Hi My firm does a lot of family law property settlement and at the tail end of that is the refinance of the property (at times to our client) as per Court Orders.  I have been doing these refinances on PEXA.   I found out today that a "Transfer without monetary consideration" (which is the transfer I use for the above matter) can no longer be done via PEXA ... is this for all these Transfers?   Invariably with the family law matters there is a sum of money that will need to be paid to the other party - so does this mean that there will be a PEXA workspace for that section of the refinance but the Transfer will have to be paper and done separately?? ... First off, I apologise if this has already been asked ...   I am handling a matrimonial Refinance (my client received the property via Court Orders) and is using the same financial institution for the new loan.  I always get confused with regards to the PEXA Workspace fee.   If there is both a discharging and incoming mortgagee are they responsible for the PEXA Workspace fee that currently shows against my firm's name?     This always confuses me and I would like to find out finally so I don't stress with other matrimonial refinances our firm does. ... I am lost as to what to do with regards to a Lease the Lessor is currently attempting to have registered.  I act for the Lessee - this is a renewal of Lease as such there is no Lessor Disclosure Document etc - which apparently have to be uploaded as "Conditions and Provisions" ... In this case would I just upload a full copy of the Lease document?   PS this is my first Lease on PEXA so I really don't know what I'm doing.     ... View more

New Subdivision - Transfer

Hi, In August 2017 we exchanged COS for land that was awaiting subdivison.  Due to the time constraints re: payment of stamp duty the COS & Transfer were stamped in January 2018 and payment send to Revenue.   The documents have FINALLY been lodged with NSWLR for registration.  The matter is now going to settle via PEXA in this instance what do I do regarding Stamp Duty - do I just enter the OSR Reference and it will be noted as paid??   Thanks Karen ... I am attempting to settle a discharge  - NAB being the discharging ... settlement is at 3pm it is now 2.46pm and they still are waiting the "updated payout figure"  why is with the paper settlements final payout figures were provided the MORNING of settlement!  This is just not good enough and basically you waste and entire day constantly checking PEXA  just in cause you have adjust surplus funds going to your client because the Bank can't get themselves organised  ...
