Hi @CT @christine4711    Good news, the standalone Change of Name document in PEXA is scheduled for Release 11.1 in February next year (2020).  Initially the document was scheduled to be deployed this year but was unfortunately pushed back due to competing priorities at NSW LRS.   UPDATE - The Change of Name document will be created under the new Residual Documents Strategy, which enables LRS to build this functionality using a standard set of building blocks.  Our understanding is they will have this document ready for launch in the March April timeframe (2020).   cheers Belinda   ... Preparing for July - NSW Transition to Digital lodgment - Webinar     On 1 July 2019 all mainstream conveyancing transactions will transition online in New South Wales. The proposed scope, as per the draft conveyancing rules version 5.0, is Discharge of Mortgage, Transfer, Mortgage, Caveat, Withdrawal of Caveat and Transmission Applications.     To ensure you’re ready to transact digitally, the NSW Office of the Registrar General, Revenue NSW and PEXA will be hosting a webinar on Tuesday 4 June, 10am AEST. Hi @George1 ,   Great questions.  We have covered a few topics in this thready so just to clarify, here is the situation with each of these items:   Order on the Agent - This enhanced functionality was introduced to our platform in May 2018 - You can access this in the notifications section in the workspace Section 22 (Notification to strata bodies) - You can use PEXA to send the email notification, but the Section 22 document needs to be uploaded to the Document Hub  in order to share with other members in the workspace, and would need to be transmitted outside of PEXA to the applicable body Notice of Sale - As has been the case since we launched in NSW, the NOS is created in PEXA and transmitted to the Land registry and then forwarded overnight to council and water. cheers Belinda ... Hi @nfras000 ,   Thank you for raising this.  This is a question we receive from time to time and is a complex issue.  In it's most simplest form the answer is this can't be currently done in PEXA and would require agreement and change from our integrated partners to do so.   PEXA needs to adhere to the requirements of the Land Registries in each jurisdiction and the NECDS (National e-Conveyancing Data Standards).  Currently under this regime we are required to capture the consideration amount for a transfer transaction, render the consideration amount on the transfer document (as per the NSW Land Registry Services style sheet), and present the document for lodgement verification.  PEXA also undertakes stamping verification with Revenue NSW which also verifies the consideration amount matches that in the eDR assessment.  To make a change to this would require agreement/change from NSW LRS, Office of the Registrar General (ORG), and Revenue NSW and the corresponding changes to each of the data standards.   To move this forward, I will raise this thread with the relevant government partners and operator to understand if there is an appetite to align the paper and electronic processes and what the likely timeline might be.   cheers Belinda           ... Hi @MelissaSmede,   Revenue NSW have advised that they can confirm the ODA 073 error resolution form is indeed gone.  They will be promoting a more streamlined and user friendly approach via email or telephone.  They will also launch a new e-conveyancing page shortly too.   So on the money @TJ  - an email  or phone call 1300 208 528 to the econveyancing team at Revenue NSW would be the way to go.   cheers Belinda ... Hi Anne,   So sorry for the confusion on this topic.  I understand there was some information provided on the webinar that was not explained correctly.  I have had a chat to the team about this and clarified for further sessions.  A TAC WILL pick up a writ if it occurs in the TAC period.  It will not pick up a writ if it is already on title, and is not visible under the "Land Titles" screen in PEXA.  The Land Titles screen in PEXA is a cut down version of a title search, designed to show who is on title and if there are any caveats on title.  We expect to expand the details in this screen in coming releases.   So in short, the title activity check (TAC) will pick up a writ that is placed on title within the TAC period, at the regular intervals the TAC is run (weekly after the workspace is opened, and daily in the last week of settlement, then 1 hour before settlement).   Hope this helps to clarify.   cheers Belinda ... Hi @Emily_EJS_Law,   Up to you, but if we liken the electronic scenario to that in paper, in paper you say settlement has occurred when cheques and documents have been physically exchanged at settlement.  Those documents have not been lodged at the land registry and the cheques have not yet been banked.  But the property has settled.   If we consider the same in PEXA, the point where documents have been lodged and funds have been settled (exchanged at the Reserve Bank level), we can concur the property has settled.   