WA Change of Name - Lodgement Verification Errors

Hi All   You might encounter a lodgement verification error when attempting to lodge a change of name document in sequence with other documents, eg: as part of a refinance. Unfortunately, there is a defect with these cases that we are working to resolve as a matter of priority and we will confirm once it is in order.   In the interim, if you do believe you have encountered such a scenario, please check in with our support team (P: 1300 084 515) in the first instance to make sure that this is the issue with your documents. If so, as a workaround, you can separate the documents and lodge the Change of Name document as a stand alone lodgement in a separate Workspace. If the dealing does not auto-register (ie: straight away), Landgate have kindly offered to expediate these dealings  by sending an email to dealings@landgate.wa.gov.au and including the below wording:   For re-finance - “Document N****** is a standalone change of name lodged via PEXA. It was in a PEXA workspace with a discharge and new mortgage but is affected by the known name justification error PDB-9149 and needs to be lodged standalone. The current mortgagee is discharging the mortgage and therefore has not provided consent. Please expedite the document so that the refinance may proceed”   For change of name and mortgage (no discharge) – “Document N****** is a standalone change of name lodged via PEXA. It was in a PEXA workspace with a new mortgage but is affected by the known name justification error PDB-9149 and needs to be lodged standalone. Hi @Sarah2    When completing any document in PEXA, the Subscriber needs to hold the appropriate authority (Client Authorisation Form) from the party you are lodging the document on behalf of.   In the example below, I presume you would hold a CAF for the mortgagee, but not for the current Proprietor on Title, whom you would need to lodged the Change of Name document on behalf of. If you hold a CAF from both parties to lodge the required documents, then you can complete the Change of Name as well as the Mortgage in PEXA - assuming you are comfortable with any potential conflicts of interest.   Hope that helps Angella ... Hi @Ca55    This will depend on the legal nature of the charity and whether or not you can self-assess the stamp duty applicable to the transaction. Hi @JacSee    As per Landgate's e-conveyancing requirements (as per the below link), all caveats should be lodged electronically (under mandate), and there is a claim category matching your wording available within PEXA: https://www0.landgate.wa.gov.au/for-individuals/legislation-and-reform/Land-Transactions-toolkit/land-titles-registration-policy-and-procedure-guides/practice-manual/electronic-conveyancing/ele-01-electronic-conveyancing    If there is evidence to be attached with the caveat, you will need to upload and attach these files to be submitted to Landgate. Hi @Tanya219    We don't have eCT control in WA. We have some electronic and some paper titles still in production. Do you know if your client's title is currently a paper or non-issue (electronic title)?   If it is currently a paper title that is on issue, then the current holding party will need to confirm they hold the CT and will destroy it as part of their certifications to the Land Registry within PEXA at the time of lodgement. They will then request a new one to be issued (presumably to yourself via mail).   If it is an electronic title, they do not need to do this, but you should ask them to ensure that a new title post the discharge of mortgage is requested as part of the lodgement of the discharge, and this can be sent to you via mail.    Hope that helps.   Thanks Angella   ... Per previous post, PEXA has been facilitating an industry-led pilot to look for ways to improve the online settlement experience for all. Now that the pilot is officially over, we thank the parties involved in the pilot for their feedback. We will use the findings from the pilot to determine how PEXA can be involved in providing more certainty and structure to the online settlement process.   Why run the pilot: PEXA was designed with flexibility in mind and as such allows for parties to complete tasks and finalise Workspaces on the day of settlement. With current market volumes, this is creating anxiety and stress for all parties involved in the online settlement process Our common industry goal is to improve the experience for all parties, and the end buyers and sellers of Australian property by providing more certainty as to the settlement timing This pilot was initiated by industry participants with a view to reduce the day of settlement stress and provide more certainty and structure to the online settlement experience   Initial feedback from pilot participants: This way of working provided more certainty and structure to the practitioner offices Very little negative feedback from clients Clear and early communication with clients is key – setting appropriate expectations Also clear communication with the other conveyancer on the deal was beneficial, especially for handling exception cases PEXA data shows that there was an overall improvement in the on time