I'll add to the call for change here.  We had to withdraw a Priority Notice at settlement (due to our error), so the fees for that were a line item fee in destinations funds.  For us to put those funds in from trust was technically a breach of our trust account obligations as the trust funds we held were not for that purpose.   There has to be a better way.   ... Choose the middle option - Received by self assessor before electronic lodgement network settlement.   If the money for duty is coming from settlement, in the destination funds select Other (BPay) and enter the BPay details for duty payment from the OSR Summary or OSR Confirmation. ... View more

I queried the Qld Titles Office regarding this issue and in particular the inclusion of "[registered]" in item 6 of Schedule 8 of the current Queensland Participation Rules.  My conclusion from the response (of 29/6/2020) which I will paste below is that it does not need to be registered.   Email: titlesinfo@qld.gov.au Telephone: 1300 255 750 GPO Box 1401, Brisbane QLD 4001 ______________________________                 Ref: 9731163     Dear Mr Morgan   I refer to your email of 23 June 2020 seeking clarification as to the square brackets around the word ‘registered’ in item 6 of Schedule 8 of the current Queensland Participation Rules.   It is the understanding of this office that the square brackets signify that the Power of Attorney, from which the Identity Verifier must confirm the details of the Attorney and the Donor, may or may not be registered given the particular circumstances of the Conveyancing Transaction. Before we did our first transfer settlement in PEXA we implemented into our precedents the Client Authorisation Form for every matter (as well as ARNECC compliant VOI).  This proved gold for us.  If there is an opportunity for a PEXA settlement we always have the VOI and CAF in place.  I don't recall ever having any client resistance to the CAF. ... Queensland firms who have embraced electronic settlements may well be frustrated by the dual paper/electronic systems and the lack of a mandate for settlements to be electronic as is the case in other jurisdictions.  I have recently written to various Queensland politicians and officials asking for a temporary mandate during the public health crisis.  Given that there are service providers available for firms which are not registered for PEXA that seemed achievable.   Even more so given that the Registrar closed for physical lodgements creating a problem for anyone who has to do a "lodgement in conjunction".  Attached is the correspondence and reply from the Registrar of Titles.   I heard the Registrar of Titles speak on person on this issue at a conveyancing conference last year and formed the opinion that the reason for a lack of mandate is the absence of the competitive market which would be achieved by a second ELNO.  I understood from the Registrar's comments that she was influenced in this position by the advocacy of the Property Law Committee of the QLS.  The written response which I have just received now from the Registrar of Titles again alludes to the issue of multiple ELNO's and confirms my understanding.   If that is the position of the Registrar of Titles it does not hold water.  If her interests are consumers, then efficiency gains of electronic settlements could be passed on to consumers with lower registry fees for lodgements by electronic settlements.  Nor can I see that her actions are consistent with concerns for practitioners whom on my observations fall almost exclusively into two categories - those who are settling electronically and want a mandate and those who are not interested in electronic settlements regardless of who the ELNO is or how many ELNO's there are.  The only plausible explanation that I can think of is that she is protecting the interests of a future ELNO.  I would be very interested to know if that is within her remit.   If you are a Qld PEXA member and keen for a mandate (everyone who I speak to at PEXA events seems to fall in this category) ....   Every single one of us needs to raise with the QLS that if they are not representing us unless they are advocating for a mandate.   And if that fails the next QLS Council elections are 2021 and it would be good to see some candidates who make it a policy platform to advocate for a mandate.   Finally, if you are passionate about this issue - share it with this forum. ... Sonia, if you go digging, you can see that the transferor information has not been completed, but I think what is needed here is a pop up in PEXA Exchange when you hit Enter Duty Information which says something like:  "Warning,  Transferor information has not been completed, do  you want to proceed?". ... By interstate settlements I mean a party who is for example selling in Victoria and buying in Qld and wants both to happen same day.   My understand is that interstate settlements can't be linked.  It would also seem that the PEXA Source account is not suitable for transferring money between interstate settlements.  Is there any better way to manage this than to have the Vic money go to our law practice trust account and then use that for source funds? ... It seems that the incoming mortgagee name is populated to the priority notice from the incoming mortgagee participant is not always the mortgagee name which will appear on the mortgage, and that solicitors for the incoming proprietor need to be alert and at times manually edit the incoming mortgagee on the priority notice.   