage Discharges. The Lease/Sublease document is required to be prepared and signed by only the Lessor party in PEXA. *To register the Lease before the Transfer in the same Workspace, the participant representing the Proprietor on Title must create the Workspace and then prepare the lease before any Incoming Proprietors parties are created.   Conditions and Provisions To successfully lodge a Lease/Sublease through PEXA, a signed copy of the Conditions and Provisions will need to be uploaded and attached to the Lease/sublease document. The Conditions and Provisions attachment refers to the Annexures and any other relevant conditions related to the lease. Note: Where the Lease/Sublease requires a Plan, ensure to attach the Plan to the Lease/Sublease as a separate attachment in PEXA. Additional attachments may also be attached to the Lease/Sublease including: Plan Statutory Declaration Supporting evidence   Steps Note: This set of instruction applies to a standalone Lease document. If you are lodging a Lease and a Transfer together in the same Workspace, please ensure financial settlement is included in the Workspace. Create a Workspace with the following settings: Jurisdiction: NSW Representative role: Proprietor on Title  – When lodging a lease, Incoming Proprietor – When lodging a lease/sublease in combination with a Transfer, or  To Deal with an Interest – When lodging a sublease. Complete the other fields as required. Review the Land Title. Represent the Lessor : Select one: If lodging a standalone lease, click Edit next to the on-title party you represent. If lodging in combination with a Transfer, click Create Party. Ensure I represent this party is selected. Complete the Party Details. Save the changes. Repeat Step 3 for all parties you represent. Create the Lessee party : Click Create Party. Ensure the Role is set to Interest Holder. Complete the Lessee Details. Save the changes. Repeat Step 4 for each Lessee. Create a Lease or Sublease document: The Lease document is created by the Lessor. Navigate to Documents > Create Document > Lease. Complete the following fields on the Lease screen: Titles Specify whether the Lease applies to Whole or Part of the title. If the extent is Part – Lease description, a description of the land affected will be required. This field is limited to 200 characters. Is this a Sub-Lease of a Lease?: This field is automatically selected based on your Workspace role: No – When creating the document in the role of Proprietor on Title or Incoming Proprietor. Yes – When creating the document in the role of To deal with an Interest. Lessor Details This section auto-populates with: The Proprietor(s) who are currently registered on title (Lease), or The Lessor Details (Sublease) . Lessee Details This section is auto-populated with the represented Lessee's details you created on the Participants screen. Lease Details Summarise the terms of the Lease. Lease Period: Enter the initial lease period in number of years, months, and days. Rent details: Enter the details related to the rent. Terms of Payments and Rent Description are mandatory; for more information on these requirements, refer to Item 9 Rent on the NSW Land Registry website. Option to Renew details: If there is an option to renew, then enter the renew period(s). Option to Purchase details: Indicate if there is an 'Option to Purchase' for the lease. Save the Lease document. Note: Multiple Leases can be created in the same Workspace. If there is more than one Lease, then repeat Step 6 for each lease required. Attach the Conditions and Provisions to the Lease/Sublease: A Conditions and Provisions attachment must be signed by both the landlord and the tenant. For information on Conditions and Provisions, see here. Navigate to Files > Upload Files. Upload the file: Browse for the file. Under Land Registry Attachment File, select Conditions and Provisions. Complete the other fields as required. Click Upload. Select Cog > Attach to attach the file to the Lease/Sublease. Note: In addition, the following files may also be attached to a Lease document: Plan Statutory Declaration Supporting evidence  View and sign the documents within the Lodgement Case. The Lease must be signed by both the Lessor. The Lodgement Instruction is signed by the lodging party. Next steps: For a standalone Lease/Sublease, when all documents within the lodgement case have been signed, the responsible party may submit the documents to the Land Registry for lodgement by selecting Submit for Lodgement.   If there is financial settlement, then both parties must sign the Financial Settlement Schedule. Last updated: 16 September 2021 Jurisdiction: SA Additional Resources:   Help Card,   Walk Thru   Overview PEXA supports the electronic lodgement of a Survivorship followed by Transmission, known as   Application to Register Death (all applicants deceased)   in South Australia. If all parties in a   Joint Tenancy   passes away, a   Survivorship with Transmission   application should be made to confirm the pre-deceased Proprietors and appoint the Executor/Administrator of the last deceased Proprietor. In PEXA, the last deceased Proprietor is known as the Primary Deceased.   Note: You are required to provide supporting documentation in PEXA to lodge a Transmission so please ensure that you are in possession of the correct documentation. Note: If one or more Proprietors in a   Joint Tenancy   passes away and there is a surviving tenant remaining on   title, please lodge a   Standalone Survivorship   instead. If a   Sole Proprietor   passes away, please lodge a   Transmission   instead. If you are lodging a Survivorship followed by a Transfer, click here.      