Hi Cathy,   Further to what Chanel has mentioned above, if you haven't already, please review this guide on how to lodge a s104 Generic Residual Document.   Generally only one party will lodge the s104 as it is a paper lodgement, similar to the party who would lodge and pay registration fees, likely the purchaser or Incoming Mortgagee.   Regarding financial settlement, please confirm if the banks involved are willing to complete a financial settlement for a s104 Lodgement, we do not recommend completing financial settlement for a transfer workspace due to the following:   1. Any Stamp Duty owing, must be paid prior to lodging the s104. 2. Hi @stephec0 and @cstewart    Thanks for the suggestion regarding the Lodgement Summary from the Victorian Land Registry.   Currently the Land Registry have an automated process in place to batch print and mail the Lodgement Summary for "usual" PEXA lodgements. Hi Cheryl, @Chezza    Good question, it appears as though your transaction is not eligible for electronic lodgement as you are only transferring part of the title. If so, you will have to settle your matter in paper, this would include exchange of funds, docs (transfer, mortgage etc) outside of PEXA. This also includes completing your stamp duty assessment and payment prior to lodgement.   Effectively you will go through a complete paper settlement process: - Financially settle in paper - CT Controller will nominate the eCT to a paper instrument - Stamp the paper transfer and pay any duty required - The lodging party (likely the incoming mortgagee here) will collect all the docs and instead of handing them over at the Land Registry counter, they will put all paper instruments into a PDF with a Request to Accept Paper Lodgement form, and Lodgement Summary Form (and any other required docs), then attach the PDF to the s104 Generic Residual Document and lodge via PEXA.   Hope that helps Jonathan   ... Hi @JackCave    Thanks for the question, good to get it cleared up here.   1. Yes, this functionality is available now, I would speak to your PEXA Account Manager to ensure you have the residual documents switched on   2. As you are representing a financial institution you are restricted to only representing yourself in a workspace. If you create an individual party (ie John Smith) you will be unable to input a DOB as you do not represent this party. For this generic residual document you could always be representing Bankwest, that would not be an issue as the attached documents would be the actual lodgement at the Land Registry, not the information you have input into PEXA for this document.   Hope that helps   ... Currently in Victoria, more than 99% of dealings are able to be lodged electronically – but there are some exceptions (e.g. folios ineligible for electronic lodgement, NICO transfer, MCP) where paper lodgement is still required. Due to the current restrictions in place as a result of COVID-19 (Coronavirus), to support Victorian members, Land Use Victoria and PEXA have worked together to build a solution to facilitate lodgement of scanned paper dealings via PEXA. This is in lieu of submitting documents outside of electronic scope for physical lodgement at the Victorian Land Registry.   It’s important to note that while PEXA delivers the document(s) to the Land Registry, it has no involvement in the lodgement process as part of this solution. This remains the responsibility of the Land Registry and is subject to its criteria. Provided the dealing meets the eligibility criteria, it will be assessed in line with the standard lodging criteria and timeframe for that intended transaction/dealing.   Functionality overview All Victorian paper lodgements will be able to be lodged through the PEXA platform using one residual document: RECORD – NOTICE – Transfer of Land Act – Section 104. Land Use Victoria will manually examine the lodgement and bill the relevant party outside the PEXA process. A financial settlement may also be orchestrated. All dutiable transfers must still obtain an assessment of duty from the SRO, post settlement as per the normal paper settlement practice. The lodgement in PEXA must not occur unless the transaction is finalised (or paid for manual assessments) in DOL. The Subscriber can then use this residual document to submit their documents to VLRS. More information on how to complete this residual document, including screenshots, can be found below.   Eligibility Criteria (From Customer Information Bulletin 200) To lodge this transaction type you must meet the eligibility criteria outlined below:  Be a subscriber to PEXA with an active PEXA enabled LUV customer code. Have a LUV customer code (same code as above) which is Direct Debit enabled and have selected ‘Direct Debit’ as the payment option. How to setup direct debit with LUV:       1. Navigate to https://www.land.vic.gov.au/land-registration/for-professionals/lodging-in-paper Scrol down to How to pay Click the link 'Direct Debit request form' Complete the form and email it to advice.enquiries@victorianlrs.com.au   Have an attached scanned transaction that is eligible for paper-based lodgement (see https://www.propertyandlandtitles.vic.gov.au/forms-guides-and-fees/electronic-lodgment/key-documentation ) [For example, if the attachment