Thanks for your question @Brooke   ARNECC cover this in their MPR Guidance notes for VOI - Clause 5.6 namely    Previous verification of identity Where a verification of identity has occurred within the previous 2 years (either by applying the Verification of Identity Standard or some other way that constitutes reasonable steps), the person’s identity does not need to be verified again, provided the Subscriber takes reasonable steps to ensure they are dealing with the person who was previously identified. Hi Jgibbs Thanks for your question.   Are you registered for Revenue Online?  When you register as a user of Revenue Online Lodgement (ROL) you are provided with your unique OSR code.  Below is a link which I hope will be useful for you. https://www.finance.wa.gov.au/cms/State_Revenue/Online_Services/Online_Services.aspx Just a reminder that presently, contracts must be within the perimeters for self assessment via ROL,  in order for settlement to be completed electronically via PEXA.  I hope this has helped with your query today. Great tip thanks Lyn !   We also often see the duty not verifying for the following reasons:   (1) DOB for sellers is missing from the workspace - If you check the participants screen and the sellers have a blue "i"  next to their name, you can send a conversation to the sellers agent asking them to complete this information asap.  It is important to note, you will not get an error message in your transfer duty screen in this instance.   (2) Incorrect Tenancy for Seller - You will need to ensure the tenancy of the sellers is correct as ROL defaults to tenants in common unless changed otherwise.   As the workspace attempts to verify with ROL,  it will be looking to match the information pulled through from Landgate (can be found via the Land Titles tab).  The error message in PEXA will indicate there is an issue with the share fractions for the Transferor and  ROL will need to be updated in this instance to reflect the correct tenancy of the sellers.  Once the new ROL certificate details are entered, the workspace will again verify the duty.   (3) Entering the No Double Duty certificate number into PEXA - The workspace will verify using only the first certificate printed as it recognises that the duty has been paid on this certificate.  Note, an NDD certificate is not required for an electronic transaction.  Some members continue to print NDD's just in case the transaction needs to revert to paper.   Happy verifying    ... Is it possible for an abandoned workspace search to include those workspaces in the abandoned tab on the main dashboard?  Over the past weeks, when doing a search using the workspace ID, it comes up as no search results found, however, if the member has been the last person out of the workspace, the workspace is actually showing in the abandoned tab, yet didnt come up in search?? ... Hi Damien In my experience, any workspace that you have withdrawn/adbandoned from where there may have been a pending or declined invite,  will remain on your main dashboard menu, as per your picture above.  It may also indicate that the workspace is still live (with a participant still active in the workspace).  I suggest to my clients to send a conversation to all other participants in the workspace asking them to withdraw from the workspace citing the reason why, and where possible, that same client be the last to withdraw from the workspace.  If all other participants have withdrawn and you are the last to withdraw, the workspace will move from your active tab to the abandoned tab on your main dashboard.  Hope that helps :) ... This week saw another Perth Hills settlement agent complete their first electronic settlement.   Jarrah Settlements based in Roleystone,  were encouraged by colleagues Roleystone Settlements,  to get onboard the PEXA train.  Below is Adam Haigh smiling as his settlement goes to ready ready   When the workspace was at settled and lodged, Adam called his seller client Sue to advise the good news.  Sue was outside the office at the time of the call and came in to watch the workspace disburse.  At 12.24pm the workspace notification advised funds were disbursed.  At 12.26pm, Sue logged into her banking app on her mobile to see her cleared settlement proceeds in her ANZ account.  Sue was ectastic, so much so, she took a photo on her phone of her completed workspace, to send to a friend.  Sue was super lovely and ready to embrace her sea change to Hervey Bay - we wish Sue well and safe travels as she drives across the Nullabor!       Well done to Adam and his team, firstly for getting his big toe wet with the completion of his first PEXA transaction and secondly, sending his client off singing the praises of PEXA.   This was a first for me to meet a client whose transaction was settled in PEXA.  It is reactions like Sue's that make the job worthwhile - PEXA making a difference in her life by having cleared funds to help her on her way soonest.    The day got better with coffee and cake from the cafe and bakery next door to Jarrah Settlements.   A DAY IN THE LIFE OF A PEXA DIRECT SPECIALIST!!   Adam Haigh   ... Transfer duty in WA - General rate vs Residential ...

