I have the same question as i was looking for a Notice of Disposition to send out   I see it was asked in 2018   Any updates?  Am i missing the form embedded somewhere? What has PEXA updated for NOD and NOA to notify authorities post settlement? Let me know   (I am a newbie! I thought I would down tools and get stuck into Pexa!) ... View more

Here's a simple view of the matter: I do not need a bank's involvement in a conveyancing transaction - the bank needs me. If a bank wants me to do it a favour by providing documents that the bank could otherwise obtain from its own customer, then the bank will have to co-operate with me and do things on MY terms! Hi there    Stand alone transfers are mandatory in NSW, but simultaneous or transfers with a mortgage may still be done via paper - though not for long!    The reason you can't open a NSW workspace is because when you register for PEXA you are then able to select your jurisdiction to indicate which State(s) you are transacting in. In your profile setting you should see Profile Setup > Default jurisdiction (in your case it will say VIC).    If you are qualified to practice in NSW, you should contact your PEXA member and ask them what they need from you to update your profile.    Hope this helps!  ... Nakatos,   You seem to make a lot of excuses for the bank not being ready to settle and as always are always happy to handball the blame to the lawyer/conveyancer.   I have had several settlements in which ANZ do not respond or even view messages and then failed to accept settlement date. The whole idea of PEXA is to set a settlement date (which is a legally binding date in the contract (not when the bank decide they are ready) and then all work toward that date. The ANZ not checking messages in the lead up to settlement and then claiming they didnt "accept" the settlement date is not good enough.   I would have thought electronic conveyancing would have been the end of us spending half hour plus on hold to a bank to organise a settlement.......obviously not ... I understand but it should be like a paper settlement, the Purchaser's rep being responsible to enter the information in, thus alleviating any duplicate entries as I have found to happen a few times.  Country Conveyancers have this down pat and there is never an issue and should be standard practice. ... I agree that any password re-set should have a prompt to create an new one on the first login. I also think that the Conveyancer in this instance needs to take responsibility for not checking all details prior to sign off. Unfortunately hacking and cyber crime are common place in today's society and no one is immune. I would suggest a notification can be created in PEXA to alert the user when an account detail is changed at any time after the original input.    The media on this story has been very one sided and I have seen an anti-PEXA sentiment on my social media.    I would like to add though, I was disappointed to only learn about this story through a worried client. I think PEXA should have emailed all users to advise what had happened and give a timely reminder to check all account details prior to sign off (especially if there had been a resent password reset). ... Stamp Duty

Hi Guys,   I have a question in regards to Stamp Duty.   So obviously the duties forms are completed online now and then linked to PEXA, that's fine, but what happens when the Vendor's representative who is in VIC has to send an invitation to the Purchaser's representative who is in NSW? Does this work? Are all the different States duties online connected? or does it have to be completed a different way?    I have one like this at the moment and the Purchaser's representative is having difficulty accessing the form after accepting the invitation. I would really appreciate any advice from anyone who has been in a similar situation or from anyone who has knowledge in the area.   Thanks in advance! ... View more

Hi @AngelaToler,   You would sign the FSS last, as signing it means you have checked/confirmed that all monies are correct and available.    For example, if in the source funds section it states the 'available' funds at the top you should also check the tab to ensure the funds are actually ready. I had a settlement take place yesterday where the source funds was showing the amount, but when I clicked the tab it stated the the funds were not ready. So I had to wait for the other side to verify and authorise the funds. Once that was done I was able to confirm that all funds were correct, ready, and balancing, and therefore could sign the FSS as correct.   I hope that makes sense!  ... View more

That's correct for the Victorian jurisdiction, as per the latest Land Use Victoria Bulletin;    Under Registrar’s requirement 6.5 the following exceptions to lodging using an Electronic Lodgment Network (ELN) include: a transfer is lodged with any other instrument for the same folio(s), including a survivorship application a transfer is of a type that as at 1 March 2018 is not available in PEXA, such as transfers by mortgagees transfers by a minor transfers creating an easement transfers of an interest (e.g. a lease or mortgage) transfers of part of land in a folio of the Register transfers of a tenant in common’s share transfers that cannot be assessed for duty by the State Revenue Office Duties Online – details of the transaction types able to be processed in Duties Online are in the tables of transactions and combinations of transactions available on the SRO website at sro.vic.gov.au/duties-online-transaction-types transfers affecting more than 20 folios ...