contains a dealing that could be normally lodged through PEXA (for example a mortgage or a transfer without a valid exception), then it would not be considered as a dealing valid to be lodged through this process]. Note: Memorandum of Common Provisions and paper based administrative notices can be accepted through this process. To produce a readable copy, the quality of attached documents is critical. Dealings or instruments of poor quality will not be accepted. Have attached a ‘ Request to accept paper lodgement’ form available at here for any mandated Instruments that must otherwise be lodged electronically using an Electronic Lodgement Network (ELN). Have attached a Lodging Summary Form (please find it under the Lodging at Land Use Victoria > Lodging Requirements tab) . It is important to complete this form to confirm lodgement order, reconcile fees and include a contact email address for correspondence.  The single applicant in the generic dealing must be a transacting party of the attached paper transactions represented by the lodging subscriber. The controlling party of the Certificate of Title must choose to receive an Electronic Certificate of Title If the dealing does not meet the above criteria, then it will be refused lodgement and the subscriber will receive a notice setting out the reason for refusal.   FAQs How much will this lodgement cost? The PEXA fees are $42.79 or $57.20 (with financial settlement) and while the lodgement fee for the dealing carrying the attachment (the TLA Section 104 doc) will be $0.00, lodgement fees for the actual scanned dealing(s) will be calculated based upon the scanned dealings in the attachments, then billed (and collected via Direct Debit) directly by LUV outside of the PEXA workspace. How do I pay the LUV fees? Via direct debit. Ensure your LUV customer code attached to your PEXA registration is enabled for Direct Debit with LUV. You can find your LUV customer code in the lodgement instructions for this document. Ensure this is setup prior to lodging the Section 104 document. Can I complete Water lodgements? No, Water Act Lodgements cannot currently be lodged via the 104 Who can lodge this document? Typically, the lodging party will lodge via PEXA or any party to the lodgement that participants are comfortable with to lodge the documents. Can I settle financially in the same workspace? Yes, unless a dealing set is dutiable.  All dutiable transfers must still obtain an assessment of duty from the SRO, post settlement as per the normal paper settlement practice. The lodgement in PEXA must not occur unless the transaction is finalised (or paid for manual assessments) in DOL. We recommend that you do not settle financially in the workspace when lodging a transfer. Will this document register automatically? No, if the Generic dealing meets the eligibility criteria the transaction will be assessed via the normal lodging criteria for that intended transaction/dealing. The document status within PEXA will show ‘Withdrawn’, the lodging party can then expect to receive a lodgement summary from Land Use Victoria within 2 business days to the email address noted within your attached lodgement. My lodgement was refused. What does this mean for my fee and re-lodgement? While PEXA transmits the document(s) to the Land Registry, it has no involvement in the lodgement process. This remains the responsibility of the Land Registry and its criteria. The PEXA fee charged covers the delivery of the document(s). If lodgement is refused, the fee will not be refunded as PEXA has completed its delivery of the document(s). Re-submission of document(s) requires errors to be amended in preparation and another transmission from PEXA to the Land Registry, which will incur the set PEXA fee for delivery.   Before lodging this document ensure: 1. You have a direct debit setup with Land Use Victoria, this is separate to your PEXA direct debit. (See above for instructions) 2. If the title(s) you are transacting on require a nomination, ensure you have nominated your title(s) to 'paper instrument' prior to lodging the s104. (Instructions below) 3. Attached PDF to the s104 is not ‘security protected’.    Create a RECORD – NOTICE – Transfer of Land Act – Section 104   Create a Workspace with the following settings: To Deal with an Interest; or Incoming Mortgagee (for financial institutions)                                                        ***IMPORTANT***  You must open the workspace using only ONE of  the below two titles: 12207/425 must be used for any instrument type that can be lodged electronically using SPEAR, including plans of subdivision, other plans under the Subdivision Act 1988 and other applications that involve a plan of survey. For more eligible instrument types, please refer to their website (https://www.spear.land.vic.gov.au/spear/pages/about/what-is-spear/spear-dealing-types.shtml) 12198/325 must be used for all other instrument types.   