settlement metrics for the firms involved Bank feedback highlighted the reduction in unnecessary effort on workspaces due that day that then did not settle, allowing them to concentrate efforts on workspaces that all parties, most importantly customers, were expecting to settle   Next Steps: PEXA is pleased with the positive feedback from this industry led pilot, confirming that parties are benefitting from more structure within the process We will continue to look for ways to enhance the PEXA platform to assist in providing more structure and certainty to the online settlement process Any updates to the system will be discussed with industry prior to implementation to ensure the proposed changes work for all parties We would welcome any feedback you have in regards to how the PEXA platform can assist all parties in improving the overall settlement experience   Please note that some of the parties involved in the pilot, for example CS Legal, may continue to work on this basis of reviewing the Workspace the day prior and moving out settlement dates if required, as part of their ongoing BAU processes.     Thanks Angella ... Further to the post above, we are currently working with parties who have volunteered to be involved in the Practitioner led initiative. Together, we are defining the parameters of the pilot, to ensure that we can effectively monitor the results of this initiative. This will provide insights to how we can potentially shape the process to provide more certainty, consistency, and a better overall experience to your online settlements.   Parameters of the pilot:   Parties involved: Banks: ANZ, NAB, CBA, Bankwest, Westpac and St George Practitioners: CS Legal, KDD Conveyancing, Debbie Crawford Conveyancing and Refreshing Settlements    Process: Each Practitioner participant will: At 3pm each day, select and review all workspaces due to settle the next business day, where the above mentioned banks are a party to the workspace Assess each workspace against the following criteria: Settlement Date and Time Accepted by all Parties All required Documents created Stamping has been completed TFRS uploaded or if new Enhanced Settlement Summary is active, Purchaser’s Line Items are completed, and if Bank is providing Shortfall, the “Ready for Shortfall” indicator set. If these 4 Tasks listed above have not been completed, the Practitioner may move the Settlement by 1 business day, including the ‘Reason for Change’ as “WA Pilot for Settlement Cut-Off”.   The application of the cut-off is ultimately at the Practitioner participant’s discretion. Exclusions may be applied to Settlements where the end buyer/seller will be negatively impacted financially (e.g. 3 day grace period, rebates potentially under threat), or potentially for settlements on the first business day of the month due to stamping processes. Please discuss any circumstances that might impact your ability to meet the criteria above with the applicable practitioner participant (noted above), in advance of the 3pm day prior review.   The pilot will run from Monday 17 May 2021 to Friday 4 June 2021. Hi Community,   Right across Australia, the number of property settlements have skyrocketed, with WA leading the charge with a 67.8% year-on-year change in March 2021. These increased volumes translate to higher pressure on people and processes to complete settlements in a timely manner – leading to added stress and frustration.   Our purpose is to transform the property experience for everyone, and we are open to ideas and feedback on how we can help alleviate some of the stress in the process. To do this, we are in the process of establishing Member Advisory Councils in each state (WA being the first to be set up). The council is made up of representative members across the settlement industry to help provide us input on how we can all work together to improve the process.   One pain point highlighted by high volume member firms and the banks is the amount of settlements booked for a day that do not end up settling – which results in unnecessary work for all parties involved. One example cited was a major bank having 1,475 settlements booked on the last day of April 2021, and fewer than 1,000 actually settled on the day.   CS Legal is keen to explore options to alleviate some of this stress on the day of settlement for their team and the other parties in the Workspace, similar to the approach taken by the Department of Communities. CS Legal have proactively approached the banks and PEXA to determine what can be done now – without the need to make any changes in the platform (which may take some time).   The idea is to run a limited, controlled, Practitioner initiated pilot, that is supported by a number of banks. In this pilot, all Workspaces identified will be monitored closely by us and the banks to determine the success of the initiative. Hi @Louise11    You can change the name of the proprietor in PEXA, by editing the information that comes through from the registry. For details on how to do this please refer to this article: https://community.pexa.com.au/t5/Help-Centre/Change-of-Name-Vendor-Help-Centre/ba-p/2891 You will note that there is an "Error in Register" justification reason, which would apply in your scenario.   