Hi @sharond1 - thanks for the question.   We have split our 'Feb Release' into two parts because it was so big. The NSW update is in part two. Unfortunately due to previously unforeseen circumstances we have had to move the date of the second release to March 16th.   So sorry - I know this has been a constantly moving target and appreciate the pent up desire for this instrument in the market. [UPDATE] The NSW Notice of Death has been delayed from the previously communicated release date of August 2019. The NSW Land Registry is working through their prioritisation of the delivery of this instrument, but do not yet have a target date.   PEXA appreciates the markets' desire for this to be available as soon as possible and will continue to work with the NSW Land Registry to deliver this instrument as soon as possible. ... Hi All, We have had a few queries around the  TLA-89A and it's inclusion in Release 9 - unfortunately this instrument will now be available early to mid 2019. Hi @Jcawood,   Customer Information Bulletin 1177 (link: https://www.propertyandlandtitles.vic.gov.au/customer-information-bulletins ) advises the T2 form will be available for a limited transitional time. This may be to allow T2s to be lodged in paper if the contract was signed before 1 July 2018.   It would be best to validate this directly with Land Use Victoria as we can't advise on paper transactions.   Cheers, Simon ... Hi Tracey, I’ve broken your questions down to help answer them J For many I have pointed you to some more generic articles that should be of assistance and answered other in line. I need to prepare a survivorship application, there is a mortgage attached which should be paid off, so a discharge of mortgage will need to be done at the same time.  Do I still need to do the bank's paperwork for the discharge (CBA) or does the PEXA discharge process take care of this? The Mortgage needs to be discharged by CBA, and this can be done either in same workspace as the Survivorship or in a separate workspace. In both scenarios CBA will need to participate to create and sign the Discharge of Mortgage. Hi @ClaireK For the Victorian Survivorship - no supporting evidence is required to be supplied to LUV when lodging via PEXA. Evidence of Death is automatically noted as a Dealing Requirement in the Lodgement Instructions, and the signing certifications state that the Certifier has retained evidence supporting the registry instrument of document.   Cheers, Simon ... @jvilar Hi Jojo, thanks for the great questions.   Please see our replies below:   Do we need to transfer Control or create a Nomination doc to lodge this application (as this is only for VIC)? Yes, a Nomination is required to lodge a Victorian Survivorship if the Participant is not the CT Controller My understanding is that these Survivorship applications can only be initiated by Solicitors, as the only role type in PEXA that can use this is ‘representing the Proprietor on Title (POT)’, and Banks/FIs cannot represent POT or IP.  Thus the FIs/banks’ involvement will be purely to give consent (via CT transfer or Nomination - subject to the answer to question #1)?  Please confirm if this is correct. A Victorian Survivorship can only be created by a Solicitor or Conveyancer who represents the surviving tenants. Therefore, if the Financial Institution (FI) is the CT Controller they will need to lodge a Nomination. Is this for both ADI and non-ADI? Yes, if the CT Controller is not the participant lodging the Victorian Survivorship, then the CT Controller will need to lodge a Nomination in the workspace or Transfer CT Control. Hi Community, PEXA’s Release 7 upgrades are primed and ready to go for November. We’re happy to announce that included in the release is a new functionality for Queensland practitioners to transact on titles that are held in capacity. What this means is that anyone acting on behalf of their vendor as Trustee or as Personal Representative will be able to transact on it using PEXA. Where the Party Capacity is Trustee, the Trust Name will also be supplied to the QLD OSR as part of the Stamp Duty Verification process. Pinnacle to delivering this change is the Department of Natural Resources and Mines, and the team at PEXA are very excited to help facilitate this upgrade to the market. Hi Shussel, thanks for the question.   The formatting of free text in the National mortgage is applied differently based on your Land Registries requirements.   Formatting is preserved in the following jurisdictions: •  New South Wales •  Queensland •  South Australia   Formatting is removed from the following jurisdictions: • Western Australia • Victoria   In relation to the jurisdiction of Victoria (per your sample), the Registrar’s preference is for any complex terms and conditions to be registered as an MCP and referenced in the National Mortgage.   Furthermore in PEXA Release 7.0 (November 2017) you will be able to scan and attach Terms and Conditions to a National Mortgage in the Jurisdictions of South Australia and New South Wales, circumventing any challenges with accommodating Terms and Conditions that extend beyond the free text 4000 character limit currently in place. ...
