Hi, Have you uploaded the Subdivision Act - Section 34(2) document into Files first. I act as interest holder when lodging S173 Agreements (over part land) via 104 applications and can attach the document as a supporting document. After you create the 104 document it should show on the screen the requirement to attach a file. Is there a current list of what can be done on PEXA for NSW and Queensland and ACT. I need to complete a Transfer of Interest (of a mortgagee), I am familiar with the dealing in Victoria, and can find the help card for NSW, but cannot get certainty for Qld or ACT.   I do understand that the type of dealing may not be available on PEXA in those two States, but it would be helpful to have a list to cross check. Good morning, Hunt & Hunt Victoria do act for Defence Bank, but the initial contact should be made by the borrower to Defence Bank as they initiate the discharge process internally.  Defence Bank then provide instructions to Hunt & Hunt Victoria once the discharge authority has been completed.  Hope that assists you. ... Westpac Discharge Non Acceptance -

Hi,  We act for an Executor, registered on title. Westpac previously nominated the title to allow the Transmision to register in 2019. The property has now been sold. A discharge of mortgage was lodged by email and was acknowledged on 3 May 2021.  Settlement of the property is due on 19 May 2021. Suddenly and out of the blue, yesterday 13 May 2021 w Westpac  "declined" our invitation with the following message and has disappeared from the workspace:   "Hi team-could you please provide the Westpac customer number or the BSB and account number as we are unable to verify the customer's details in the Westpac database. Regards"   We had loaded in the Files, a copy signed discharge authority that had been emailed, and copy correspondence from the previous Transmission with Z number and matter reference.  The fact that Westpac cannot locate the customer's details in their data base seems ridiculous as they are registered mortgagees.  They have simply abandoned the workspace and left the whole transaction in limbo.   We have been unable to get through on the Solicitor hotline, and as this message is being prepared, have been on hold for 25.34m.  No one is taking responsibility.   As Westpac have delined the invitation we cannot initiate a conversation, and we are left, with settlement due on 19th May, effectively having to start all over again.   Is there anywhere or anyone at Westpac that can assist?           ... Hi, please see Fees, guides and forms (land.vic.gov.au)  and you will find the Guide to applying for a new Folio of Register  You can do in in PEXA in residual documents. This guide sets out the requirements to lodge an Application for new folio of the Register – form 11, under the Transfer of Land Act 1958. Hi, the requirements for related party transactions are:  Related party including associated or fractional interest transfers | State Revenue Office (sro.vic.gov.au) I have recently completed 2 or 3 related party transactions on this basis, without any requirement for bank statements    The additional requirements regarding evidence of bank statements etc. is usually only in the circumstance where settlement has taken place, and you are attempting to obtain a refund.  Is that the case in your circumstances?     ... This is really a great result.   It is an example of a full team approach when Subscribers really do have a voice and PEXA took up the request and ran with it.  Thank you.   Now to push the envelope a little, and we all like a challenge -   In the circumstances of Transmission and Survivorship Applications, we still have to draft a standalone Notice of Acquisition Smart Form on the SRO website.  Will a NOA be generated in the Workspace (as for transfer workspaces) at some time in the future for these types of documents.   Cheers all ... @JonTeh This is wonderful news.  We experience difficulty every time we try to lodge a S173 paper dealing (over part land eg. unregistered plan in play) as it doesn't meet PEXA requirements.  We have to go to the LTO and experience push back every time...  Now, it appears that problem is solved so it will make things so much easier in those circumstances. ... Good morning,   I have been dealing with City West Water in relation to this issue.    For certainty their notification should be read as: the form of Notice of Acquisition that is prepared in PEXA should be printed to pdf. and attached to an email to the water authority (and applicable council).  They do not want to receive the electronic NOA smart form from the SRO web site.  Their preferred email address is <NoticeofSale@citywestwater.com.au  I have been using this process successfully with the other water authorities.   Cheers,    ... Hi @KR, not necessarily.   As a subscriber  we have an automated debit for PEXA service fees, they are not automatically loaded into the FFS destination schedule when we act for either a Vendor or a Purchaser.  We have to enter this $114.07 amount ourselves in our destinations.   For subscribers without an automated debit set up, I can't comment as I don't know.   Kind regards,  ... Hi, the $114.07 is a service fee payable by a Subscriber for using the PEXA workspace.  It is not a registration fee for Land Use Victoria.   If you have set up an automatic debit, this fee will be debited from your nominated bank account.    If it  has been agreed that the purchaser pays your fees, then they can set up a destination line making payment to you (as a reimbursement) to your nominated bank account.   Hope that helps. ... Hi Brianna, this may start being an issue in Victoria also. Currently we set up a Notification to the agent, which is an email from Hunt & Hunt (via PEXA platform) that settlement has taken place, and that they can account to deposit money held in trust to their company in its own right for commission expenses.  It is provided to ensure "real time" notification of settlement and facilitate key release. We have started to get phone calls from agents asking us to confirm settlement has taken place, although they have the email and in one settlement this week, we were asked for an additional letter on letterhead.
