Hi AngellaC,   Thank you for your quick response.    I do not know if CBA had a paper Title or non-issue.  Based on what you have said, I assume CBA's practice will be to request a paper Title that they will then forward onto us.   kind regards  Tanya   ... View more

Can anyone tell me how to create a Survivorship Application for a mortgagee on Title?   Scenario:  Mum and Dad have a second mortgage on their son and daughter-in-law's Title.  Dad has now passed away and as such the mortgage needs to be registered in Mum's name alone.     I originally created a Workspace as mortgagee on title but was unable to indicate that Dad was deceased and as such could not create an ASP.  I have also looked at creating a Workspace as "To deal with an interest" but had no luck there either.      Any assistance/suggestions greatly appreciated.   And to add to it all, following the ASP the mortgage will be discharged.   ... Upon completion and lodgement of a Transmission Application it was realised that the wrong proprietor on title was selected as the deceased person.  What is the best process for correcting this error?  Can it be done in PEXA or do we need to forward paperwork evidencing the deceased (and the live) proprietor to The Registrar? ... Hi @MDela,   Have you been given or worked out a solution to your problem?  I am keen to know as we have a similar issue.   We had created a Workspace for a stand alone Survivorship, had created the Nomination, signed and submitted lodged it for lodgement.  However, when we went to sign the Survivorship it would only let us edit it.  Having had this same issue with a Discharge of Mortgage only last week, I knew to go in and edit the parties names in the participants tab (because PEXA automatically brings in their first and second name in the one box you have to separate them).  I then went back to sign the Survivorhsip only to find it had been deleted, the Nomination lodged and the Workspace completed!  So, given what you have experienced we will no doubt be faced with the same issue. ... We are dealing with a matter whereby Mum & Dad and son are registered on Title as tenants in common;  Mum & Dad are joint proprietors as to 2 of 3 shares and son as sole proprietor as to 1 of 3 shares.      Mum has now died and an ASP is required for Dad.  Are we able to do this on PEXA or do we need to lodge via paper?   NB: property is located in VIC ... Hi Jennifer,   As you can see no one has responded here however, upon further investigation and through trial and error we have established that when you nominate the Title you select "No" to retaining control and then in the Lodgement Instructions you select a paper Title be issued to you.   cheers Tanya ... Good afternoon,   Is the following transaction on scope or do we need to complete on paper?   Dad, Mum and Son are registered proprieters as TIC - Dad and Mum as JP and Son as SP.  Dad and Mum are now wanting to transfer their tenancy to Son and Daughter-in-law as JP.  The consideration will be natural love and affection and the proeprty is a family farm.         ... @bspinner  I note your reply to @SimoneC  above.     Last week our firm registered a Survivorship Application for which we were the CT Controller.  As we held a pCT we had to nominate to an eCT and, in the process of doing so, we selected that we were to retain CT control.  This then led to some confusion in completing the Lodgement Instuctions for the ASP as we could not request a paper Title issue to us.  Should we have selected no to retaining CT control and then selected a pCT issue to us in the Lodgement Instructions for the ASP?  Or does LUV recognise that we converted to an eCT and will automatically issue a new pCT to us? ... @AnnPC  I note your comment that Bendigo Bank will no longer charge a consent fee for matters being transacted in PEXA.  I am in the process of registering a Survivorship Application the Title to which Bendigo Bank are the eCT Controller.  A conversation has sent by the Bank to us on 29/03/2018 asking us to upload a copy of the Death Certificate (all good and can do) but to also send a cheque for the consent fee of $150.00 to the Consents Department.  Should I write back and point out that this fee is no longer required? ...