Financial Settlement required? Parties will require a DOB and Address if individual or ABN/ACN and address if organisation Create RECORD – NOTICE – Transfer of Land Act – Section 104 Residual Document. Navigate to the Document screen. Select Create Document > Other Documents. Start typing the name of the document (e.g. Section 104) Select RECORD – NOTICE – Transfer of Land Act – Section 104 from the list and click Proceed. Select the extent of land as ‘Whole’ Select your party as the Applicant Additional Information – the lodging party must make the following certification and enter: The certifier certifies that the copy instrument submitted is a true copy of the original. Complete the form and Save it when you're done. Upload and Attach File to the document. Please ensure: The complete paper lodgement is in one PDF (Max size of attachment 100MB) The attached PDF is not ‘security protected’.  Attach file as: Supporting Document How to Upload and attach your paper lodgement file: Navigate to the Files screen. Click Upload File and select the file you'd like to upload. Click Upload when done. On the Files screen, from the Actions column, select Attach next to the file you want to attach to the instrument. Click Attach. Edit the Lodgement Instructions: From the Actions column, select Edit next to the Lodgement Instructions. Check the details and then click Save. View, Sign, and Lodge the documents: We recommend that you view the documents before you sign and submit it for lodgement.   Electronic Certificate of Titles If a nomination is required for your lodgement and the title(s) is an eCT, please lodge this in a separate workspace, exactly how you would do it when lodging in paper previously. If the title is a pCT, you will need to convert the title to an eCT by emailing the Application to convert a paper Certificate of Title to an electronic Certificate of Title CPCT  form on the LUV website to advice.enquiries@victorianlrs.com.au. Once the title is converted to an eCT you can nominate it to the paper lodgement via PEXA also in a separate workspace. After your lodgement is received and the document status within PEXA will show ‘withdrawn’, expect the lodgement summary from Land Victoria within 2 business days. Hi @clare_de_kok    Usually a caveat will register within a few minutes of lodging via PEXA in Victoria. Your caveat may be going through a manual assessment, I would recommend calling the Victorian Land Registry and quote the dealing number on your caveat to find out why it has not registered.   If you are not sure where to find the dealing number on your caveat, please watch this video.   ... Hi @cstewart    Here is the response from LUV on this topic:   In relation to the General Law Conversion (s 14), most of these have been given a folio reference pursuant to a Registrar’s conversion under section 23 of the TLA.  So, they can be dealt with in PEXA to complete the exercise. There are about 1,000 parcels which have not been attributed a folio reference.  These are mainly roads, slips and slivers.   If you do not have a folio reference for the parcel you are trying to convert you will have to lodge a paper dealing. ... Hello Community,   Victoria continues to lead the way in the transition to 100% digital conveyancing. Hi @tania1    To invite other parties into your caveator on title workspace you will need to setup your workspace with a financial settlement. In your scenario, best to invite the other party as a proprietor on title, you can prepare your withdrawal of caveat and input destination funds owing to you in the settlement page. Hi Tania,   Yes this is possible, think of it like setting up a meeting time between you and the party paying for the withdrawal of caveat, your side would bring a signed withdrawal of caveat and the other party would provide you with a cheque, it works very similarly in a PEXA workspace.   You can invite the party providing the funds in another applicable role ie Proprietor on Title, they do not need to represent a party in the workspace as they are not lodging any documents, only providing funds for removal of the caveat. You will need to set a settlement date in the workspace to enable a financial settlement to take place. You can input your payment direction into the destinations, the other party can then bring in source funds. As long as all documents and financials are signed off by the relevant parties and the destination and source funds are balanced your lodgement of the withdrawal of caveat and financial settlement will occur at the designated settlement time.   If you need any assistance setting this matter up please contact our support center.   Cheers Jonathan  ... From 1 August 2019, Land Use Victoria begins its final chapter of its transition to 100% digital, when all remaining Victorian property transactions move online. As part of this transition, the State Revenue Office (SRO) of Victoria is delivering its Duties Online (DOL) solution to allow transfers requiring complex assessments to be settled and completed electronically. Therefore, as of 17 June 2019 you can retrieve and claim your transaction for complex assessment in Duties Online, ensuring you lodge the assessment request at least 30 calendar days prior to settlement. Once an assessment is submitted in DOL and identified as complex, the earliest possible settlement date will be returned from the SRO (30 calendar days from lodging with the SRO). The SRO has supplied a full list of complex assessments and is hosting multiple webinars in the lead up to 17 June. View a recording or register for an upcoming webinar here.   