A23: The Client Authorisation ends upon the death of the Client, except in the case of South Australia (see section 59 of the Real Property Act 1886 (SA)). In South Australia, where a Client who has completed a Client Authorisation dies, an instrument which has been executed pursuant to that Client Authorisation after the Client’s death remains valid. In all other Jurisdictions, the death of a Client effectively renders the Client Authorisation invalid. This means that any instruments or Documents (whether signed prior to the death of the Client or not) cannot be used and cannot be Lodged for registration. ... View more

@RichardFrazer Thank you for your question. The process has remain unchanged in that you are still required to obtain the caveator's consent. HI @Petramunro. There has been no change to the NSW statutory requirement of payment of stamp duty within 3 months from the Contract date. If completion is after this time, to avoid interest, payment should be made manually prior to settlement. Revenue NSW has however previously advised other practitioners that once the duty assessment is done via EDR it stops interest from accruing for a period of 21 days to allow the matter time to settle and payment to reach them. Hello @MCOLAW, In relation to your query, you can clarify directly with NSW LRS - econveyancingnsw@nswlrs.com.au. I can however advise that previously they have instructed on the Priority Notice, you do not need to reference the incoming mortgage, as the mortgage will follow the transfer in registration. Often when lodging the Priority Notice the detail of the incoming mortgagee may not be known. ... View more

The limitation on the title would remain and therefore you could proceed and settle electronically. Hi @Ritz   You are able to continue to have an agent complete the duty assessment, but then remit payment via the PEXA workspace.   Still ensure that the payment will be made within the required Revenue NSW time frame.   When forwarding your documents for assessment, add a screen shot of the 'stamp duty' screen. Hi @Christine58. Please check in the workspace if the land title data is showing. It may be because when the workspace was created the question regarding the land title data was changed. Thanks @PetaStewart. Great feedback. I can see that some further calculation fields are essential as you mentioned. An initial suggestion, if you use the additional fee/allowance as the adjustment description the date fields are removed. You can then insert the required amount under the vendor or purchaser column. Also, you should be able to ctrl p or right click on mouse to print the page. ... View more