Transfer duty rates in WA vary and none more than the general rate vs the residential rate.  The majority of transfer transactions would fall into the residential rate, but what would the answer be to the following scenario:   Buyer purchases vacant land Buyer has entered into a building contract prior to settlement In a manual settlement, when lodged in ROL, the buyer is eligible for the residential rate of duty rather than the general rate (which applies to vacant land without a building contract); often the difference between the two amounts can be approx. $1K. Will there be an issue with verification of transfer duty in the electronic space in this instance?  Presuming the property information data is populated as vacant land?  As property information is not required for transfer verification, will it just be a case of the workspace will not go to ready ready if it cannot match ROL data vs property information data.   NB – Manual settlement - In the instance of the buyer signing a building contract after settlement, they pay the higher rate at settlement for transfer duty and then claim the rebate directly back from OSR  ( cannot claim rebate via ROL and must be done at OSR counter).  They are required to provide proof on what was paid at settlement, together with a reassessment form and copy of the building contract.   Bit of a curly one !   @AnneLynch ...     PEXA making settlements easy as ABC !   I had to share this email from an avid subscriber......Raelene is a PEXA advocate and spruiks to as many people that will lend their ear to her, on the benefits of PEXA to their business.  Raelene certainly is about working smarter not harder...   Hi Fiona   I have an ugly cold/flue.  As you know, “ I’m it”, so regardless of how I feel the show must go on.   Off to Scott Ashwood I went, sick as a dog and sat in a corner at the back of the room and advised everyone to stay away lest they also be infected with my lurgies.  As I coughed, sneezed and blew my nose through the proceedings  and looked an absolute treat, most were happy to avoid being too close to me.   Enter, other settlement agent, also having a bad day.  Staff away and also not feeling well.   I promptly advised him that I could be in my pj’s sipping hot cocoa watching this settlement go through on my computer and so could he for that matter, if he would only register with PEXA.  Then the issue is raised on problems with PEXA, such as double dealings, stat decs and fees.    Not being well and not wanting to be at this settlement, I advised the whole room, which was crowded, that most things could be dealt with, if you actually use the system and ask the support crew.  In fact there was a problem that delayed the settlement for 20 minutes, that would not have arisen if the settlement had been conducted on-line.    I have another settlement tomorrow at SAI, so everyone will hear, again, why I don’t need to be there spreading my germs.  Very soon, people will agree to conduct electronic settlements with me to avoid being nagged!   Kind Regards   RAELENE BENNETT SETTLEMENTSWA.COM PTY LTD ... Hi Carl The first course of action would be to revoke the authority of the previous employee to prevent any further use and access to the electronic network.  This includes revocation of the users right to sign and where appropriate, to request the certification authority to revoke the signers digital certificate.  If the previous employee was the subscriber manager,  all administrative rights within the ELN must be revoked promptly. The digital certificate in question can be returned to the PEXA registration team, who will invalidate and dispose of the token in the appropriate manner.    Fiona Rodda ... View more

Hi there Lawyers Conveyancing It is unfortunate that there can be an "all care and no responsibility" attitude from some (not all) of the financial institutions.  In my  experience of similar situations, I have done exactly as you, and promptly pushed back on the bank and informed the client immediately.  I have also found that it depends on the work ethic of particular bank personnel as to how quickly and easily such instructions and or anomalies are actioned/remedied. It has been some years since I have sent a banks discharge authority to a client for execution.  I have been stopped in my tracks by the fear of reprisal as a result of sending an incorrect form, or not enough forms in the case of a refinance.  I always found it odd that so many clients could not or would not include the basics such as a loan account number on these discharge forms.   Keeping it simple can be so hard at times :(  PEXA is currently in consultation with industry forums to  collaborate a national discharge authority, so watch this space !  Ending on a positive - there is light at the end of the tunnel.           ... The funniest feedback we've ever had! Christine - your next lunch during an electronic settlement is on PEXA! You can at least enjoy a nice glass of wine with you 6" subway chicken teriyaki... or you can upgrade and dine somewhere else. I was sitting eating my 6” subway chicken teriyaki when I got an email telling me that the settlement had been effected. M y heart sank as I thought for a minute that I should have done something when I remembered it is electronic and was at ready ready yesterday, to top it off I didn’t even have to let the agent know. A big thanks to Fiona Rodda my PEXA PDS who has helped me complete my dealings and makes me feel very comfortable dealing on the platform. I love electronic conveyancing.