Cleared funds may take minutes,hours or overnight to appear in the vendor's account (depending on the financial institution they bank with and their internal procedures), but the funds are definitely on their way to the client!   cheers Belinda ... Hi @Pmaher4,   Thank you for your interest in the new leasing functionality.  It has been designed as such to allow the annexures to be uploaded in a document and attached to the lease document created in PEXA.  Once you create the document and then upload the Annexures to the lease document, digital signing covers both the lease document and uploaded annexures.   In terms of your questions: - Which leases can be prepared in PEXA? Fair Trading leases only?    Not sure what is meant by Fair Trading leases - this functionality is to support leases that would normally be created using LRS templates in commercial settings - Can a stand alone lease be completed and registered via PEXA? Please note: although this message seeks to align PEXA statuses with the paper process, the two processes are not directly comparable and the below should be taken as a guide only.   PEXA tracks the overall status of Workspaces using the Lodgement and Settlement bars across the top of the Workspace.  Below is a list of the possible status values in a Workspace: Lodgement status   Corresponding stages in paper Settlement Status   Corresponding status in paper In preparation The period from Workspace creation including when documents are in preparation Period from pre-exchange, through to contract exchange, cooling-off, satisfaction of conditions and preparation of instruments In Preparation The period from Workspace creation including when parties have commenced preparing the Financial Settlement Schedule Period from pre-exchange through to parties calculating and exchanging settlement figures Prepared Documents have been prepared and are ready to be signed.  Stamp Duty verification and Lodgement verification are successful Buyer has signed the transfer and has sent the Transfer to the seller’s/vendor’s representative. All revenue office documents have been completed. Signed The Financial Settlement Schedule has been signed by all required parties All parties have agreed on the settlement statement. Cheques requested. Ready All documents have been digitally signed by the required parties and lodgement verification is successful Vendor has signed the transfer and each side has their settlement packet ready for settlement. Includes attendance at settlement room. Ready All aspects of the financial settlement are ready (funds verified, authorised, schedule is balanced and all required items are signed) Cheques are produced and ready for settlement Lodging Document is in the process of lodging with the Land Registry/Titles Office Following settlement, Agent/practitioner attending Land Registry/Titles Office Settling Source funds are being moved and PEXA is seeking reservation of funds for the transaction Practitioner/agent attends settlement, cheques are being handed over. Lodged The Land Registry/Titles Office has accepted the documents for lodgement Dealings have been deposited at the Land Registry/Titles Office Settled Reserve Bank settlement has occurred – the property has settled. Vendor’s representative / bank has received the cheques and the purchaser’s representative / purchaser’s bank has received the documents.   Complete The Land Registry/Titles Office has completed their examination of the documents and assigned a status Dealings have been examined by the Land Registry/Titles Office and assigned a status Disbursing Instructions are being sent to banks to disburse funds to their respective accounts Practitioner/agent attends relevant financial institutions to deposit cheques       Disbursed Financial institutions have confirmed they have the disbursement instructions and have actioned them. Cheques have been received by destination financial institutions The lodgement "complete" status is one that practitioners can find confusing.  We normally equate “complete” with dealings being “registered” or clients being “on title”.  However, the complete status means the Land Registry has completed their examination of dealings.  In fact, the Complete status could mean a variety of things, depending on your jurisdiction. “Registered, Rejected, Requisitioned, Unregistered, Unnecessary” are some of the available values in NSW.  A full list of values available in each jurisdiction can be found below. Practitioners should always check each dealing in the documents screen to ensure they have registered (where applicable).  If in doubt, contact your Land Registry to discuss the details of your matter. Please confirm your Land Registry Contact Details for your firm's PEXA subscription are up to date.  This can be checked by your Subscriber Manager in the PEXA platform. Hi @Emilytrotman,   Unfortunately we are unable to produce titles on behalf of practitioners.  This change came into play a few months ago.  However, the "no-charge" still applies for producing the title, so you would just need to pay an agent for the production.     