Hi @CindyBrown,   The current wording can be found on the land tax payable document.  My understanding is there are plans to include this wording in a variety of documents as well as commentary on the RNSW website.   Re:  "Also, how is this going to work when the paper waiver ends on 31st March and the purchaser refuses to settle without a clear land tax certificate regardless of being "able" to pay it in PEXA" . Understand your concern.  This is where messaging on the RNSW website and associated documents will be important to ensure everyone is aware of the new process.  The Law Society are working with RNSW to facilitate some communication.  I also understand from the ORG they intend to provide some communication on the matter prior to the expiry of the waiver.   Hope this helps! cheers Belinda ... Hi @AndrewK,   That does sound onerous.    My understanding is you would only need to get the land tax payable letter if the Section 47 returned saying there was Land Tax payable.  In the examples below, did you order a Section 47?  If there was nothing owing, there should be no need to request anything further from Revenue - they only generate the letters if there is a debt outstanding.   There is some work going on at the moment with RNSW and the Law Society to fine tune the process and communications will be made available at the conclusion of this activity.   cheers Belinda ... Hi @Cory,   Yes good question.  The long-awaited Notice of Death will be available in Release 11.1.1, scheduled for 14 March.  This was pushed out a couple of weeks from the original date in February due to some delays.  Details of this release can be found here .   Change of Name on the other hand, will be one of the first document types released under the new Residual Documents Strategy.  The RDS was developed to speed up the introduction of the long tail of documents required to reach 100% digital.  The RDS provides a framework to enable NSW LRS to design the remaining forms at their own pace.  NSW LRS have proposed Change of Name to be ready in the March/April timeframe.    Meanwhile, Release 11.1.0  features an increase in scope for part tenancy transfers, to enable joint tenancy matters to be dealt with using part tenancy functionality.  R 11.1.0 will be available in production 10 February.  Details are here.   Thanks for your patience! Dear Community,   Some community members have asked for more information on the expected timeframes for electronic dealings to register in NSW.   Some lodged electronically are auto-registered, in which case the registration can take place in a matter of minutes.  But what about those that are manually examined?  And which documents are likely to automatically register?   NSW Land Registry Services has service delivery targets for electronic dealings to either register, requisition, refer or reject is: 70% within 2 business days 100% within 5 business days   Several frequently lodged dealings can be automatically registered when transacted through an ELNO. They are: Transfer Mortgage Discharge of Mortgage Withdrawal of Caveat   All other dealing types lodged electronically are manually examined by the NSW LRS team.  There are also circumstances where a dealing that would normally auto-register requires manual examination, such as where there are certain notifications on title or where unregistered dealings may exist on title.    A delay in registration can be disconcerting for practitioners, and indicate further work/investigation may be required.  While caveats do not auto-register, practitioners can have confidence that a caveat takes effect from the date of lodgement.   Tips for community members If you want to keep an eye on a dealing as it progresses, you can utilise the free “Document Inquiry” on the NSW LRS Online Portal to check the status of the dealing by entering the dealing number referenced in PEXA.  To find the dealing number assigned: Access the documents screen from within the PEXA workspace Select View next to the document you are interested in Look for the Dealing No     For information about a specific dealing, please contact NSW LRS.   All the best Belinda ... Happy New Year Community and welcome to 2020.    Sending our love to all communities that have been hit hard by the fires across the state - our thoughts are with you and the dedicated firies battling as we speak.   On the topic of Writs.  Here are the facts:   The RIS or Registry Information Supply that populates the "Land Titles" screen in your PEXA workspace, does NOT show if a writ is on title.  In fact there are a number of 2nd schedule dealings that are not populated on this screen.  