Walk Thru Select Walk Thru a Survivorship (SA) from the Help tab in PEXA then follow the on-screen prompts.     Steps   Create the Workspace in with the following settings: Jurisdiction: SA Transaction Type: Other > Transmission Role: Incoming Proprietor Important For a standalone Transmission, select No to Financial Settlement required?. For a Transmission lodged with a Transfer in the same Workspace, select Yes to Financial Settlement required? and Will this transaction involve a Transfer?. Review the   Land Title. Confirm the Proprietors are deceased: Navigate to the   Participants   screen and select   Edit Party   against the deceased Proprietors. Select   The Proprietor is Deceased. Click   Add Details of Death   and complete the details. Save   the changes. The Proprietor now appears as deceased on the   Participants   screen. Repeat step 3 for all deceased Proprietors. Represent the Executor/Administrator/Legal Personal Representative: On the   Participants   screen, click   Create Party. Select   I Represent this Party. Ensure the role of   Incoming Proprietor   is selected. Complete the required information for   Party Details: Name Date of birth Party Capacity to be recorded on Title Click   Save. Create a Survivorship document for each of the pre-deceased Proprietors (except for the last deceased): Navigate to the   Documents   screen and then select   Create Document > Survivorship. Check the   Land Title. If there are multiple titles in the workspace, select the correct title. If there is a single title, the title will be automatically populated. Check the   Deceased Proprietor Details: The correct Proprietor is registered as deceased. Their details of   death   are correct. To update their details of death, click   Edit Details of Death. Under   Applicant Details, check that the surviving Proprietors' details are correct and complete. Under   Grantee Details, check that the Name, Party Capacity, and Address are correct. Save   the document. Repeat Step 5 until a Survivorship document is created for all pre-deceased Proprietors (except for the last deceased). Create the Transmission: The Transmission Application is created for the Proprietor who passed away last. On the   Documents   screen, select   Create Documents > Transmission. Under   Applicant Details, check that the correct   Party Capacity   is selected and the   Address   is correct. Under   Tenancy, check that the details for the last deceased Proprietor are correct. Add   Evidence Details: The Evidence Type will populate automatically, depending on the Party Capacity entered. Enter the Evidence Date. If there are additional evidence types that support this transaction, add them by clicking   Add Evidence. Save   the Transmission. Attach evidence to Transmission: You are required to attach supporting documentation for the Transmission (e.g. Probate/Letters of Administration). Navigate to the   Files   screen and click   Upload Files. Browse for the file and complete the required fields. Note: Under   File Description, select the   Land Registry Attachment File   applicable to the   Evidence Type you are uploading. Click   Upload. Select   Cog > Attach   to attach the file to the Transmission. For a Transfer Workspace only—If you are lodging a standalone Transmission then skip this step. Invite the Incoming Proprietor into the Workspace via the Participants screen and then wait for them to: Create and represent the incoming party as a new party in the Workspace. Create the Transfer document. View, Sign and Lodge the documents: Note: The document status for documents within the Lodgement Instructions must be   Prepared  and Successful  before you can sign the documents. On the   Document   screen, select the Edit   against the Lodgement Instructions. Ensure to check the order of lodgement. On the   Document   screen, select the View   against the Survivorship(s) and Transmission and review the details. On the   Document   screen, select the   Sign   against the Lodgement Instructions. Select the checkboxes for Lodgement Instructions, Survivorship(s), and Transmission and if applicable, Transfer then click   Sign Documents. The documents will be verified with the Land Registry and once they are successfully verified and signed, you can lodge the documents. If a joint tenant on a property title passes away, then the surviving proprietor should make an application to the Land Registry to have the deceased’s name removed, so that only the surviving proprietor’s name is on title. A Standalone Survivorship can be lodged: When one or more Proprietors on Title in a Joint Tenancy has passed away and there is at least one surviving Proprietor With or without financial settlement  Note: If all Joint Tenants  have passed away, a Surivorship will need to be lodged for each pre-deceased joint tenant and a Transmission for the Primary deceased. That is, create the Survivorship for the Proprietor who passed away first, then create the Survivorship for the Proprietor who passed away second, and so on.  