Hi Sarah, Thanks for the additional information.  I've checked with Rural Finance and they have advised that this transaction will not be able to proceed electronically as these types of mortgages now sit with the Rural Assistance Commission who as you mentioned is not a PEXA subscriber.   You will need to use the exceptions cover form to lodge this in paper. You can download it from Land Use Victoria -scroll down to select Request to accept paper lodgement.   Let me know if you encounter any further issues with this. Thanks, Cate     ... View more

Hi Barry, In the exceptions coversheet, there is an option to select "Transfer linked to Refinance transaction for simultaneous settlement and a party to the transfer unable to use PEXA". Hi Ann, Your understanding is correct.  Just to further add, the below execution clause appears on the Mortgage and Cord Holder Consent documents and outlines specifically what you are certifying. Mortgage: The Certifier, or the Certifier is reasonably satisfied that the mortgagee it represents,: (a) has taken reasonable steps to verify the identity of the mortgagor; and (b) holds a mortgage granted by the mortgagor on the same terms as this Registry Instrument or Document. The Certifier has taken reasonable steps to ensure that this Registry Instrument or Document is correct and compliant with relevant legislation and any Prescribed Requirement. The Certifier has retained the evidence supporting this Registry Instrument or Document. The Certifier holds a properly completed Client Authorisation for the Conveyancing Transaction including this Registry Instrument or Document. The Certifier has taken reasonable steps to verify the identity of the mortgagee.   Cord Holder Consent: I certify that: 1. The Certifier has taken reasonable steps to ensure that this Registry Instrument or Document is correct and compliant with relevant legislation and any Prescribed Requirement. 2. Hi Caroline, The mortgage memorandums can be lodged and registered with the land registries who will provide you with an associated Memorandum ID number.  You can then enter the ID number upon creation of the mortgage document in PEXA.  This code replaces the need to attach the 30 page document. Hi @BGoodwin, That'a a great question. You are correct, a CAF is all that you require to put through a standalone discharge of mortgage. There are numerous benefits of subscribing though, such as visibility in the network and the ability to receive refinance and transfer invites. For a panel solicitor such as yourself, having your clients on the network allows for a simpler process when creating Mortgage documents by ensuring their mortgage reference data has been hard coded into the system and that their company details are prepopulated for you.