Can I flag this as something that would be good to improve on the platform.  It should be down to the incoming mortgagee participant to provide the correct name for the priority notice and that data be pulled through to the priority notice when the solicitor for the incoming proprietor prepares the priority notice. ... Thanks Morvanna, that agrees with my own inquiries with the Titles Registry and answers a question that is otherwise not immediately apparent.   The Subscriber Representative must satisfy themselves of the capacity of the client agent to act as agent for the client under the power of attorney. Conduct VOI on the client agent. Client Authorisation to be given by the client agent. No requirement for the power of attorney to be registered. Even though not a requirement, for an incoming proprietor I would also like to see some identity documents for the client (in addition to VOI of the client agent) to make sure that the names being registered are the legal name of the client. ... I have searched Community high and low and can't find documentation which explains the categories for Destination Funds.  The details for some categories are visible to the other party, and for others not.  BPay is available on some categories, but not for others.  Can anyone assist with comprehensive reference documentation on the destination categories? ... Liz Dann, Registrar of Titles and Registrar of Water Allocations made comments at a recent QLS Conveyancing Conference regarding a roadmap for electronic settlements.  If I understood her comments correctly, a roadmap is not on the agenda because it is not supported by QLS for reasons around multiple ELNO's and interoperability.  I have taken the time to email policy@qls.com.au attention the Property and Development Law Committee to express that if that is the QLS position then it does not represent this member who would like to see a roadmap so that the efficiency gains of electronic settlements can be realised.     ... Testing digital certificates

I would like to see a feature to be able to test a digital certificate.  There is a tool which checks if the software is installed correctly.  In almost every situation where I have had to manage digital certificate issues, this test is passed okay and the issue is something else.   I had a new user where we spent hours trying to crack "There is no digital certificate" when trying to sign to discover there was a middle name missing in the profile.  Of course, this all happens when we have a settlement looming.   It would be helpful if there was a test in the platform that requires digital signing that could be used ... well ...for exactly that purpose.  To test digital certificates and make sure they are all good and problems resolved, PIN works fine, etc before the user is engaged to digitally sign a live transaction - more often than not under some pressure regarding time constraints. ... At present, a subscriber manager can't tell from a user profile whether or not the user has a digital certificate, or the expiry date of the digital certificate.  At present, this information has to be manually requested from PEXA support.  I think it would be a helpful feature for subscriber managers to be able to see in the user profile whether or not a user has a digital certificate and the expiry date of the certificate. ... You can act for both buyer and seller in PEXA by adding additional roles.  However, you can't assign one workgroup to one role and a different workgroup to the other role.  There is a single point for configuration of email notifications which is global across both roles.  Also, there is a single Conversations section and conversations are not separated for the two roles.  The result is that any other Chinese wall is defeated by notifications and conversations being globally visible to both sides.  I would like to see the platform so that conversations are not global for a workspace but are separated for each role within the workspace, and likewise for email notifications. ... When representing both a buyer and a seller, the platform links to a single Workgroup.  If we have different people (in different Workgroups) looking after the buyer and the seller then the platform does not allow us to allocate the buyer side to one Workgroup and the seller side to the other Workgroup.  Could this please be considered as a feature for future releases. ... The VOI standard allows Australian passports which are expired (within two years).  It seems Australia Post does not accept expired passports.  Apparently ZIP ID do accept expired passports.  Also, Australia Post do not witness the signing of the PEXA client authorisation and ZIP ID apparently do. ... When we use PEXA to lodge a priority notice only (no financial settlement) we need to obtain a copy of the lodged priority notice and a copy of the lodgement details.   At the moment, we click on the gears beside the priority notice, and View, and then in our browser right click to print (to Adobe PDF).  It would help if you could eliminate a few of those steps and when we click on the gears there could be a “View as PDF” function.   To get the lodgement details, we click on the arrow to the left of the document type and that reveals lodgement details.  The only way we can get a copy of that is to take a screen dump.  It would help if when we click on the gears beside the priority notice if the “View as PDF” function proposed above also included as a second page the lodgement details. ...