From 17 June 2019, we recommend lodging all duties transactions with the SRO 30 calendar days prior to settlement, whether it’s a simple/non-complex or complex assessment, to avoid any possibility of the settlement date shifting beyond the intended settlement date. A duties transaction, lodged with the SRO, containing supporting documents that requires manual examination is considered complex. What are simple/non-complex assessments? Simple/non-complex assessments are those that do not require manual examination. The vast majority (approximately 90%) of duties transactions are completed instantaneously via DOL. What happens if I do not lodge a complex assessment with the SRO 30 calendar days before settlement? Your settlement will be pushed back automatically to meet the 30 day requirement. Where will I see the settlement date returned by SRO? The settlement date returned by the SRO will be viewable on your Workspace’s Stamp Duty screen. Will the settlement date provided by the SRO populate automatically into my PEXA Workspace? - The SRO will only move the settlement date if the initial date is set within 30 days of submitting the assessment. If the settlement date is greater than 30 days, the date will remain as is. - If you do not have a settlement date applied to your Workspace, you must then input the settlement date provided by the SRO as normal. The settlement date provided by the SRO is viewable on your Workspace’s Stamp Duty screen. Can I manually change the settlement date submitted by SRO? The PEXA platform will not allow you to manually change the settlement date provided by the SRO. However, if for some reason the transaction rolls-over and does not settle on the predetermined date, there is a grace period of three business days. If the transaction does not settle within these three business days, a new assessment will be required, and an additional 30 calendar days will be added to the transaction.   If you want to settle on an earlier date than the one provided by the SRO you will need to request an escalation (see "What is the process for escalating a complex assessment?"). For an escalated assessment you can chose a date between the new earliest settlement date and the settlement date used when you submitted the assessment. Whose responsibility is it to manage the duty assessment? One Participant will take responsibility of the assessment i.e. a Participant representing one or more incoming (purchaser) parties in the Workspace.   In the case of an on-sale workspace (where there are multiple transfers in the same lodgement case) the final purchaser is responsible for submitting the lodgement case assessment in DOL, which includes all transfers in the workspace. Please note the final purchaser will require the Digital Duty Form ID for each transfer.  When should I claim a simple/non-complex duties with the SRO? We recommend lodging/claiming with the SRO 30 calendar days prior to settlement whether it’s a simple/non-complex or complex assessment to avoid any possibility of settlement date shifting beyond the intended settlement date. When should I submit complex lodgements with the SRO? You must submit all complex lodgements with the SRO at least 30 calendar days prior to settlement to avoid any possibility of settlement date shifting beyond the intended settlement date. What is the process for escalating a complex assessment? Hi Community,   Very excited to announce the Victorian State Revenue Office updates to the Land Tax Clearance Certificates. You can now pay the tax listed on land tax clearance certificates by credit card or BPAY. This continues the move to convenient, online payment options. From 27 March 2019 you will also be able to pay the tax listed on land tax clearance certificates via PEXA. To do this: 1. Navigate to your Financial Settlement Schedule 2. In the Destination Funds Details section, select Land Tax Clearance Certificate Liability Payment from the dropdown (this will allow both the proprietor on title and incoming proprietor to see the BPAY reference in the FSS) 3. Select an Associated Subscriber (your counterpart in the workspace) 4. Enter the biller reference number located in the Payment Options section of your clearance certificate 5. Enter the amount you are paying and select Save * Please ensure that the BPAY Reference Number is correct as provided by State Revenue Office Victoria. Hi @JudyHoward    You're correct!   The PEXA fees will calculate once the document has gone through Lodgement Verification and has 'Successful' in the verification box.   Please note, if you have multiple documents in the workspace and some have not gone through Lodgement Verification then you will only see the fees associated with the 'Successful' document. ... Hi @Weston3130   You should include the GST in the gross consideration in the transfer in PEXA for Victorian matters so that you pay the correct lodgement fees associated with the property.   As an example, let's say a property sells for $500,000 and there is $50,000 GST owing. Hi Louise, the purchaser's DOB should be appearing on the exiting NoA. Please direct message me your workspace details if this is not showing on your latest NoA.   We are working on a solution regarding sending the NoA direct to council and water authorities.
