We’ve been advised that some members have encountered an issue where the Mortgagee on Title has selected the “assign to me” for the Vendor’s Surplus in situations where they are not handling surplus. Please note that the “assign to me” function currently does not allow a practitioner to take this assignment away from the Mortgagee on Title and assign it to themselves instead. The Mortgagee on Title who has selected “assign to me” in error must unassign it from themselves. If for some reason they fail to unassign, the following steps can assist practitioners who are handling surplus:   If, for example, the Mortgagee on Title had selected “assign to me” in error, a Practitioner acting for the Proprietor on Title can enter a Destination line item for Vendor’s Surplus. Noting that the amount for this line item will not be auto-calculated as part of the FSS, but the amount can be manually entered. This will reduce the auto-calculated amount for the Mortgagee on Titles Vendor’s Surplus, by that amount entered.   We’re always eager to hear about your experiences in order to help us continually enhance the Financial Settlement Summary. Hi Emma   If at the time of purchase it was a non-issued title, unfortunately you will not have the option to receive a duplicate title to issue as a part of the settlement in PEXA. If it was an issued title at the time of purchase, you would have the option to request a duplicate to issue within the PEXA settlement.   It is part of Landgate's policy that a title will not be issued, where one previously hadn't been. However, on their website under Policy and Procedure Guides, it provides that:  Where a duplicate certificate of title was not previously issued, the registered proprietor(s) may make application on a General Application Form, without payment of a registration fee, for a duplicate title to issue. Also for your info, there is a Transfer of Land Amendment Bill 2021 which is expected to be given proclamation in the later part of the year following debate in both houses. One of the amendments to the TLA will be to removes duplicate certificates of title from the conveyancing process. But for now, your cash buyer could obtain a duplicate post settlement, via the above process if they wanted to.   Cheers! Rebekah ... View more

Hi Everyone I am aware that some parties may be encountering some Lodgement Verification and Certification issues when discharging a second Mortgage if there is an issued title. Just a reminder that you can discharge a second mortgage without the need to hold the title (as per the paper process) if you ensure that the “Issuing Instructions” in the Lodgement Instructions (in the Documents screen) are set to “Please Select”, ie; there are no issuing instructions. This will remove the need to enter any “Holding Details” for the title. Just to note that the “Issuing Instructions” default to “No Duplicate to Issue” so do need to be manually changed back to “Please Select”. Hi Everyone,    Further to this, here are other important times in moving settlement:   During summer – when the Eastern States have daylight savings time: The last timeslot you can book a financial settlement time (or manually change a time to, before the 1pm cut off) is 3:30pm WA time. You can manually change the settlement time before 1pm WA time. A settlement will roll for the last time from 1:30pm to 2pm WA time, and then fall off for the day if the Workspace is not in a “ready” status at the allocated settlement time. A standalone document (ie a Caveat) can be lodged up to 4:30pm WA time.   Otherwise – when the Eastern States have standard time: The last timeslot you can book a financial settlement time (or manually change a time to, before the 2pm cut off) is 3:30pm WA time. We are delighted to update you that the issue with stamping “One-named parties” appears to be resolved. The time range will differ in each state, depending on when the Land Registry will accept lodgement of documents and when the RBA closes. In WA for example it is between 8:30am - 3:30pm, on every half hour in between. I believe this will increase in WA by an hour with daylight savings time. ... View more
