If you are acting for a vendor and a caveat from a third party needs to be withdrawn from the title at settlement but the caveator is not legally represented how is this dealt with in  Vic and NSW please?  In Vic does this mean you have to do a paper dealing?  In NSW however,  this  scenario does not seem to be an exception listed in the NSW LRS Lodgement Rules Exceptions List  Thanks Angela  ... Can I please ask about this scenario:   1. Assume there are 4 contracts of sale. 2. Each relates to a property in a different state.  3. The contracts are interdependent.  A contract can only settle if all the other 3 contracts also settle simultaneously. 4. One contract relates to a property in Victoria where PEXA settlement is mandated, and the transaction does not fall within the list of PEXA excepted transactions issued by LUV.  5. The 4 contracts may have the same vendor and purchase entities. 6. Or, they may not - for example, the 'vendor' may hold the properties in the various States under different corporate entities within the same group.   Questions: 1. Does the fact that settlement of the Victorian transaction is mandated to occur in PEXA mean that we must insist on the other contracts being settled in PEXA too, even though they are not mandated to do so in those particular States?    2. What if one of the contracts in a non-Victorian state cannot settle in PEXA for any reason, yet we are mandated to settle the Victorian contract in PEXA.  Are we somehow required to facilitate simultaneous paper/PEXA settlements and how do you propose we do this?   3. Can we settle ALL the contracts in paper, on the basis of their interdependency, and the lack of PEXA mandate in the other States.  If so where is this provided for as this does not seem to be an option in the exceptions list issued by LUV and we would require certainty that this is acceptable before proceeding to exchange contracts drafted on this basis.    Many thanks, Angela        ... Whilst the SRO has updated it systems to deal with complex transactions,  its publications refer to you being able (not required) to undertake complex transactions in PEXA from 17 June.  I understood that the actual mandate for having to do this was 1 August.  Is this correct or are we REQUIRED to lodge and register complex transactions through PEXA now?  We are getting conflicting advice from LUV and SRO on this.  Thanks Angela   ... Hi Paul,   This doesn't quite deal with my first question which relates to one transaction. Usually exchange of contracts will occur and then, some 30/60/90 days later, there will be a settlement.  However in some instances we may need to exchange and settle the same transaction simultaneously, on the same date at the same time.  Rgds Angela   ... 1.  Please can you advise how it is anticipated we deal with a transaction involving a simultaneous exchange and settlement ie. one transaction in which we must exchange and settle at the same time, as distinct from simultaneous settlements on multiple transactions?     2.  How are practitioners dealing with the handing over of documents that would normally occur at settlement?  For example, are Vendors generally  holding onto them until settlement has occurred and then delivering them to the Purchaser or vice versa?  Are undertakings being given to support this?   Many thanks   Angela   ... Is there a way to filter by workgroups yet?  We have multiple workgroups that lawyers are members of (so that they can cover matters when needed etc) but most lawyers will have one or two that they usually operate in.   This functionality is really key for us.   Many thanks Angela   ... View more

Signing FSS and verifying/authorising funds

I have a question re the timing of signing the FSS.  I had anticipated that our internal firm process would be in 3 stages.   1.  Our practitioners would SIGN the FSS, as they are the ones handling the transaction and agreeing the Statement of Adjustments. 2. Having signed the FSS as correct, they would then email the relevant accounts administrator asking them to VERIFY that the funds are in the trust account.  3. Once verification has taken place, they would then email the relevant authorised parties asking them to AUTHORISE the source funds transfer.   However on the PEXA site is says that verification and authorisation must be  done before you sign the FSS.  Is that the case?    Many thanks   Angela      ... Presumably I am able to invite a caveator's lawyer into my workspace for the purpose of them withdrawing a caveat affecting a title on settlement.  Is there functionality to invite a caveator's lawyer for the purpose of consenting to a transfer, rather than withdrawing its caveat?   Many thanks Angela     ...