Navigate to the Documents screen and then select Create Document > Survivorship. A warning message appears to alert you that you cannot create a Transfer in the same Workspace as the Survivorship. Click Proceed to continue. Check the Land Title. If there are multiple titles in the workspace, select the correct title. If there is a single title, the title will be automatically populated. Check the Deceased Proprietor Details: The correct party is registered as deceased. Their details of death are correct. To update their details of death, click Edit Details of Death. Under Applicant Details, check that the surviving Proprietor's details are correct and complete: Ensure only the surviving Proprietors are listed here. Save the document. Repeat Step 5 for all deceased Proprietors. View, Sign and Lodge the Survivorship: Note: The document status related to the Survivorship must be Prepared and Successful before you can sign the documents. If you have more than one Survivorship in the Workspace, ensure to check the order of lodgement. On the Document screen, select the View against the Survivorship(s) and review the details. PEXA is pleased to present a maintenance release of the PEXA System, Release 9.0.1, scheduled for business go live   3 December 2018 10 December 2018.   UPDATE: There is no expected outage during the rollout of this release.     Key Highlights Positive title activity check (TAC) changes in Victorian Workspaces (VIC) Notice of Acquisition (NoA) enhancements (VIC) Leases (NSW) (Updated 10 December 2018) Lodging a Survivorship or Transmission with a Transfer (SA & NSW) (Updated 11 December 2018) New landing page (Updated 13 November 2018) Enhancements to the Workspace (Updated 05 December 2018)     POSITIVE TITLE ACTIVITY CHECK (TAC) CHANGES IN VICTORIAN WORKSPACES (VIC) In Victoria, it is common for a Nomination and/or Withdrawal of Nomination to be lodged on settlement day or the day prior to settlement. As a result, the title activity check (TAC) on the day of settlement is returned as positive and all incoming parties (incoming proprietor, incoming caveator and incoming mortgagee) need to 'confirm settlement execution' before   settlement   can proceed. In many cases, the result is a delay to settlement. In R9.0.1, we have updated the TAC to ignore known activity for nominations and withdrawal of nominations lodged from within the current workspace. TAC will return as positive for activity that is: Lodged from the current Workspace, except for Nominations or Withdrawal of Nominations Lodged from another workspace in PEXA Not lodged through PEXA E.g.1. TAC on the day of settlement returns activity related to a caveat that has been lodged on   title. Result: PEXA will notify the participants in the Workspace and incoming subscribers will be required to ‘confirm settlement execution’. E.g.2. TAC on the day of settlement returns activity related to a nomination which was lodged from the current Workspace. Result: PEXA will not notify the participants in the Workspace and incoming subscribers will not be required to ‘confirm settlement execution’. (Referencing PEXA SETT-6030)   NOTICE OF ACQUISITION (NOA) ENHANCEMENTS (VIC) PEXA will be implementing an updated stylesheet for the Victorian Notice of Acquisition that will address some of the current deficiencies. The following items will be corrected as part of this change: All Titles for each Property will be displayed The Land Description for each Title will be displayed Transferor Representative will be displayed Overseas Addresses will display correctly (Referencing PEXA LS2-5802)   LEASES (NSW) PEXA now supports lodgement of Leases in New South Wales.  A Lease in PEXA enables the representatives of the Landlord (Lessor) and the Tenant (Lessee) to prepare, sign and lodge   a NSW   Lease over Whole or Part of the Land in a Title. A Lease may be lodged in the following scenarios: In combination with a Transfer of Land. In a series with other Leases (i.e. consecutive leases). A Lease document has a mandatory attachment type of Conditions and Provisions, which requires a subscriber to upload and attach one of the following file types to their Lease: Plan Minister’s Consent Caveator’s Consent  Note: Sub-Lease, Surrenders of Lease and Variations of Lease are not yet available in PEXA. This is to be confirmed with the Land Registry).   For more information, refer to the Community help article.    (Referencing PEXA LS2-3523)   LODGING A SURVIVORSHIP OR TRANSMISSION WITH A TRANSFER (SA & NSW) PEXA is implementing an update that allows Survivorships and Transmissions to be lodged together with a Transfer in the same PEXA Lodgement Case. This simplifies the process and the need to create these documents in separate Workspaces.   The following combinations are supported (including other variations of these combinations): Survivorship–Transfer–Mortgage (SA) Survivorship–Transmission–Transfer–Mortgage (SA) Transmission–Transfer–Mortgage (SA, NSW) Transmission Direct to Beneficiary–Transfer–Mortgage (NSW) (Referencing PEXA LS4-1397, LS4-1398)   NEW LANDING PAGE PEXA is excited to introduce a new, simplified landing page experience for members. The current landing experience directs you to the Dashboard, which displays a complex table of all active workspaces. While comprehensive, this can make it difficult for members to focus on high-priority Workspaces. The new landing page is designed to cut down the noise and help you see recent Workspaces at a glance. After you log into PEXA, you will see your six most recently-viewed Workspaces arranged as clickable cards. Other enhancements include: Workspace status is colour-coded to help with prioritisation Layout is mobile-friendly and fully responsive The entire Workspace 'card' is now a link that can be clicked or tapped   You will still be able to view Active workspaces and all of the other dashboards from the left navigation menu, where they are displayed in their original table format. Although the Dashboard will no longer act as the default landing page, it is still accessible via the left navigation menu.   (Referencing PEXA FS-4199) Enhancements to The Workspace PEXA has made further improvements to the Workspace.   Ordering of Tasks Tasks in the Oustanding Tasks panel on the Workspace Summary screen and in the Tasks screen are now sorted in the order in which they must be completed. Linked Lodgement panel A new panel for Linked Lodgements has been added to the new Workspace Summary. The Linked Lodgement panel displays a maximum of 10 Workspaces that are already linked. Status indicators for each linked Workspace are: Status Description The Workspace status is Ready, and The settlement date and time matches in all linked Workspaces. The Workspace status is In Preparation or Prepared, and The settlement date and time matches all linked Workspaces. Hi @cstewart,   Thank you for your post. I've checked this with others and you can create a Third Party Transfer document with the role of Mortgagee on Title, however, all parties need to be represented before you can actually create the Transfer by TP document. I've updated the help article to reflect this.   As for your second question, you're right - the Discharge of Mortgage document isn't required in a Transfer by Third Party document. PEXA is pleased to present the release of PEXA Projects (PoT and MoT) — Release 4.3.0, scheduled for business go live 26 October 2018.   New bulk Financial Upload We’ve made it easier for you to efficiently upload bulk financial data to PEXA. This is the first iteration of the Bulk Upload Financials tool that lets you import bulk Financial Settlement Schedule (FSS) data from an Excel file to PEXA via a wizard. You can now use a wizard to import the following data to your project’s Workspaces: Subscriber Reference Lot Number Financial Settlement Schedule (FSS) data Destination line item Source line item The data in the file will be mapped and once uploaded, will create or replace the financial line items in the PEXA Workspace. Note: The option to upload bulk financial data via PEXA Connected is still available, however, the link to PEXA Connected via PEXA Projects will no longer exist. Instead, this link directs you to the new Bulk Upload Financials tool. To use PEXA Connected, you will need to access it via the PEXA Core dashboard.   How do I access this new feature? You can access the Upload Bulk Financials tool via the updated side navigation menu under Manage Workspaces > Upload Bulk Financials.     Mapping data For destination financial line items, your file will need to include a Destinations tab and include specific columns (e.g. Subscriber Reference, Lot Number, Destination Category, Amount, Transaction Description). Similarly, for source financial line items, your file will need to include a Sources tab and include specific columns (e.g. Subscriber Reference, Lot Number, Source Category, Amount, Description, Source Account). Furthermore, we will allow a Workspace to automatically reschedule up until 5:00 PM AEDT^ (previously 4:00 PM AEDT), which will give you more time to settle Workspaces that had not been able to settle earlier in the day. Any Workspaces that remain Not Ready at 5:00 PM AEDT will have its settlement date and time removed and a new date and time will need to be proposed. Title Activity Checks and Stamp Duty Verification (where applicable) will continue to run within the hour prior to the scheduled settlement time. Notes: The Manual Rebooking cut-off time will remain at 4:00 PM AEDT (i.e. settlements cannot be rebooked for the same day after this time). ^The Queensland reschedule cut-off time will remain at 4:00 PM AEDT due to Land Registry’s lodgement availability restrictions. (Referencing PEXA SETT-5580, SETT-2556)   Ready to Sign – Manual Allocation of Workspace for signing We’ve introduced a new opt-in functionality that allows Subscriber Managers to turn on Manually allocate Workspaces. To access this setting, go to Administrator Tools > Manage Subscriber Details > Ready to Sign – Allocation Preferences. By default, Automatically allocate Workspaces is selected.     When Manually allocate Workspaces is selected, users can add or remove pre-approved Workspaces to or from the Ready to Sign dashboard. This means you have more control over which Workspaces appear in the Ready to Sign dashboard and sign approved Workspaces with minimal on-screen clicks.   Scenario: With Manual allocation of Workspaces turned on in ABC Conveyancing, junior law clerks can manually add or remove pre-approved Workspaces to the Ready-to-Sign dashboard. Senior lawyers are then able to review the subset of Workspaces that are ready for signing and use the current efficient signing to sign Documents with minimal on-screen clicks.   