See the chart below: 2 nd schedule dealings Dealing In RIS Detected in TAC   Writ No If lodged in TAC period   Charge No If lodged in TAC period   Plan Lodged No If lodged in TAC period   Easement No If lodged in TAC period   Caveat Yes If lodged in TAC period   Lease Yes If lodged in TAC period A writ IS detected in a TAC (Title Activity Check), providing the writ is lodged during the TAC period. The TAC period runs from 60 days before the workspace is opened, then weekly right through until the week of settlement, at which time it will run daily then 1 hour before settlement.   It is imperative that a full title search is run prior to opening a workspace, but equally important the search is completed no earlier than 60 days prior to opening the workspace. It's anticipated NSW LRS will start to send through 2nd schedule dealings information in RIS in the next few months as other dealing types are created for lodgement via PEXA, and require this data eg removal of a writ.   Reminder - the Land Titles screen in PEXA is not equivalent to a full title search. ... Hi @Grant,   Thanks for getting in touch.  The issue here is around the Client Authorisation Form (CAF).  Where a law firm is acting for an appointed Financial Manager, the law firm can have the CAF signed by the appointed Financial Manager, to authorise the firm/subscriber to transact the property.   The subscriber should retain as evidence, in addition to the CAF from the financial manager, the order appointing the financial manager to act on behalf of the managed person.   However, if the property of the financially managed person is being transacted directly by NSW Trustee & Guardian, Trustee & Guardian are unable to get a Client Authorisation from the managed person.  In fact, for the purposes of the transaction, Trustee & Guardian are the person which means the e-conveyancing framework doesn't really fit.  Hence a waiver has been provided for this particular scenario (where Trustee & Guardian are transacting).   Hope this clarifies! cheers Belinda ... VOI and the Digital Driver Licence (DDL)   Dear Community,   The NSW government have launched the Digital Driver Licence (DDL) - the first in Australia, enabling citizens to download a licence to an application on their mobile phone.   While this is a great initiative and a convenient way to carry a licence, it should be noted the DDL has a limited use case under specific acts:   Road Transport Act 2013 Gaming and Liquor Administration Act 2007 Liquor Act 2007 Registered Clubs Act 1976 Unfortunately, the DDL can’t be used as evidence for the purpose of verifying identity in a conveyancing transaction, or to access an ELNO (eg PEXA).   Citizens should retain their plastic licence for the foreseeable future, and practitioners should be aware the DDL does not meet the VOI standard outlined by ARNECC (Australian Registrars E-Conveyancing Council) for the purposes of VOI.   Further information about DDL can be read here and the legislation can be found here.   Best regards Belinda ... Hi @katherineglenn011 @Jessmem ,   We have another thread on this topic here and it is not the first time we have had this request.  The issue is around what is acceptable by NSW LRS and Office of the Registrar General (ORG).  PEXA creates documents in the platform based on the National E-conveyancing Data Standards.  Unfortunately in the data standards, there is no scope for providing a transfer without the consideration.  I have been liaising with ORG on if this functionality is something they would agree to.  Unfortunately the response has come back that they would not support this change and in fact, they are looking to change the rules in paper to mirror this.   Part of their argument is the transmission of the NOS information to the Valuer General means that the consideration amount becomes available shortly after settlement anyway, so there is limited value in leaving it off the transfer as people can find out the consideration within a few days.   For further discussion, please contact ORG-eConveyancing@customerservice.nsw.gov.au.   Hope this helps to clarify!   cheers Belinda   ... Dear members,   There has been some uncertainty around processing NSW Family Law transactions using PEXA.  While work was underway to clarify the impacts of such transactions on our ecosystem partners, Revenue NSW and NSW LRS, PEXA asked members to cease transacting these transactions in PEXA, and to utilise the current waivers in place for processing in paper.  I’m pleased to advise work in this area has completed with the following transaction types now back in scope for processing in PEXA:     Transaction Description Example Outcome 1 (A+B)->A Where A+B are joint tenants and one is coming off title.  Divorce Can be transacted in PEXA. Please see the following Community page for more details. 