We're receiving conversations from NAB regarding a "Industry Guideline" that Refinance Settlements are to settle only on a Tuesday, Wednesday or Thursday.  I haven't heard of that and can find no reference to this requirement. Can anyone enlighten me? Baz... ... View more

Hello again @Saysa I'm not getting any response from your team. The payment in question was a matter where we submitted corrective account details on 22/10. It's 25/10 and it's a sizeable sum. Hi @Saysa . How long do corrective payments stay in Processing? I've got one that settled 9/10, corrective payment raised 10/10, we didn't notice it until 15/10 (we really need a notification) so submitted the new details the same day. It's now 17/10 and the recipient is still waiting for their money which is in "Processing". Baz... ... View more

Hi Rebecca, Had a similar situation in Victoria and had to wait for the Priority Notice to expire. For Queensland you can still lodge a paper withdrawal at least. There is a form called "Withdrawal of Priority Notice Form". Cheers, Baz... ... View more

Well we just got caught out with the 1 August mandate. We refinanced a FI - one loan, two security properties (VIC and ACT). We don't consider a simultaneous PEXA and Paper Settlement to be workable. NSW exempt elodgement transactions when a non-PEXA jurisdiction is involved, but this apparently is no-longer the case in Victoria and we now need to organise a PEXA transaction to lodge the Vic documents. In the real world how are we supposed to handle simultaneous PEXA and Paper Settlements? Do we have our Settlement Agent check the paper settlement documents before the PEXA workspace is locked, then wait around until the PEXA workspace is settling? ... View more

Just to add to Christina's post. Can we clarify that a "correction" of name (e.g. christian name spelt incorrectly or middle names missing and is not the result of a titles office error), cannot be effected via a Mortgage in NSW, but can in VIC. I'm not sure about SA. Baz... ... View more

I don't believe Banks (or their representatives) can view the Transfer until it's in "Prepared" status, however TJ's suggestion of a simple screen print is a great idea. I didn't know that was available. You are right Peter, the Banks can see it for themselves. They're mainly interested in the consideration and tenancy shares. I'll be checking if that also works with Priority Notices as we can't view them when prepared by other parties and I don't quite trust other parties  - most don't even know what a Priority Notice is! I finally received an answer from PEXA Support: "Thank you for your patience with this matter. Our team has identified this to be a defect, where there is an issue with ability for the 'Applicant' role to create and lodge a Withdrawal/Extension of Priority Notice. This will be tracked under the following reference PDB-6676. We will update you on the progress of this defect. Thank you for your understanding." So I wasn't crazy after all.  ... View more

We have two Victorian matters where we hold first mortgage and there is a second mortgage. In both matters we wish to discharge the first mortgage. In the lodgement instructions we cannot direct the eCT control to the 2nd Mortgagee. We tried lodging a Nomination saying we don't want eCT control after the transaction, however we still need to complete issuing instructions (and the 2nd Mortgagee is not one of the choices). Last Monday 17 June PEXA charged the increased service fee for lodging Priority Notices of $9.13 which should take effect from Monday 1 July.  I raised an incident PTR0421951 last Tuesday but I note the issue hasn't been fixed. We lodged 3 Victorian Priority Notices last week, the last being Friday. Should be a simple fix surely. Baz....  ... View more

I'll answer my own question then . Apparently you can extend or withdraw before a Priority Notice before the workspace settles or after the workspace is completed, but not whilst the documents are of a lodged but unregistered  status. We need to withdraw the Priority Notice to allow the documents to register.   I've ended up with workspaces in both NSW and VIC with the same issue. NSW Land Registry kindly waived their requisition on the documents and registered the dealings. @BusinesServices_LUV where not so helpful so we'll wait until the Priority Notice expires next month.   It seems to me that we need to able to create and lodge the withdrawal of a Priority Notice in the same workspace at any time. @GeorgePolus  perhaps you could have someone look into this.   Cheers, Baz..... ... Just looking at this again. Does anyone know how to complete a withdrawal of a Victorian Priority Notice? The training material implies it's easy, but I can't work it out. I now have a file where we lodged the Vic Priority Notice for a simple refinance - it looks to be correct but Land Victoria say we need to withdraw it to allow the PEXA documents to register (or wait until it expires).   I can't create a Withdrawal (or any documents) in the original settled workspace, so I tried creating a new Workspace as an Applicant, however I can only create a Priority Notice and other documents, but a Withdrawal of Priority Notice is not amongst them.   Baz.....   ... Hi Christine, According to Land Victoria's information: A recorded priority notice may be withdrawn at any time before it expires by lodging a withdrawal of priority notice. A withdrawal of priority notice must be lodged using an ELN e.g. PEXA and can only be withdrawn by the subscriber who lodged the priority notice. Only subscribers who are authorised to lodge electronically in an ELN can lodge a withdrawal of priority notice.   I would expect you could create a new workspace to do this, but you're saying you can't. Hi Cam, just to let you know the CBA declined our Transfer of eCT Control. We'll ring them and find out who we need to explain the situation to.   Might be an idea to have a field as part of the eCT Transfer where you can add notes in relation to transfer, for the invited party's information. Hi Ryan, It is hidden away under Administration privileges, but probably for good reason. Took me ages to find it the first time. I do find it strange that they can be created from within workspaces, yet can't be edited only removed from the list. I would've thought only Subscriber Administrators should be able to create or remove the frequently used accounts. Baz.. p.s. something else I only just found out is if you delete an account (e.g. a double up) any line items created using that frequently used account are deleted as well. ... View more

Hi, We're still confused on the Discharge of a second Mortgage issue. We have two on the go today.   First matter is in Victoria. We're on first and CBA are on second. We are in the role of Mortgagee on Title. We're Discharging our Mortgage so that CBA becomes first Mortgagee.  CBA are currently unrepresented so we are the responsible subscriber and the eCT Control can only issue to us. Should we be inviting CBA to the workspace? p.s. we haven't been required to create/lodge a Nomination.   Second matter is in NSW. Westpac are on first and we are on second. Both are acting in the role of Mortgagee on Title. We're Discharging Westpac's Mortgage via a financial settlement so that we become first Mortgagee. The responsible subscriber is currently Westpac so they will need to complete the lodgement instructions. Is that correct and will CoRD issue to us? ... View more