Limitations to Manually Allocate Workspaces: Only Workspaces with signing tasks can be manually allocated to the Ready to Sign dashboard. If a Workspace that is manually allocated to the Ready to Sign dashboard includes a Nomination and Priority Notice, they will appear as an action item for all users. However, only participants who created the document have permission to sign. Users without signing rights are still able to select Workspaces for signing and will be directed to the signing screen. However, they won't have permission to sign the document. The Add to Ready slider is not supported in IE8. The Added By column can be filtered only by username. Additional improvements: In addition, we’ve made other improvements to efficient signing: Financial Line items will continue to display for Subscribers until all signing is complete. Destination line items that include a Payment Reference Number (PRN) are included on the signing screen from the Ready to Sign dashboard. Future addresses in a VIC Notice of Acquisition (NOA) are now displayed when signing from the Ready to Sign dashboard. Workspaces manually allocated to Ready to Sign are reflected when deep-linked from PEXA Projects (if Subscriber has opted in to this function). When the user deep-links from PEXA Projects, the number of line items displayed per page is set at 25. (Referencing PEXA FS-3270)   Workspace Summary Revamp Note: Initially this functionality will be piloted with 5% of our member base. After actioning any feedback we’ll progressively enable this screen for all members. To help you quickly assess the health of your Workspace and pinpoint outstanding items, the new Workspace Summary screen consolidates all the statuses and indicators you need to determine why your Workspace isn’t Ready/Ready. This will save you navigating through the Workspace in search of outstanding items. Additionally, each item that you need to action will be clickable and actionable, simplifying and streamlining your work. For example, if your document hasn’t been signed, you’ll be able to click on the Sign document link and be taken to the signing screen.     The new Workspace Summary will also be mobile responsive! If you’re already using multiple platforms in the PEXA suite – such as PEXA Projects when acting as Mortgagee on Title for a development project – you can access these via the app menu (top right corner of your account), making switching between platforms quick and easy.   Positive title activity check changes in Western Australia (WA) We have updated the Title Activity Check (TAC) in Western Australia to ensure that a positive TAC is displayed only for new activities on the land title that has not been previously returned. This ensures that incoming parties are not having to repeatedly provide approval for activities that were previously approved. On the day of settlement, if a positive TAC is returned, the incoming parties will only need to ‘confirm settlement execution’ if a new title activity has been returned from the Land Registry for the first time. All subsequent TAC responses received for the same activity will be displayed as no activity against the Land Title. This change now aligns the behaviour of WA TACs to all other jurisdictions. PEXA is pleased to present the release of PEXA Projects (PoT), scheduled for business go live 8  October 2018 .   New features Ability to manually add Workspace(s) to a Project within PEXA Projects (PoT) Increase character limit on Subscriber Reference New validations for Account Locking   Ability to manually add Workspaces to a Project within PEXA Projects (PoT) In addition to creating Workspaces via the bulk upload tool, we’ve developed a new option that lets you manually create Workspaces within a Project in PEXA Projects. Manual creation of Workspaces lets you manage additional Workspaces conveniently within PEXA Projects. You can easily add any number of Workspaces to any projects at any given time. Subscribers managing a project with a small number of lots can also add Workspaces without needing to do an initial file upload.   How do I access this new feature? We've redesigned and updated side navigation menu and the new feature can be accessed via this new menu under Manage Workspaces > Add Workspaces.   Alternatively, you can also add new Workspaces by clicking the Add Workspaces button located on the Workspaces panel on the dashboard.     Adding new Workspaces The new Add workspaces screen allows you to add Workspaces to a Project on either a parent title (if a plan of subdivision has not yet been registered) or a child title. You may add any number of Workspaces as required, there is no limit. Any Workspaces created within a Project will inherit the following data from the Project it was created in: Subscriber ID Role (PoT) Jurisdiction Workgroup Mortgagee on Title (MoT) Project ID In addition, information about the Incoming Proprietor participant and Incoming Proprietor parties is captured and populated into the Workspace. If the Workspace you created was Unsuccessful or Partially Successful, then a message appears on the screen prompting you to review the Workspace. Please correct any errors and resubmit the Workspaces for creation in PEXA core.       After the Workspaces are successfully created, the Proprietor on Title may send bulk invitations to the relevant Mortgagee on Title participants. Increase character limit on Subscriber Reference The subscriber reference field for Workspaces created via PEXA Projects has been extended to more than 30 characters. Note: PEXA Project dashboard will display the entire name at a max length of 200 characters.     New validations for Account Locking BSB Validation We have added some simple validation on the BSB field when entering account details. The validation checks whether the BSB entered is valid and if not, a warning message is displayed to users accordingly.   