Thank you TJ, so the process has not changed i.e. PEXA does not allow us or have a function to transfer an Ect to a PCT? The only option still then is to lodge the application at the Land Titles Office? Regards ... View more

Transfer control of Vic Title to an individual aft...

Hi, I work within a Financial Institution and a common request we have is to register a discharge of mortgage after the customer has repaid their loans. If we request an ECT even though the customer has no debts with us anymore we're still the controller of the title. Therefore any future transactions on the title we need to provide consent via a nomination. Is there any method we could utilise to transfer control of the Victorian title to the customer who is registered on title? Unfortunately the only way around this we've found is to request paper titles to be issued, that we then hand to the customer. Hi Ames, Yes there is only one mortgage. I’ve two separate workspaces, one workspace with 2 titles and the other workspace with 3 titles. All titles are in the same customers name. I set up two separate workspaces because they’re relate to different properties. I am at a real loss on this one, really appreciate any assistance Kind regards ... View more

Hi, I work within a Bank and in the past when we could not meet settlement quite often the response from the customers legal representative was, "where do I send my claim for costs and penalties".   I've noticed a few more outages involving the PEXA system. In the future if there is a PEXA outage and it affects the settlement can we direct the customers legal representative to claim costs, penalties etc from PEXA? ... View more

I workin within a Settlement Team of one of the big 4 banks.   I am not sure how many times I've had Solicitors phone to advise that their colleague that was handling the settlement file originally is not in today. They call our office and we then need to advise that yes the Settlement has been booked and go though again all the details of the of the settlement arrangements.    This would be easy to corrected if Solicitors or Conveyancing Agents in the same firm conversed with each other. Is this improper delegation?   In Victoria when a purchase settlement occurs we do not receive a stamped tranfser. The bank needs to collect additional documents at settlement to have the transfer stamped after settlement. We receive calls from our Settlement Agents advising the documents are either missing or not completed correctly at settlement. So the settlement can proceed and the customers don't need to sleep on the streets, we then accept an undertaking that the corrected or missing documents will be supplied after settlement. This leaves the bank open to greater risks and additional costs.   In Victoria if Solicitors or Conveyancing Agents can not supply a stamped transfer  Is this improper delegation? ... View more
