Hi @AeYco    Yes the CT controller can create workspace to Transfer the CT Control to the relevant subscriber.    The   Transfer of CT Control   document enables Financial Institutions to give control of a title or titles to their Panel Lawyers. The same document can be used by the Panel Lawyer to pass CT control back to the Financial Institution following completion of a matter. Solicitors and Conveyancers can also use the document to transfer control to other Solicitors or Conveyancers. Hi @naomib    An Application for Replacement of Certificate of Title can be completed on PEXA via other documents.    A Transmission will not be able to lodge together with the Application for Replacement of Certificate of Title as it will require a CORD Consent. In order for this to proceed on PEXA the Application for Replacement of Certificate of Title will need to be lodged first. Hi @sgs    Stamp Duty is calculated against the Consideration amount entered in the Transfer document. Thus the duty is solely dependent on the figure entered in this field. Hi @LumleyLegal    The Transfer document can be removed by selecting the arrow at the end of the document, once selected there will be an option to "Remove Document".   Please note the Transfer document can only be removed by the involved parties eg. POT and IP representatives.  ... View more

Hi @Werry    A Transmission Application by Executor, Administrator or Trustee is available to lodge via PEXA as a paper dealing.    The COVID-19 Residual Lodgement process enables paper documents to be sent through to NSW LRS via a PEXA Workspace as a document in PDF format. Hi @AlexandraV    As per design once the workspace is in lodged status changes can no longer be updated.    The documents cannot be withdrawn. Once you have relodged the correct documents to Land Registry the workspace will update to completed status.    ... View more

Hi @KerryRodwell    A new user can be created in PEXA by either a Subscriber Manager or a Subscriber Administrator. However to activate a new user the a Subscriber Manager/Administrator will require a Digital Certificate to sign and activate the user.    o Activate a New User 1. Log in to PEXA Exchange as Subscriber Manager or Subscriber Administrator. 2. Navigate to Administrator Tools > Manage Users. 3. From here, there are 2 ways to activate new users: → 3a. By creating a new user and then clicking Save and Activate. Ideal for creating and activating a single user. → 3b. By marking the checkboxes next to the PENDING user(s) you wish to activate and then clicking Sign to Activate. Ideal for activating multiple users at once. Hi @tania1    If you are transacting a standalone Discharge of Mortgage, you will not be able to issue the CT to another party without them be a transacting party to the lodgement case.   However, once the Discharge is Mortgage is registered and you hold ECT control, you can then Transfer the CT control to a nominated party. Hi @Chrissy1983    For your requisition, unfortunately Priority Notices can only be withdrawn electronically if they were created in the role of Applicant or prior to settlement. For Priority Notices lodged post settlement you will need to arrange for the Withdrawal of Priority Notice in paper directly at the Land registry as this is currently out of scope for electronic processing.     ... Hi @ShandellC123    Our understanding is that unencumbered NSW titles that are dated prior to the 1st January 2004 are required to be submitted to the NSW Land Registry to confirm their authenticity and obtain a Production Receipt number due to the absence of required security features on the title. The title will need to be produced to the Land registry along with the e-form found in the link below: http://www.nswlrs.com.au/__data/assets/pdf_file/0004/215581/E-Transaction_Production_Receipt.pdf Once produced to the Land Registry, the ‘Production Receipt’ will be attached to the Land Title allowing it to be transacted upon in PEXA. Hi @Krystal    If title is unencumbered and your office is holding ECT Control of the title would still mean the it is a clear title.    In Victoria, Converting an eCT to Paper Title, or Paper Title to eCT, cannot be done on PEXA without a transaction taking place. The good news is this can be rectified quite easily. Hi @Gibbslawyers    We cannot waive the Consent document from the PEXA Transaction, as this is a LRS requirement for ELNO.    A Consent document is an authorisation document required by the NSW Land Registry for the successful lodgement of a property transaction. It is created by the person named as the controlling party on the certificate of title. When completing a Consent in NSW you will need to select the Consenting Type, two options are available: → Transacting Party: consents that are prepared and digitally signed by or on behalf of the CoRD Holder who is a participant in a transaction. → Third Party Consents: prepared and digitally signed by or on behalf of the CoRD Holder when the CoRD Holder is not a transacting party. Hi @MG1    The Section 173 Agreement is available in "Other Documents" as a residual document. This does not fall under the generic residual document and setting up a DD with LUV is not required for the Section 173 Agreement that is available in the standard residual document. Fees will be DD from the PEXA Fee paying account.    Residual documents in PEXA are a large collection of infrequently lodged registry documents that previously had to be lodged in paper. These can include: • Acts; • Legislations; or • other document types that don't fall into any of the main categories currently available in PEXA. To address this, we’ve created a new category called Other Documents that comprises all residual documents so users can now create and lodge them via PEXA. There are no requirements to be a Subscriber Manager.   The access that a Subscriber Manager has is: Subscriber Manager Hold the highest level of access to PEXA.