Account Name validation We have improved the validation to exclude special characters from being accepted in the Account Name field. When you log on to PEXA Projects, you’ll see a new global navigation header with the new branding. The global navigation header includes newly branded clickable icons that redirect you to Single Sign-On links.   New global navigation header     Single Sign-On (SSO) We have also introduced the Single Sign-On (SSO) functionality, which greatly enhances the user experience. With Single-Sign-On, you can seamlessly navigate between PEXA Projects to other PEXA products (for example, a PEXA Workspace or the PEXA Community) without needing to enter your logon credentials again.  Single Sign-On links are accessible via the global navigation header. Click on an icon to redirect to the relevant page.     Financial Account Locking (PoT) Subscribers can now lock the financial account for disbursements within a project. This new control feature helps mitigate errors associated with managing financial accounts across a high number of Workspaces within a project. The new option to set the account lockdown flag is accessible when you create a new project, or via the new Financials link on the side menu. By setting this flag in PEXA Projects, no disbursement financial settlement line items may be created until at least one financial account has been created and approved within PEXA projects. When a financial account has been approved for a disbursement category (e.g. Vendor Funds), then any disbursement line items created using this category within a Workspace (for a project) will have financial account details auto-populated and non-editable.     Click Financials on the side menu to set the intent to restrict accounts. Any Subscriber user may set this flag.     A new Manage Financial Accounts screen lets you add financial accounts for a disbursement category. Only Subscribers with Financial Settlement Schedule signing permissions or Trust Account signing permission may create accounts.   Once an account has been added, you can Approve or Decline the request to restrict accounts. In this instance, when a Sole Proprietor, a Tenant in Common, or all parties in a Joint Tenancy are deceased, and a beneficiary is nominated, you can lodge a Transmission Direct to Beneficiary to transfer ownership of the title from the deceased directly to the beneficiary. This is different from a Transmission Application where the title is first transmitted to a Legal Representative Executor before being transferred to a beneficiary.   The following information is required when lodging a Transmission Direct to Beneficiary: Grantee Details (Executor, Executor by Representation, Administrator, or Trustee) Details of Death Evidence Details Notice of Sale Stamp Duty Written permission from the Grantee Financial Settlement   Steps Create the Workspace with the following settings: Jurisdiction: NSW Transaction Type: Transmission Direct to Beneficiary Representative Role: Incoming Proprietor. Confirm that "Written consent to this Application has been obtained from the executor of the will/administrator of the estate/trustee of the estate of the deceased registered proprietor" by selecting Yes. Add Evidence Details: Select the Evidence Type. Enter the reference number and date. Click Add Evidence to add additional evidence if required. Save the document. Edit the Notice of Sale: On the Documents screen, select Edit from the Actions column next to Notice of Sale. Complete the fields and then Save the changes. The document status for Notice of Sale should now be Prepared. Enter Stamp Duty information: On the Stamp Duty screen, click Enter Duty Information. Type in the DAN reference number in the OSR reference number field and then Save the changes. The stamp duty is automatically verified, and the stamp duty verification result should return as Successful. Edit the Lodgement Instructions: On the Documents screen, Edit next to Lodgement Instructions. Edit the fields and then Save the changes. Sign the Documents From the Actions column select Sign, ensure the Lodgement Instructions, Transmission Direct to Beneficiary is successfully signed. Complete the Financial Settlement Schedule: Navigate to the Settlement screen. Click the Adjustments & Payments tab to add in your Destination and Source line items. For Source Funds, ensure you verify and authorise the funds. Sign the Financial Settlement Schedule and all Documents. Should a Transfer be required, you would need to lodge and register the Transmission Application first, and then lodge a Transfer in a separate Workspace. When lodging a Transmission Application (APR) in NSW, the following information is required: Details of Death Evidence Details Consent You are not required to attach supporting documents in PEXA for Transmission Applications in NSW. Once available, we recommend that all users upgrade to this certificate as soon as possible so they can take advantage of the performance improvements. To prepare you for the rollout, here is information about how to upgrade to the Digital Certificate software.   *Note: This feature will be activated on 30 July 2018. (Referencing PEXA PX-131) NEW HELP ICON As part of a new look and feel for the PEXA top navigation bar, a new floating Help icon has been added to the Dashboard. The new Help icon replaces the previous icon, which was located on the navigation bar. The new icon provides in-context support by directing you to the relevant Help page when it is clicked. Note: This feature will be activated in early August. In the meantime, the existing Help and Community link offers the same functionality but with the classic look and feel.       (Referencing PEXA FS-3242) AMENDMENTS TO STANDALONE NATIONAL MORTGAGE Previously, you couldn’t lodge standalone National Mortgage that contained multiple tenants of the same name on a single title in PEXA. When doing so, parties who share the same names had their names merged as a single party. This issue has now been fixed. From this release, you can now lodge a standalone National Mortgage where multiple tenants of the same name are on a single title. PEXA now references each party as separate title holders, even if they have the same name.   EXAMPLE John Smith (holds 1/3 share of the title) and John Smith with Mary Smith (hold 2/3 share of the title) as Tenants in Common. PEXA now references each title holder correctly on the Participants screen.       (Referencing PEXA) NEW USER ACCOUNT AUTHENTICATION As of 27 June 2018, PEXA will run an internal authentication process for newly created user accounts. The process involves verifying the account creation and may take up to 2 business days to complete. During this time, if further verification is required, PEXA will contact the Subscriber. New users will not be able to log in to PEXA and will not appear as a user in the Workspace until the verification is complete. Once verification is complete, PEXA will contact the relevant parties to inform them of the account status. Security tip Verified users with signing rights will also need to install the digital certificate in order to sign documents and the Financial Settlement Schedule. Before giving the final sign-off, please carefully check that the details on the settlement statement are correct. Whilst PEXA makes it a priority to provide a safe and secure platform for you to process online settlement transactions, we encourage you to learn more about how you can protect your account.   TIMESTAMPS ON THE FINANCIAL SETTLEMENT SCHEDULE As of 27 June 2018, the Financial Settlement Summary has been enhanced to include information of when a destination line item was last modified. Users now have the ability to mark a project on their dashboard as being Archived. When this is done, the project is moved into a separate list view and no longer appears on the main dashboard. You can unarchive a project at any point. The Trust information saved against the Frequently Represented Party record will now pre-populate into the Workspace when creating parties and auto-representing on-title parties.     (Referencing PEXA AXL-924) File Description types are now categorised We’re making it easier for you to distinguish between general file types and attachment types when uploading files to the Workspace. The items in the File Description is now grouped into categories of General Files and Land Registry Attachment Files. This makes it easier for you to find the right file when uploading a file. The two category types: General Files— used for files that are shared amongst participants, or for files that are kept as records in your Workspace. Land Registry Attachment Files— used for attaching additional files to a Workspace Document that support your PEXA Lodgement.   In addition, we’ve also added a new menu item–Others–to the File Description drop-down menu. This option allows you to enter a custom file description for an uploaded file. Last updated: 10 May 2021 Jurisdiction: All   The Settlement Notification functionality gives  Incoming Proprietor reps  and  Proprietor on Title reps  more control over the notification that is sent upon successful settlement of a Workspace. This functionality allows both Incoming Proprietor reps and Proprietor on Title reps to : Create multiple settlement notification emails Add multiple email addresses per settlement notification Customise the content of the settlement notification email This better aligns with current practices followed in NSW and Queensland, but also provides enhanced functionality for remaining states. This functionality's main purpose is to notify real estate agents of successful settlement. But it's flexible enough to be used for other purposes, such as notifying a broker, body corp or even client. Demonstration Video     Steps Create a Settlement Notification To create a Settlement Notification: Navigate to Notifications > Settlement Notifications Click Add. From here, you then add the recipient(s) and select an email template for the notification.  If you wish to create a custom email, you must first select Custom from the Email Text drop-down list before you can start typing your message. Optionally, you can also upload and attach a file to the settlement notification.           Upload and attach files to a Settlement Notification You may upload and attach files to a settlement notification. These files will be included in the emails issued when your transaction settles. As an example, you'll be able to send a real estate agent an 'Order on the Agent' pdf.   