However, as for the contract and the need to vary this and/or receive a Commissioner assessment, I am unable to advise. If a manual/Commissioner assessment is required, then yes, the dealing will become ineligible to settle on PEXA. You might be best placed reaching out to OSR/ROL direct to ask the query. Hi @Jodietai    Correct - you should be able to proceed on matters for parties with one name in PEXA. It is also my understanding that you should be able to settle these matters on PEXA for FHOG recipients. Hi Everyone   It has been raised by Landgate that some WA subscribers are uploading documents to the PEXA workspace but not attaching these to their registry instrument prior to lodgement,  eg: expired restrictive covenant removal.     Please note that in order for the document to be sent to Landgate, there is a second step requiring the attachment of the document to the registry instrument. Hi @lp1    It also depends on the type of the caveat. You are correct in that generally, and absolute caveat will bar the registration of subsequent documents. However, there can be other types of caveats, such as "subject to claim" which can remain on the title and will not prevent registration of other documents. *UPDATE*   This matter has now been resolved (as of 3 March). If your Workspace was opened prior to this date, you may still be seeing incorrect information on the Land Titles screen, but this can be cleared by completing an "information re-supply" on the Land Titles screen, should you wish. However, please note that there is a small fee for this service and you can proceed as per normal with the Workspace without removing these incorrect entries, if you are satisfied all is in order.   For any Workspaces opened post 3 March, you should no longer see incorrect entries on the Land Titles screen. Hi All   For anyone using the PEXA-SettsPlus integration and coming across the attached error saying "The message has failed schema validation", this generally relates to an issue with the address you are trying to load in PEXA.   The most common cause is if you are using a street with no street type, or have a unit number with no unit type. Please check your address details, correct anything that looks amiss and try and reload your data.   If that does not work, you should be able to use the "complex address" indicator to bypass the error.   If you continue to have issues, please contact our support team on 1300 084 515.   Angella ... Hi @bissets    In all jurisdictions only eligible parties are able to join the PEXA network. This eligibility is set under the Model Participation Rules, as outlined by ARNECC. These can be found here: https://www.arnecc.gov.au/publications/model_participation_rules Licensed conveyancers and lawyers are eligible to join, but individuals are generally not.   In WA Landgate does make allowance for self-represented parties to still lodge any documents in a paper format. Just to clarify after speaking with OSR today, there is a distinction between the Land Tax Assessment Notice and the land tax certificate of charges that is a result of the EAS lodged before settlement.   The certificate of charges does not yet have electronic payment options available, but will do soon. Just by way of update on this post - unfortunately OSR made a recent change to their ROL system and we can no longer verify transfer duty for parties with one name in PEXA.   OSR are working on a fix for this, but as yet, we do not have an ETA. Just a quick note for those who might act for any government entities in WA. When doing so in PEXA you will need to add in a GPR (Government Property Register) code for your client in the Participant screen. These codes can be found via the link below, noting that you will need to enter a four-digit code in PEXA, so please ensure you use both the “Organisation Type” and “Organisation code”, eg: if you are representing the Shire of Broome, please use L001 as the GPR code. Hi Everyone   Did you know that you can transact on a title that is subject to a Registrar's Caveat? There is no need for the Registrar/Landgate to be in the Workspace, but you might see this on the Participants screen - there is no need to do anything with this "Unrepresented Party".   Upon verification of the documents by Landgate, a warning should be displayed in the Documents screen referring to the Caveat, however, the transaction can proceed online as per usual.    Such dealings will, however, not be eligible for auto-registration, and will be diverted to the usual examination queue. Hi @DMc    In WA you can settle deals for parties with one name in PEXA. In ROL you need to enter the party's name in the surname field and in PEXA it needs to be in the first name field. You might find the Troubleshooting Guide for WA stamp duty verification useful for future reference: https://community.pexa.com.au/t5/Help-Centre/Stamp-Duty-Help-Center/ba-p/61 (see the document attached at the bottom of this page).   @Karolidis_and_Co - I know this was an issue previously in PEXA, but that may have changed. @JonTeh are you able to advise re parties with one name in Vic?   Thanks Angella ...