2 A->(A+B) Where A is bringing B on title as a joint tenant. Hi @LeahStevens,   I've asked the question at Revenue NSW - just waiting on an answer.  I think there are some issues that prevent the debt letter from being auto generated.  The Vendor would need to contact Revenue NSW and then request the total outstanding be calculated, and a letter outlining the total debt owing.    I'll update once I have further information. cheers B ... Just like the invention of colour TV, Land Tax can now be paid on settlement utilizing the PEXA Platform!   Land Tax can be paid at settlement in a PEXA transaction without the availability of the physically stamped clearance certificate.   The solution was agreed between Revenue NSW, PEXA and the Law Society of NSW.   The solution required the following changes to satisfy parties, which were implemented earlier this year:   BPAY payment details available on Revenue NSW documents A document provided by Revenue NSW explaining the Land Tax payable Inclusion of agreed wording by the Law Society explaining the practitioner can be comfortable to settle Hard-coded BPAY biller details in PEXA against a new NSW Land Tax payment destination category Ability to upload Revenue NSW documents in document hub (existing functionality) The process is as follows: Purchaser or Vendor representative uploads a copy of the Land Tax Clearance Certificate (Section 47) to document hub in the workspace (under Revenue Office Documents) Vendor representative uploads the Land Tax Payable letter provided by Revenue NSW to document hub in the PEXA workspace (under Revenue Office Documents), and any additional documentation provided by Revenue NSW detailing outstanding debts (if applicable) Vendor representative creates the line item for payment to Revenue NSW, choosing the category of NSW Land Tax, with the amount as per the documents After settlement, the clearance certificate can be obtained online here by the Vendors representative 48 hours after settlement.  Note there is no requirement for this certificate to be obtained or provided to the purchaser. Hi @DZTS,   PEXA designs the functionality in PEXA based on data standards provided to us by the Land Registries in each jurisdiction. We are required to adhere to the data standards.  In order for for us to make the change in PEXA to allow transfers to not display the consideration, agreement is required from our government stakeholders.   I'm aware there is a discrepancy between what was allowed in paper, and what is allowed electronically which may have been by design rather than accidental, as government look to achieve certain goals through e-conveyancing.  Having said that, I think NSW are open to changing this, and the topic is being debated.  Once a decision has been made, PEXA will insert this into our development schedule - noting existing priorities and the urgency NSW government place on this.  I will certainly pass on the feedback from this thread and endeavour to have this escalated.  NSWLRS will need to make some changes at their end to accommodate also, but hopefully we can have this up and running sooner rather than later as I know this is important in certain transactions.   Hope this helps to clarify!   cheers Belinda ... Revenue NSW have made some changes to the messaging practitioners receive when verifying duty in PEXA.  These changes are an exciting step forward, enabling practitioners to self-help when they receive a verification error.  The messages came into effect in August and detail the title reference or name causing the stamping mismatch, enabling swift resolution:   Error New Message E114 Please match the incoming proprietors name (xxx) in your workspace with the liable party name on your Duties Notice of Assessment.  Check Revenue NSW website for further help with verification service. E108 The land title reference provided (xxx) does not match Revenue NSW records. Hi @fadichahine ,   The short answer is, an electronic settlement is required and the citizen needs to be represented in the workspace by a PEXA subscriber.   The 2/2019 waiver to Conveyancing Rule 8.7, allows for paper lodgement where both the transferee and transferor are not represented by a legal practitioner or licensed conveyancer and the transfer is standalone.  This waiver is designed to cater for transfers between family members that may not engage legal representation.  https://www.registrargeneral.nsw.gov.au/publications-and-rules/conveyancing-rules-waivers   In the case you describe below, the citizen would need to be represented in the workspace by a PEXA subscriber for the purpose of completing the transaction.  They may opt to be represented by a lawyer, conveyancer or e-lodgement agent.   