There are two ways you can upload and attach files to a settlement notification: To upload from the 'Settlement Notifications' screen: Navigate to Notifications from the left navigation menu. Click Add to create a new settlement notification or Edit to edit an existing notification. In the Attachments section, click Upload. Browse for your file. By design, the File description and Share with permission is locked to protect privacy. Click  Upload. The file is uploaded and attached to this notification and appears listed under the Attachments section. To upload from the 'Files' screen: Navigate to Files from the left navigation menu. Click Upload File. Browse for your file. For File Description, select General Files > Others. For Share with, select No one. This is important. By selecting "No one", the file is shared only with the intended recipient and no other Workspace participant. Click Upload. Overview Last updated: 11 October 2021 Jurisdiction: NSW Additional Resources: Help Card     PEXA now supports the ability to process a Part Tenancy Transfer for properties in NSW. A Part Tenancy Transfer is used where there is a change in tenancy where at least one Proprietor on Title is remaining on title. The transacting Proprietor on Title (transferor): Is in a Tenant in Common, Joint Tenancy or Sole Proprietor ownership, and Is transferring their ownership (part or whole) to: An Incoming Proprietor currently not on title, or A Proprietor on Title who is already on title. Note: Transfers where a Proprietor on title will be listed on titles multiple times is currently out of scope Where a Proprietor on Title who will remain on title requires a name justification, a change of name must be completed and registered outside of PEXA prior to lodging the Part Tenancy Transfer If you're representing the Proprietor on Title, you only need to represent your transacting client. Otherwise please see the following link for a NSW transfer representing the Proprietor on Title.   What Party and what role should I represent in a NSW Part Tenancy Only Proprietors on Title whose share is changing are required to be represented in a transaction An Incoming Proprietor role should only be added to the Workspace where the party is NEW to the title Use this handy table as a reference guide:   Is the Part Tenancy Transaction in Scope? Find out if your Transaction is in Scope by completing the Scope tool: More information can also be found on the Land Registry Services page, Schedule of eDealings.   Steps Create a Workspace with the role of Proprietor on Title with the following settings: Transaction type = Other Transfer > Part Tenancy Transfer Financial settlement required? = Yes Will this transaction involve a Transfer? = Yes Review the Land Title. Represent the Proprietors on Title relinquishing their share of the title: From the Actions column, select Edit Party next to the party you represent. Select I represent this party and complete the remaining details for the party. Click Save. Repeat Step 3 for any other parties that you represent. Add or represent parties acquiring a share of the title (transferees): If a Proprietor on Title is a transferee in this transaction, then represent them: From the Actions column, select Edit Party next to the party you represent. Select I represent this party. Complete the remaining details for the party and then click Save. Continue to edit other parties that you represent. If there is an incoming participant, then do one of the following: If you don't represent the Incoming Proprietor: Click Invite Participant and invite the representative into the Workspace. Wait for them to create and represent the Incoming Proprietor. If you represent the Incoming Proprietor, then navigate to Workspace Settings and add the role of Incoming Proprietor: Select Role Settings > Edit. Select Incoming Proprietor and then click Add Role. Click Save. Navigate to the Participants screen and select Create Party to represent the Incoming Proprietor. Create a Transfer document: Navigate to Documents > Create Document > Transfer. Complete the following fields on the Transfer screen: Part Tenancy Details Select Yes to Is a Proprietor on Title staying on the Title? Transferors Select the Proprietor on Title who is transferring their share. Click Add Transferor. For each Party, enter the share details. You may enter a part or a whole portion of the share in the Share being transferred column. Transferees Check the Tenancy Type. Under Party, select the transferee acquiring the share and enter their share details. Tip: Existing Proprietors on Title have the words 'Proprietor on Title' appended to their names. If required, click Add Transferee to define more transferees and their share details. Note: Only parties who are represented are selectable in the Party drop-down list. Transferee Details Please ensure that a Future Correspondence Address is added for the Transferee. This is required to progress the Transfer of Interest to a 'Prepared' status. Consideration Type Select a Consideration type and fill in the relevant fields. Transaction Information Complete the Transaction Information. Save the document. Edit the Notice of Sale: Complete the details and then click Save. View the documents: Click View for each document. Notes: Select View if no changes are required. Select Edit to update any of the details in the document. Sign the documents: From the Actions column, select Sign associated with the Transfer document. Notes: Ensure to sign the Transfer, Notice of Sale, and Lodgement Instructions. If you are representing the Proprietor on Title and Incoming Proprietor, you will need to sign the Transfer in both roles. Complete the Financial Settlement: Navigate to the Settlement screen. Add Destination and Source line items, as applicable. Select Sign > Financial Settlement Schedule. For Source Funds: From the Actions column, select Verify Funds. From the Actions column, select Authorise to authorise the Trust Account payment.
