If you are acting for a vendor and a caveat from a third party needs to be withdrawn from the title at settlement but the caveator is not legally represented how is this dealt with in  Vic and NSW please?  In Vic does this mean you have to do a paper dealing?  In NSW however,  this  scenario does not seem to be an exception listed in the NSW LRS Lodgement Rules Exceptions List  Thanks Angela  ... Can I please ask about this scenario:   1. Assume there are 4 contracts of sale. 2. Each relates to a property in a different state.  3. The contracts are interdependent.  A contract can only settle if all the other 3 contracts also settle simultaneously. 4. One contract relates to a property in Victoria where PEXA settlement is mandated, and the transaction does not fall within the list of PEXA excepted transactions issued by LUV.  5. The 4 contracts may have the same vendor and purchase entities. 6. Or, they may not - for example, the 'vendor' may hold the properties in the various States under different corporate entities within the same group.   Questions: 1. Does the fact that settlement of the Victorian transaction is mandated to occur in PEXA mean that we must insist on the other contracts being settled in PEXA too, even though they are not mandated to do so in those particular States?    2. What if one of the contracts in a non-Victorian state cannot settle in PEXA for any reason, yet we are mandated to settle the Victorian contract in PEXA.  Are we somehow required to facilitate simultaneous paper/PEXA settlements and how do you propose we do this?   3. Can we settle ALL the contracts in paper, on the basis of their interdependency, and the lack of PEXA mandate in the other States.  If so where is this provided for as this does not seem to be an option in the exceptions list issued by LUV and we would require certainty that this is acceptable before proceeding to exchange contracts drafted on this basis.    Many thanks, Angela        ... Hi Angela   The ability to support Complex Assessments is now available for use, both in PEXA and SRO VIC.    The capability to support mandated dealings is always released in advance of mandate dates in order to allow members to become accustomed to the new features at their own pace.    The mandate, as specified by the Victorian Registrar remains unchanged.    Until the mandate comes into effect, there is no requirement to lodge dealings subject to Complex Assessment via the electronic channel.   Please let me @GeorgePolus know if you have more questions.   Regards, George ... Bump on this request.   This will become more and more useful as an increasing volume of workspaces will lead to some being assigned to different staff members.   It would also be extremely useful to hide development workspaces created by PEXA Projects from cluttering up the list of regular workspaces. ... Hi @AngelaToler,   You would sign the FSS last, as signing it means you have checked/confirmed that all monies are correct and available.    For example, if in the source funds section it states the 'available' funds at the top you should also check the tab to ensure the funds are actually ready. I had a settlement take place yesterday where the source funds was showing the amount, but when I clicked the tab it stated the the funds were not ready. So I had to wait for the other side to verify and authorise the funds. Once that was done I was able to confirm that all funds were correct, ready, and balancing, and therefore could sign the FSS as correct.   I hope that makes sense!  ... View more

Hi Angela,   Yes.     From PEXA R8 (May, 2018) a new Disbursement line item category will be available in the Financial Settlement Schedule.   It will be named:   GST Withholding (or similar).   It will work in much the same manner as the current Foreign Resident Capital Gains Withholding (FRCGW) disbursement line item category value works.   That is: Upon selection of the category value: PEXA will auto fill the ATO BSB and Account Number fields; PEXA will make mandatory entry of the ATO Payment Reference number in the transaction narrative field. But watch this space.   We are working with the ATO to enhance the experience for our members by building integration to the ATO for FRCGW and GST withholding.     Please contact me @GeorgePolus if you have more questions.    Regards George ...