cheers Belinda ... Hi @Ashlee ,   Unfortunately writs or the removal/cancellation of, can't be transacted in PEXA.  See the list of eligible dealings on the LRS Registrar General's Guidelines here.  Land Registries in our live jurisdictions and PEXA are working together towards 100% digital lodgment and a road map of residual dealings are prioritized nationally on a regular basis.   There is no date yet for writs in NSW.   cheers Belinda   ... Today, 1 July 2019, marks the next milestone in e-conveyancing in NSW, with the mandatory e- lodgement of mainstream dealings.     As with any new process change, we need to be prepared for the curve balls.  One of these is the scenario where practitioners settle in paper but later discover their transaction falls within the list of dealings required to be lodged electronically.  Never fear, the team at PEXA have put together two documents outlining the process to lodge using PEXA once settlement has taken place. Good afternoon NSW members,   With just FIVE days to go until 1 July, I thought it would be timely to put some last minute links and resources together for you:   Circular - announcing inclusion of dealings in 1 July compliance date New Conveyancing Rules  Waivers in effect 1 July Land Tax - in place while practitioners get comfortable with the new functionality to pay land tax in PEXA Mainstream Dealing Exceptions - all other waivers to the mandate in one document Mortgage Certifications  - certification wording Participation Rules Waiver - certification wording Conveyancing Rules Exemption Form 2019 - If you need to rely on a waiver to lodge in paper, you will need to complete this form in conjunction with the above links to adequately populate the form with the correct reference. What to do if you have settled in paper but are unable to lodge? Stand by - PEXA will release 2 documents prior to Monday explaining how to complete a transfer and a transmission application in PEXA after you have settled in paper. How to pay land tax via PEXA?  Revenue NSW and PEXA, in conjunction with the Law Society, have developed a procedure and associated system changes, to enable practitioners to pay Land Tax at settlement in a PEXA workspace with comfort for the incoming party that the debt has been cleared.  The solution utilizes the upload of the Section 47 and associated debt letter, into the Document Hub.  Detailed instructions are being created for distribution shortly. Hi @CT @christine4711    Good news, the standalone Change of Name document in PEXA is scheduled for Release 11.1 in February next year (2020).  Initially the document was scheduled to be deployed this year but was unfortunately pushed back due to competing priorities at NSW LRS.   UPDATE - The Change of Name document will be created under the new Residual Documents Strategy, which enables LRS to build this functionality using a standard set of building blocks.  Our understanding is they will have this document ready for launch in the March April timeframe (2020).   cheers Belinda   ... Preparing for July - NSW Transition to Digital lodgment - Webinar     On 1 July 2019 all mainstream conveyancing transactions will transition online in New South Wales. The proposed scope, as per the draft conveyancing rules version 5.0, is Discharge of Mortgage, Transfer, Mortgage, Caveat, Withdrawal of Caveat and Transmission Applications.     To ensure you’re ready to transact digitally, the NSW Office of the Registrar General, Revenue NSW and PEXA will be hosting a webinar on Tuesday 4 June, 10am AEST. This will cover a half hour presentation about the scope of 1 July, updates on bulk conversion of paper titles to  eCT  and documents yet to transition to digital. Revenue NSW will update us on land tax & complex stamping arrangements.       We’ll then open the floor to you for a 30-minute Q&A with our industry experts.     Register here to attend.     See you there!      Belinda     P.S. Hi @George1 ,   Great questions.  We have covered a few topics in this thready so just to clarify, here is the situation with each of these items:   Order on the Agent - This enhanced functionality was introduced to our platform in May 2018 - You can access this in the notifications section in the workspace Section 22 (Notification to strata bodies) - You can use PEXA to send the email notification, but the Section 22 document needs to be uploaded to the Document Hub  in order to share with other members in the workspace, and would need to be transmitted outside of PEXA to the applicable body Notice of Sale - As has been the case since we launched in NSW, the NOS is created in PEXA and transmitted to the Land registry and then forwarded overnight to council and water. cheers Belinda ...
