We are acting for the vendor whose name on the title has no middle name but the bank's records has his middle name.   Do we need to execute a Change of Name and lodge at LRS, or we can just use the name on the Title Search when transacting in PEXA and when completing the Discharge Authority. ... Deadline to sign off

Just wondering why some banks give us a cut off time to sign off when in fact they delay signing off until the last hour of settlement.  Is this right?   We have a settlement at 12:00 noon and this bank wants everything ready by 10am otherwise they cannot guarantee that an officer will be available to sign off after this time. ... We act for a purchaser on a matter that has been re-booked for the 15th time as Mortgagee on Title (NAB) has been "working on the matter which involves a partial discharge".   My question:  Is it normal for a bank to work on the file for almost one month on a partial discharge? What else can we do if the vendor's representative does not respond to conversations and email request if they agree to our adjustments.  We need their response so we can provide the funds required to settle.  It is very frustrating as we also need to advise our client of the amount for the shortfall so they can make a deposit to their account. ... Just to give you an update, this will have to settle on paper instead as the middle name  "111" could not settle in PEXA.    I still believe that problems may arise on registration but since the bank insists on using this name in all the document, we need to adhere for the sake of our clients. ... I need help!!   We have a settlement at 12:00 pm today and until now we are still waiting for the bank to sign off because of the issue on the name of the purchasers.   Name has 111 as middle name.  PEXA shows it is an invalid name so we made it III which is actually the correct one, and all documents were accepted by LRS.    However bank won't sign off in spite of sending Stat Dec of one and the same person and copies of names with III not 111.   Client is still hoping that it will settle because he has already notified his landlord and have arranged for a removalist.   Who else can help.  Bank asks us to ring PEXA Support and the team agrees that problem has been resolved with regards to the name by putting III instead of 111.   Bank suggested client to legally change his name first before they can re-do mortgage documents.  This will take days and client will be paying penalty interest. ... I am still confused about this task.    When can you confidently confirm that this has been done?    Whenever I see this task (whether I am acting for the vendor or the purchaser),  I try to complete this and once done, this task does not go away.  Who is supposed to do this, the vendor or the purchaser?  Do i just ignore this task once I have acted on it? ... Yes, we are now in the same situation.   We opened a workspace and invited the Mortgagee in Title's solicitors but had to eventually withdraw from the workspace when everything became complicated because of the conflicting advice so we all agreed to settle outside of PEXA.    We paid all fees through bank transfer but until now (after more than one week from payment of fees), the Discharge has not been lodged nor registered. ... Our firm does the adjustment sheet through LEAP Conveyancer, then enter the details of the water usage.  We call it "additional charge" and not "water usage". ... View more

Dear DMc   PEXA hotline confirms that once funds are deposited into the PEXA account,  we will just wait until settlement happens (earlier or later) and no need to request for a refund as funds will still be used to complete the transactions.    I made sure that the amount deposited is slightly more than what is required and a destination line item in favour of the client will be created for the surplus. ... I found out that you need to create a work space first before going to LRS for a production receipt.  In this case, you need to do an "Information re-supply" via the action cog in the Land Titles tab, then check PR details are updated under the CT details. ... View more

Based on my experience, I was acting for the POT for a 3:00 pm settlement and the OM waited until 4:30pm to enter the vendor's funds, which I could have done if I was allowed to do since  I knew the exact figures to balance.  Countless conversations were unanswered until I totally gave up.  The time spent on checking whether they have entered the figures ate up all my time for my other matters.   Is there any other way to oblige these banks to adhere to the time limit?  Or we, as practitioners, just have to accept and wait for their mercy? ... I understand from the previous comment that we should call OSR if we get an error during stamp duty verification.  I do not have a current issue at the moment but I want to know what happens after you ring/email the OSR (for those who already did) if we don't need an Error Resolution Form.  I have a few unregistered matters that have been previously stamped but will need to be verified soon. ... Hi Bianca   I was reading your response stating that council, water, etc (third party beneficiaries) can be entered by either the vendor or purchaser representative.    However, if I am acting for the purchaser I will not be able to enter a vendor's destination (council rate payable)  as there is no "Add" option for me.    So I will have to wait for the vendor representative to enter the destination line item and send a conversation in case I do not agree to their entry so they can amend.  Is this correct?    ... Hi Karen   Correct,  but once you enter the OSR reference, verification will be unsuccessful and you will get an error, so you will need to complete an Error Resolution Form and email it to OSR so they can update the lot and plan number details.  The OSR will email you once they have acted on your request.  You can then verify stamp duty successfully.   ...