So sorry we are unable to support this service moving forward.   cheers Belinda ... Hi @Sam22,   You can do your stamping now but you will need to pay the duty within the 3 months, through some other method.  Then when you settle in January, you will enter the stamping reference number and the verification service with Revenue NSW will show that $0 is owing for stamp duty.   cheers Belinda ... Hi @AnnH,   Yes correct.  As you are acting for the Incoming Mortgagee, you can create the consent for the land using the title the borrower has provided to you.  You will need a Client Authorisation Form between yourself and the Incoming Mortgagee.  You would not require a signed Client Authorisation Form between yourself and the borrower if you do not act for them.   I understand you are meeting with your PEXA Direct Specialist today who will talk you through how to do the Consent.   cheers Belinda ... Hi @Cathie,   I've done some investigating to get to the bottom of this issue.  An incoming mortgagee would normally create the consent in the case of a standalone mortgage or refinance.  This is partly due to the fact that a person would not be able to complete their own consent on PEXA and normally not represented by a practitioner for these types of transactions.  In this case the individual would provide the paper CT to the incoming mortgagee in order to create the consent.   On the surface, it seemed more appropriate for the practitioner representing the purchaser to consent to a mortgage being placed over the property of their client.  However in practice, this might not make sense from a banks perspective and would require a different set of processes depending on the parties involved.   So based on that, I think your bank was quite right to retain the CT and create the consent themselves.  Apologies for the differing response on this one.  I've discussed this with ORG who have come to the same conclusion also.   Happy transacting and thank you for raising such an interesting issue!   cheers Belinda   ... Hi @Cathie,   Great question!  Technically no, the incoming mortgagee does not have right to deal as they are not on title.  I would think that the more appropriate way  to do this transaction in PEXA would be for you to create the consent on behalf of the client as the client is still on title with right to deal.  Assuming bank would then place a mortgage over that title in the workspace.  Of course you will need to get the title back off the incoming mortgagee to facilitate that.   For further clarification, you might like to contact ORG such as @DavidMcDowell.   cheers Belinda ... NSW LRS Announce additional fees   NSW LRS have announced they will be charging additional lodgment fees in certain scenarios.  Where additional fees apply, the practitioner will be invoiced post settlement.  Please note: The additional fees will not be populated in PEXA or collected by PEXA.  The standard lodgment fees will still be populated in the Financial Settlement Schedule as per usual, via the Lodgment Verification Process.      The new fee arrangements can be reviewed on the NSW LRS website here.  Please take a moment to review them to ensure you and your client understand the new arrangements.   cheers  Belinda EM, Government Relations   ... @Paulapexa - might be cheaper than the wash-up of a fraud, and potentially cheaper than a requisition fee from LRS!   All jokes aside, how would you like to see the functionality work?  There are a couple of ways to skin the cat:   Have a field in PEXA to enter the PoA registration reference and have that verify as a valid reference; or Verify the reference but also verify the name matches on the PoA registered at LRS Bot of these items would take development effort on both LRS and PEXA side so I guess it's a matter of weighing up the time and cost vs the level of risk and frequency of transaction.  As we purchase the data we populate in the workspace from the land registry (which makes up a large portion of the PEXA fees), we could assume there might be a cost associated with this data element from LRS as well.   What are your thoughts? ... Hi @FelicityElias,   You may process your stamping well in advance, and in fact, at least 2 weeks prior to settlement is a good idea if you are stamping via an agent and intend to pay via the agent as well.  This is because it can take time for the agent to post the cheque to State Revenue and for State Revenue to receipt the cheque against the correct reference.  This activity has to occur before you can settle in PEXA.   If you are intending to pay via PEXA, excellent.  Once this is selected in the eDR assessment and the assessment number is linked up with the PEXA workspace, State Revenue know when the property is settling and hence when they will receive the payment via the PEXA platform.  This in turn alleviates the debt falling due in your weekly return.   So feel free to stamp as early as you like, and enter the details in the PEXA workspace.     cheers Belinda ...
